in a letter dated June 11, 1815, and ad
dressed to Mr: TORRANCE, he
thus states his judgment:
"The second question, whether the
judges are invested with exclusive au
thority- to deride on the constitutiiinality
of a law, has been heretofore a subject of
'consideration with me in the exercise of
official duties. Certainly there is not a
word in the Constitution which has giv
en that power to them more than to the

executive or legislative branches. Ques•
lions of property, of character, and of
crime, being referred to the judges
through a avtinitc course of legal pro
ceedings, laws involving souls questions
belong, of course, to teem; and as they
decide on them nhitnately and without
appeal, they of course decide for theni

law or laws again prescribing executive
action, and to be administered by that
