An accident fatal in its results, occurred
yesterday. forenoon at the glass hense of

near linesman's coal works, in Birmingham.

commenced ,under the supervision of 'Mr.
Joan Eichain, architect, Messrs. Smith A Cor
bett, carpenters, sending their foreman sand.
workmen to thejob. A scaffold some twenty
feet in height, was erected for the adjust
meet of the upper timbers of the now build-
ing. Aceortling to the facts testified to yes
terdar, there was considerable discussion as.
to . the security of this seaffolding.at the time
Of its erection. The foreman,Mr. Isaac
AleGuml.PlT. remonstrated aganst, it being
used by • the workmen until some of
its timbers both. in the upright,
and transverse portions should be replacedby
more solid Ones. .The architect, Mr. Alchain,
decided that the scaffold was Safe.l2.,ollgll and
' it was permitted to steed. and the-workmen
proceeded with their work. Yesteitigy morn
ing, at a little' before eleven, tile foreman . Mr.

From the testimony It was impossible to de
cide ii hether It was • a cross piece or an up
right that drat give way. It was probably the
prinmpal cross piece at the end. This WaS a
scantling eight inches by two. It might not
have broke:l,lmi.! it not been for a knot whirls
extended through Its entire breadth, anel
e, bleb materially weakened it. the foreman
is disposed to t xi:met - ate kir. 31chain from
blame in the matter, as he did not see this de
fective timber before it was put in the scaf
fold. The jury returned a %collet' to the fol
lowing elle..ti "That the deceased came to
his death in the borough of Birmingham, on
the 12th of November, ISCO', by the

jury are of opinion that the said scaffold was
Insecurely built, and that the responsibility

The deco ,sod was a single man .of about
twenty-three years of age, and came to this
vicinity levied,' from Lawrence county. Ile
resided with ;cloth es on Gist street, Birming
ham, and has a brother in this city who is a
plasterer. Lle is said to have been a-man of
irreproachable Character. , •
