the two Houses the Constitutional amend
ment, proposed by Congress at the late ses
sion. In discharging this oblig,ation hn
naturally and propeily availed himself of
the occasion to recommend the Amend
ment to favorable consideration.• His ar
gument on the questions di/cctly raised, do
not contain any novel features, but are well
put, and fully respond tO the popular senti
ment of the State as developed in the can
vass which resulted in the election of Gen
°EMIT as iris. successor.
But Governor CCIITIN goes farther to

ne maintains that it is not essential to
count the States whieTWere concerned in
the rebellion, and arc still unrepresented
in Congress. He contends that when the
Amendment shall be assented to by three
quarters of all the Slate' actually partici
pating •by representation in the govern
ment, Blain be legally carried, and become
part and parcel of the organic law. This
-le an advanced opinion, but we believe it
to be the true one.
True, there are difficulties attending it.
The Supreme Court may take a different
view, and hold that three quarters of all
the States are requisite to gite validity to
an Amendment. Courts are at all tunes
behind the spirit of the age, and have lobe
forced up to it. They are necessarily slow
said conservative, representing
.antiquity,
and finding • wisdom in the -graves of the
fathers, and scarcely anywhere else. It
.that was the Worst that could be said of
them,Witirsubstantial reason, 'it would be
'comparatively aamall matter. But every
student Of history knows full well that

ments of reaction and -of despotism. If
there is an old abuse that has vitality
enough left' in it to marshall a following
"respectable in numbers and in social stand
ing, they are sure to gravitate towards it
lovingly. This was illustrated in the Dred
Scott decision of the Federal Supreme
Court., pronounced by)Chief Justice Janey.

to find itself more secure than behind the

By evlgting law the Secretary of State is

fication of an amendment. This is in or

cerned. But nothing in that laW meets
the present case. When - that law was en
acted no States had incurred disabilitiesby
rebellion; and it was not contemplated that
any would. Hence the Secretary was not
directed what States to count and what
States to omit. Congress may be expected.

in Congress shall be enumerated; that

or some other official, shall proclaim the

As Governor CCILTIN came into ollice,
keeping abreast of public opinion on all
great questions, we are glad to see him go
out displaying the' same noble character
istic. The people have honored and trust
ed him, and he has not deceived them.
GoVernor Gkany is soon to take the place
Governor CURTIN will vacate. We have
no misgivings as the line of policy he will
adopt and pursue. He is on record, both
by word and deed, and we doubt not will
make good his commitments. He follows
u man who has won golden opinions, not
only in Pennsylvania, but wherever loyal
ty is held in repine. ,So long as he shall
not trail the Republican banner in the
dust, but shall bear it on high so that our
trlutnphant host may gather about it,iand
fullou it to new victories, will he challenge
and receive the support of. all who-aided in
his election. •

fore a civil tribunal. After a careful ex
amination of the Con4itution and the
Laws the national authoring decided that
the case was properly trl ' hi elie;lro a Court
Martial, and one was ordered, for e.,et put ,
pose, which did its work to the sar,,r ac ..
lion of most loyal people. It is itow
nounced that one of . the' .lodges of the
Supreme Court of the teltltl States has
decided to issue a process . for bringing be
fore him the individnala who were con
vie.ted by that Commission of participat—
ing in the assassination, sad sentenced to
imprisonment at the Dry- Tortugas. The
inference is that the Judge holds the trial
of these Men to have been illegal..
Article five'Of Amendments-to—the Con
stitution adopted in 1789 covers this Case.
It reads:
"No person shall be held to answer, for
a capital, or otherwise infamous crime; un
less on a prs sentinent Or indictaient of a
grand jury, except in — rates arising In the
fond or nasal fortes, or the militia,
when
_in actual service +in time of war or
public danger. nor shall any person be rub- -

Commission depends on the precise mean
ing of one of tee clauses of this article. It
wil l b e otw rred that It is not said a man
must so aally belong to the land or naval
few , of the United States, to make him
,uenable to military tnbunal. If that was
the precise meaning of the words, tho a
rebel, found In arms against the goVern
ment, could not be adjudged by a court
martial, nor could a man belonging tO
other recognized nation with which we
might be in collision, and who should vio
late the rules of civilized warfare. _Such
clearly, was not the intention of the arti
cle. The design manifestly was to make
all offences against the war power of the
government triable militarily, rend none

The question, therefore, is, was the as
sassination of President I..mcoms "a case
arising in the land or naval forces?" If,
during war, a public enemy, or several of
them, were Co find their- way into the head
quarters or General GRANT, and kill him,
and should be captured,—would any one be
silly enough to say the cue could only be
disposed of 1;y indictutent and conviction
for m urder In s. Court of Oyer and Termi
ner? Doubtless, the offence would be
murder,'and would be triable in civil
courts; but, by reason of the fact that Gen.
Gntvr was "in the land or naval forces,"
and by reason of the other fact that hevra:s
taken off, not.by personal mama, but by
a public enemy, the culprits would bo sub.
ject to military Inv, and might be dispos
ed of summarily.
Article .11, Section 11, Clause I, of the
Constitution, provides that "the President
shall be Commander-in. Chief of the Army
and Navy of the United_fitates." The as
sassination, therefore, of the President, in
time of war, by a public enemy, was a case
"arising in the land or naval forces;" and
was properly tried and punished by a Mil
itary Commission. If any individuals wish
to retain the advantanges of What is known
as "due process of law," they must res
trict their malevolent actions to such offen.

Soldiers and sailors did many things, and
did them well, for .which no, warrant can
he found in the statutes at large. 'lt does

fenders. The nation honors them for their
loyalty, courage, and energy. Now that
the crisis Is past, dotibtless the judges—the
men of technicalties and precedents—will
be upon their track. Such has always been
the case when sharp diseases required
speedy remedies.

holic liquors in the United States; or that
frauds. upon the revenue by persons' en
gaged in that pursuit are constant and enor
mous. Nobody, we apprehend, will main
tain that less liquor's are consumed than.
formerly. The evidences of drunkenness
abound throughout society. Indeed, that
vice is alarmingly on the increase. Nor is
there any apparent diminution in the nsC
of alc:ohel in connection with arts. All
the facts, open to observation, point not to
a lessened consurepam, but to a large in
crease.

frauds are perpetrated on the revenue.
, Every dealer knows that alcohol can be
purchased for less than the tax upon it.
This was seen when the exorbitant assess.
meat was enacted. It always happens that
when duties are laid on a particular article,
far above theaverage, that the elicit manu
facture and vending of it is stimulated.
There seems to be no other course, when in
ordinate revenue is desired, from any corn •
modity, entering into general use, but for
government to take the production and
sale of it into its own hands. Even then
success in suppressing. frauds is only par
tial. The Inducements ;to surreptitious
traffic are so many and great that the risks
are freely incurred.
It is against the settled polity of this
country for the government to conduct any
branch of traffic for the sake of income.
The government has no thought of such a
scheme, and the people would not endure
It even if it should be urged by officials.
There seems, therefore, to be no other
remedy for the evil under consideration,
but to reduce the excise on distilled
li , uors. The government needs what rev
enue can legitimately be derived from this
branch - of business ; and people engaged in
other callings do not want to can,' their
own burde ns and the burdens which the
distillers should shoulder.
There's still another point 'which should
be looked at. So extensive have evasions
Of the excise laws,become by secret distil
lation that honest dealers are really driven
to the wall. They cannot pay duties, and
still compete with thoie who mty none at
all. Thit is a hardship from which they
have a right to demand and expect deliv
erance. Their interests in this matter ac
cord with those of the government itself,
and 'with all other classes of tax-payers.
It wUI be seen, moreover, that this is
not a question of temperance or license. It
respects neither the quantity of liquors
made nor used; but, primarily, the reve
nue derivahle...b.y„government from the
liquor traffic, end the suppression of frauds
therein. While Congress Is engaged - with
the revenue laws, a close scrutiny may as
well be given to this particular branch.

portion of Europe against those of the other.
This island of Crete, vulgarly called
Candia, is situated in the Mediterranean,
and belongs to the Grecian Archipelago.
Its population, estimated' from a million to
a million and a. quarter, in the ancient
times, has dwindled down to not more than
one hundred and seventy thousand. Of
th ese sae hundred thouiand are native
G ree ks, forty-five thousand of them Turks,
and 'the remainder liellenes, Jews and
other foreigners. '
It is, 11:nteed, astonishing that these one
hundred thousand Greeks, with allithe aid
derivable from their kindred living else.

It appears they have a steamer engaged in
bringing them supplies, which is extraor
dinarily-fleet, and haS no difficulty in elud
ing the-blockading - squadron. If this re

in their behalf. This offered, not. by.
Greece, with its two millions. of people,
but by 'France or any other tirst class
power, would at once induce the Sultan to
relinquish his claim. As this matter map
