missed the only chance that ever existed,
as we view the case, thr bringing Me.
Davis to justice, when it neglected or
refused, soon after his arrest, to order a
Military Cominissiou to try' him for
treason. This, we think, will be seen
clearer by and by than it is now. This
was the course we di sired should be
taken; but the Administration was ret
sole v 1 he should not be ; punished. To
send him before a Military CommiTion
at this late day would shock the civilized
world. Bence, he has been at last turn&l
over to the civil magistrates. Ws bail
ment does not prevent his trial, when
ever it shall suit the Judge's to call on
his case. Will it be called? The cur
rent Impression is that it will not.
Why? Nobody doubts Judge tin ozn-
I wOon's loyalty or zeal. Not a man
questions the patriotism, -talents, or an
, gacity of Chief Justice CLUB& What,
then, is the matter? It would seem that
in the minds of the initiated more than a
suspicion exists that in consequence of
concessions either by the Executive de
partment or by military commanders a
conviction would be frustrated if the

would fall to agree upon a verdict ; in
either case leaying the government in a
worse attitude than would follow a vol
untary relinqiiiihment of the prosecu
tion. If this conjecture is correct, can
Mr. Onsairr properly be
made a scape
goat? or, rather, is it not folly to do
otherwise than face the case as it stands,
and make the best of it ?
If the journals which, isplay so much
wrath, not at the bailment of Mr. Davis,
but at Mr. GRES.LICY for be-diming one
of his sureties, really want hies to be
tried, why do they not direct their crib
; cisms at the Judges who have power In
the premises? at the Attorney General,
who represents the government in the
prosecution ? and at the President, who
has both influence and authority over
the Attorney General? These are the
people whO have the decision of the mat
ter. If they sap Mi. Darts shall be
tried, he will be, a thousand Mr. Gana
xxle to the contrary notwithstanding.
