Stat.,. Circuit Court, yesterday, rendered a
diellion in this case, In Which the point was
raised as to the amount of 'money due the
informer through whose agency the distil
cry and whisky were first ' tlulzed. Follow
ing is the opinion of.the 'Court:
On the 7th of ApriLlSfS, the Collector of
the 24th collection district Belled the distil
lery of Hook & Weise, situated in Greene
county, together with seventy-two barrels
of whim k ,, y, and all the implements of man
ufacture, for a violation of the laws regula
ting the Interne: Revenue of the United
States.
The District Attorney, on the VW- of the
same mouth, filed his phut, In this Court,
for a forfeiture, and the respondents falling
to answer. or even to appear In obedience
to the monition, the Court on the ..tid of To.
ly pronounced sentence of condemnation,
and ordered a sale of the forfeited property.
Only a part of the proceeds of sale, amount-
Mg to about Kent have been realized by
the Marshal, and none no set paid Into
Court.' This Is owing to no outside claim
ant of part of the whiskey, who is In cor
respondence with the Commissioner of In
ternal Revenue.
At this stage of the proceedings, J. W.
Scott presents his petition to this Court, ask
ing to be declared, to the judgment Of the
Court, the informer, in the language of the
Slot section of the Act of lAA, being "the
first, to inform of the cause,matter or thing
whereby such line, penalty, or forfeiture
was incurred," and claiming to be entitled,
as such, to a moiety of the forfeiture. •
It is objected that this distribution Of
the proceeds Is applicabie to penalties, and
not to forfeitures. But the act makes no
discrimination, placing them in the same
category, and although one Id a flied sum,
readily divisibie, and the other a condem
nation or appropriation of the Offending
chattel to specie, yet the act of the Govern•
most. by Its execution, reduces It to money

there Is no informer on the Record and that
the decree of condemnation having been
entered without reference to such a party,

cure the Integrity .Of the informer, by such
reward as would - place him above any
temptation which the offenders could offer
him. To deduct the tax of two dollars per
gallon (rein the proceeds of sale, and then
allow him one-half of the rend. ' would be
no reward at all. tie would deem It a mock
ery upon public justice, and no ono would
be willing to Incur the odium which some
times attaches to public informers If such
was the bounty of the Government. It
would be giving him the moiety of some
thing incapable of division, of nothing, for
In most instances of forfeiture the pro
cyclic of sale would not cover the tax and
costs. A said of t.ie forfeited chattel does
not exempt toe party from the payment of
the tax. Ile is still liable, although his U.
tie to the very property, which was the
subject of taxation, has been divested.
It only, remains to notice the objection
caused by the delay in making this applica
tion, This is sufliciently accounted for In
the proofs. The Informer mistook his reme
dy,. At the suggestion of the Collector, he
applied . to the Department at Ws.shingtoM

Court, to which the adjuitictaion properly

Court, and it is subject to our control, until
