Just before the close of the called ses sion he introduced a Confiscation Bill to the Mouse, where it is still pending, to . be called up hereafter. - That bill was , formal notice to all the country, and the . xevolted States pi particular, that he did not regard the measures previously adopted as constituting a finality. Ile said by it what he now says in his letter. So far thedency is to involve the white populattot r orthe seceding States in doubt ,and unertainty ;• to induce them to remain et least passive until they shall be made acquainted with the utmost extent of the demands upon them; and to excite a degree of distrust emi . ently unfavorable to a speedy' settle . eat of the great national controversy. Two years have.elapsed since the last bel army laid down its arms. It was this illegal and rev ' olutionar) l proceeding that changed the current of Southern feeling and purpose by creating a belief that the Presideni could and would effectually stand be tween the rebellions States and the law -1 making power. 'Nor was Congress - 'lclear of censure in this matter. When it came together, months afterwards, in i r n eg g ula - th r e ~ usurpation session, in matee t - of f a a r e beenl)uk -1 committeand- asserting its right- 1 ful authority in the premises, it took an i ambiguous position—half assenting, half I , protesting—which gave encouragement to the _ Executive and inspired fresh i . hopes of escaping all disabilities in the F lenders of - the Confederacy and in the 'States concerned in that contumacious organization: Only when the voices of the loyal people were heaid through the liallot-boxes did Congress recover its composure and self-respect, and take up I_ , the line of its imperative duty; nor did I it then perform its functions in the full : hearted and intelligent manner the peo , pie had a right to expect. It failed in many particulars, not only to apply the right remedy, but to see that any reme dy was necessary. Just upon the eve adjournment, it bit upon a plan of Reconstruct ion. That plan certainly did not embody all we wanted in it; but it had the merit of being tolerably good and definite. Under it the Southern people, returning them the escapade into which the Presidia led them, are evinc ing a pretty strong disposition to re-or gamin. There are malcontents, as there always are under such circumstan ces, who say and 'do obnoxious things. To delay, waiting for all overt sympathy , -with the rebellion to die out, would be tantamount to an indefinite postprin.e ment, leaving ten States under military control. This 'does not .comport with the genius ,of popular institutions, and might, in the mutations of affairs, fur ., nish a precedent of fatal tendency. Ma. STVVE.NS has not the popular mind on his side, and can get it there - only by foolish and psrverse conduct on , the part of the Southern people. -II they • go ahead, under. the law as It stands, complying fairly with its proyisions, • manifest a deeire to let by-gones be by , gones, and consult the things that make for permanent peace, they need have no " apprehensions that additional, burdens will be laid upon them. The will of the people is to make the Military Govern ment Act .an end of the fierce debate, and under it.to re-unite the circle of ths 'Union during the next twelve months. A repetition of the violences of Mem phis and New Orleans, or any fresh acts _proceeding from like temper, would surely elminge the drift of Ntirthern sen timent, and lead to enactments of which . the little finger would 'be thicker than the loins of the Military Government Act. bat we do not anticipate, any such outburst. Garr. Snorrato may still have occasion ro animuss a violent news , paper; but rash editor's are neither exclu rarely indigenious nor exotic at the South; and we have little faith iu repression as a , means for obtaining oneness of opinion . and purpose. Much will remain for time 'and distance to accomplish. The terrible feud between Scotland and Eng land did not die out in a day. The fac , lions by which. France was torn and • mangled during theßelgn of Terror were moldod anew triton homogeneous mass, only by, new wants and affinities. Eng land has endeuvcred-by proscriptions to ailence discontent in Ireland. Russia has attempted to trample out with iron /eels the resistance of Poland. The Measure of success achieved in either in stance does not encourage to imitation of the example. Even now there are intlication t s, amid all the jar and contention, of an increasing affinity. The part of genuine sttesmanship is to en courage this tendency. • 'PROGRE..99 AT THE SOUTiI. Shortly after Mr. JOIINEDN'S Seer,,sion to the Presidency he offered t o the people of the insurrectior. ii ry States, as his friends were pleased. to phrase it, in the capacity of a sor' of break-water against northern rad : A:align). That was what they greatly desired, and his ad vances were m , ,t with unfeigned cordi ality. If th'ey had little respect for him either 59 an individual or as a public funetiorJary, they knew he was clothed with a large measure of authority and was bold and energetic in working out his purposes. Hence, they were ready to forget, at least temporarily, the vio lence with which he had previously es pousedthe national cause, and to follow his leadership Fo long as it promised de liverance from any of the embarrass ments or forfeitures biought upon them by the failure of the rebellion. They did follow him, until the Mouth became again dangerous for a sincere Union man toxeside in, except in immediate contig ulty with a military post, and until the spirit of revolt had so far revived as to lead to the massacres of Memphis and New Orleans. Then the loyal people of the north be came aroused, and a demand was made on Congress for a remedy, adequate to the evil existing. It came in the form of the Military Government Act. That enactment had a salutary effect. It dem onstrated that the will of the President was not law, and that his betrayal of the principles for the defence of which' he was entrusted with power, had been 'imitated by only a weak and insignificant faction.. Some of. the old politicians, deeply compromised by participating in the rebellion, and consequently proscri bed to a certain extent under the plan of reconstruction determined. upon, con ceived the idea of appealing virtually against Congress to the Supreme Court, in the hope that the Judges by a stretch of prerogative would attempt to usurp all the functions of the government. It must - be confessed the Supreme Court had made two or three decisions which gave strong encouragement to the thought that it would go farther, and claim authority to compel the Executive and Legislative Departments to obey its behests. But the people gave the Court to understand, as they had previously the President, that they were masters, and no such assumption would be toler ated. When the preliminary hearing conic on, some of the Judges were sore ly puzzled to make what they felt con strained to do comport with what they had done before; but they ,bowed before a power greater than they. Meanwhile the masses of the southern people evinced a commendable design to accept the situation. It was little to Them that a few hundred gentlemen who had held offices under, government, and had violated their oaths, were excluded from opportunity to repeat their crimes. It was much that civil order should be restored; that a just and legitimate au thority should he establiihed; that har monious relations should be inaugurated between the local authorities and the national ones; and that the ',different classes acuLraces of southern population should come to a friendly understanding with earls other. This disposition was promoted by the discreet but vigorous action of the new Military Governors, •who promptly gave the old State magis trates to know that if they did not 6 - ,:•C resistance to the laws they would be re moved, and the vacated places filled by men of better purposes. As the combined result of all these causes reconstruction is progressing more rapidly than was anticipated. The lead ers of the Confederate armies are not only giving the people good advice, but are setting an excellent example'. The business classes are generally taking on the same spirit, and these will' eyentual ly, and without much delay, exerts con trolling inthience. It is settled that re organization will be accomplished un der the 3filitary Government Act ; and there are abundant reasons for believing that before the close of the next regular session of Congress the representation in the two Houses will be full and the patriotic work perfected. It is barely possible some of the old political leaders may pursue the appeal made to the Su preme Court, with a view mainly to see ing if they cannot get the disabilities under which they rent declared illegal, but that is a comparatively harmless labor in which they may be allowed to expend their money and patience. Mn. Monnow B. Lowey, of Erie, is a candidate for re-election to State Senate Decision In a Homestead Case Mon'. Joseph 11. Wilson, Commission. er of the General Land Office, has deckl ed in- the ease of a homestead settler who died unmarried, and whose father applied for a preference right to take the land by ordinary purchase at $1 25 per acre, that this could not be granted; but on satisfactory proof of the death of the homestead party being produced, with proof of settlement and cultivation, un der the eighth section - - of - the - tiomestead law, that the land could be paid for at $1 25 per acre, and entry made under that sectioa in favor of the heirs of the decedent; following in this respect, the rule prescribed by the second section of the act of March 3, 1843, in regard to de. ceased pre-emptors.. ' • —ln Salem, Mass., during a thunder shower, a few evenings since, a young man was prostrated by the lightning while walking in the street. At the time he had a steel framed umbrella In his hand, with a wooden handle, the frame of which was completely riddled and thrown to the opposite side of the street.. The breast of his coat was Some., what torn, and the waistband of his flannel shirt hung only by a shred, while the sleeve was partly torn open. What is more strange, on the shoes which its wore were steel buckles, appa• rcntly untouched,' While the top of one of his stockings was literally unraveled. The young man was not injured In the least, only experiencing, on the follow ing day, a little numbness in one of his bands. All he remembers of the affair is, that he.saw a large ball of fire.
