It Of the five millions of rebels, who re cently made war on the government, not one has suffered the punishment due to his climes, unless falling in battle may be ac counted such punishment. Nor is there a reasonable expectation that any of them will be punished. When the democrats declaim in favor of "The Constitution as it is, and the laws as they are, - they clear ly do not imitate those portions we have juskreferrod to; and the repahlicans, leaning to lenity and willing to be magnanimous, are ready to take compassion on the van quished. This third section, ii it shall be passed, doubtless provide , all the punish ment to which the rebels will be subjected. It is so modetate as to hallentte the admi ration of mankind. This is strictly analagous to proceedings in the Courts Of Justice. When a man has been convicted of perjury, he is ever after excluded from the right to give testimony. The presump tion is that he cannot be trusted ; that the rights of the public or of individuals ought not to be determined by what he might de pose..
