months alter date, November Ist, MD. The
note was given at Wheeling, West Virginia,
in pert Deviant for the purchase of the
stock, good will and fixtures of the Wheel
ing brewery, from 'Geot ge W. Smith. For
the defense It was averred that a part of
the consideratlon of the note was the sale
of ri lot of ale, eighty-two barrels and three
hundred and thirty-two half barrels, sold
to the defendants as good, at the rate of
eight dollars per barrel, whilst the same
was not good, bet sour and worthless; atm.

ale, sold as good ale at eight dollars per bar
rel, whilst the same was not good, but sour
an d unfit for sale; also, the barrels contain
ing said ale, to wit: two hundred and sixty

were useless to defendants, but which they
were willing to retain at the price stated,

over nine hundred barrels of ale became
sour, and was wholly lost, being of the Vales
