charged that on the night Of the 2Sth of
August last, the Third ward of Alle
gheny City, ho inflicted a wound upon
Louis Hetnel, of which Ile (Rebel) died
Se,p,tember Sth, at his boar:Blau. house, In
said city. E. P. Stone and J. W. Taylor,'
Esqs.,appeared for the prisoner, and
District Attorney Duff thr the Cotnmen
wealth.

testified that Helsel dled at Ids house,
where he had been boarding for about
two weeks.
-Dr. J. P. Aliont testified that he saw
the wounded man early on Tuesday
morning, August 30th, nearly dead from
henaorrhsge; the wound was on the right
side of the neck; the external Just:ter
vein was severed, and the internal Juan
tar divided; It was three Inches deep,
backward and dovenwani; there waive
alight woundinst below the chin under
the Jaw. A pair of paper hamcere scis
sors were shown, with which witness
was under the inapreaaloff the wounds
might have been Inflicted, the inatru
merit being held with the blades open.
The wound was rho cause of death, •
Ignatius Erfutnif testified that ho resi
ded In the Fourth ward, 'Allegheny; . de
ceased and prisoner (loin brother-in-law,
were painters, and both worked for him
last summer; ou the night of the 27th of
August he and deseased went to the tat--
ern of Mr. Gelb, (witness' partner in the
painting businesal in the Third ward,
Allegheny, and there met Bendier, the
prisoner; they drank bee together; the
time was about ten o'clock; thane woo
some conversation about Bendier's, wife,
who had complained of him for 11l treat-.
meat; after twelve o'clock Bendlerstart
ed away, and called to deceased and wit
aces from the opposite aide of the :street,
using vulgailanguageg deceased aald be
would go aver and see what Reedier
wanted, and followed after into; ultras/a,
alter a low minutes. also 'followed, and
after ho bad gone about forty yards (or
steps) he met dechased, who said he was
cut, and was bleeding from the neck; wit
ness add be did not seethe stabbing, and
did not know exactly where it was done...
Jacob Vogle testified the difficulty
occurred near the:con:ter of Second and
Middle streets, • about half peat twelve_
o'clock In the night.; first saw prisone r
and Ehrhanit (previous witness) quar
reling about melt other's wives; deceased
wan sitting down near them, Bendier
started away and turned Into an alley;
deceased and Ehrhardt talked together
and then started after Readier, alter he
had disappeared in the alloy; deetwaed
was In advance of bilarhanit, and upon
reaching the alley turned into it, but al
most immediately turned - back, and
again had some talk with Erhardt; de
ceased then returned into the alley. With
Ehrhardt, and in two or three minutes
deceased came out with his hands to his
neck and said he was cut; did not say
who cut him. Afterwards, when Lis.
closed was taken to Geib's, the prisoner
was pointed out by deceased as the
man who had cut him, when prisoner
started to nm; he was pursued by a
policeman and arrested.
Joseph Ditrall, of Second street,
gtheny,timitified that on the nigh tln ques
tion he was awakened by bond talking,
and looking out of the window he saw
deceased sitting on the :sidewalk against
Gelb's tavern, covered with blood; asked
who stabbed him, and some ono said,
Ehrhart's brother-in-law, Readier, the
prisoner; at this limo Randier wasstand
mg on the opposite aide of the street.
Bendier was arrested and taken to where
the deceased was; doectased was asked if
the prisoner was the. man who :dabbed
him, and deceased replied that ho was.

Thlnd alley is the one the prisoner went
Into; it Is between Middle and West
streets; paid no attention to the conver
sation between Ehrhart and. prisoner
before they went into the alloy. When
I find saw the parties that night they
were quarreling; had words together;
knew Ehrhardt; did not sea Bendier
attarhe went Into the ally.

Ehrhardt, Headier and deceased on
Middle street, at beib's corner. When
Randier started away demised, who had
been sitting down, got np and talked
with Ehrhardt, and than followed Bend
ier; deceased went into tho alloy, but
came out again and th en both be and
Ehrhardt went into the alley; soon de
ceased tome out and mid ho was cut, and
to go for a docter; could not see what
took place in the alloy lit was too dark)
or hear anything. Witness was standing
on the opposite side of Middle street. In
going towards the alloy the prisoner was
tour or five feet in advance of deceased
and Ehrhardt; they walked slowly.
Mr. Vett recalled—Waited on deceased
1w his last illness; had sorno conversa
tion with him II few hours before he
died, arid after the physicians had told
hintho would die; we ariktel him whether
the statement ho had given us of how ho
was cut was Just. Ile said It was. Do. ,
ceased's statement of the affair was about
as has been detailed by the Witllol3so4.

against him (deceased), when Bendier

good friends, had seen them together

oner quarreling about their selves, do.'

Officer Jamb Surber testified that be
ar rested the tniaoner, who was searched

the prisoner In his cell about an hour af
ter his arrosh . found a pair of scissors
(shown) In his pantaloons pocket; found
no other weapon.
Mn. Leib was examined, but testified
to no now theta; except that when Rand
ier was arrosted he add Ehrhardt must
