The case of the Commonwealth vs.
David Martin, Mary Martin and Robert
Baldwin. aline "Black Bob," indictment,
keeping a disorderly house and fortune
telling, on trial Monday afternoon, was
proceeded with and concluded, the jury
finding a verdict of not guilty upon the
first count (disorderly house), but guilty
Ivan the second count (telling fortunes.)
Shot sentenced.

Minerva Johnston was called to answer
an indictment, the - first count of which
charged
. her with keeping a disorderly
house, and the second with keeping a
bawdy house. D. F. Lucas, Esq., of
counsel for defense, moved to quash the
second count for the following reasons:
First—The prosecution on which the
indictment was framed was commenced
bye private prosecutor, by information
made before a committing magistrate,
for keeping and maintaining a common
disorderly house, to the common. mile
once and of orderly citizens,
but not for keeping It bawdy house and
place for the practice of fornication.
Gamut—The second count 'of said in
diennent was framed and presented to
the grand jury by the Assistant District
Attorney without any previous Informs.

Third-r-The defendant is prepared to go
to mai for the offense charged in the in
formation, but is not prepared to go to
trial for the higher offense charged in the
second count of the indictment and of
which there had been no previous hear-

fendant with keeping a disorderly house
at No. 72 Gibbous-street, 'Eighth ward.
The prosecutor was John Sheehan, who
testified that defendant had rented up
stairs apartments from him; that she
commented herself as a widow; that all
went smoothly until two women came to
live with her; that these women attracted
men to the house at all hours andcaused
him annoyance; that he protested against
defendant throwing slops out of - a win
dow, when she made use of ill language,
and from that limo forward there was
trouble, mainly from a dog, which wit
ness testified defendant induced to keep
up a continual barking at him. The
case terminated by a verdict of not guil
ty, defendant to pay the oasts, to do
which she was accordingly sentenced.

Smith vs. the Pittsburgh, Columbus and
Cincinnati itailroad Co., (already repor
ted,) was p6cceded with. It is en ac-
lion to recover damagees for the killin g
of plaintiera son, Igo,' eighteen years,
by a oollislon of trains on defendants'
road in Juete, - hirsi, near Walker'. Mills.
W. C. Moreland, Esq., for the defense,
moved that judgment of non-snit he en
tered, on the ground that the plaintitra
son was inthe employ of the company,
and that his death - behm alleged to have
been occasioned by the negligence of the
employees or agents, an action would
not lie, being cansed bv his en-laborers.
At the conclusion of the argument the
Court. adourned, Judge Williams stat-•
hog that lie would give his opinion Wed
nesday looming. Messrs. Bruce and
Gam, and Mr. Leslie, of Ohio appear
for the plainti ff , and Mr. Moreland for
