m orning of Staiday, July iffith, some men woo
were passing along the Butler plank road by
the lane that led to the haute of Thomas Don
nelly, Esq., in Hatfield, saw three men stand
ing under some trees near the house and mo
tioning for them to Offineap. On approaching
them, they saw the insensible form of a young
girl lying On the:ground under the trees, her
clothes torn and dirty, her limbs and body
I bruised, and her person evidently having been
most brutally ontragal,' The young men who
51004 by her said that they were passing there
and towel her in the condition described. She
was removed to the house of Mr. Donnelly,
and. Dr. Botaion called to attend her. For a
long time-indeed, until recently-her case
was very uncertain, and it was feared she
would die. Eventually she gave her name as
Fanny Smith, and was discovered to have
lived in Allegheny. The Mayor and his police
spared no pane, and at length found a clue
• which led tothe arrest of James Weleh, Win.
1" Klee and Wm. McMillen, residents of Hat-
Reid. These men were confined until she

tation, as the guilty parties. They then had
a hearing, and in default of $lO,OOO ball each,

Yesterday they were brought Into court and
arraigned in the usual form, each one plead
leg not guilty. District Attorney Duff, John
Coyle Esq., and M. Swartzweider,Esq., appaar.
for the prosecution, and Messrs. Moffatt and
Cochran, Gen. A. L. Pearson, Thos. Marshall,

Mr. Moffatt, one or the counsel for defen
dant, made a motion to quash the indictment

got to the city; he then told me that I hail to

Lawrenceville and went down towards the
railroad track: there we found three other
men; one was McMillin and one was WC/S11;

dragged me along; I commenced to cry out,

dragged me along by the Cemetery, and
I cried out again and an old woman
came out and tried to take hold of
me; they drove her off and called her sone

man. Further up the road, beyond the lane, i
tee met two young fellows whom they called
ltrahe and litelligan. Halligan tried to per
suede the boys to let me go, for 1 might be a '

They told lam to shut up for they did not want ,
anything to do with him. He Insisted mad
they quarrelled, at last / saw McMillan shoot

The other boys had hidden along the road. In
the lane they threw me down and one of them
held Ills hand over my mouth; then Tom Mc-
Cune or Kinzie ravished me; after that the

don't know, ravletted me, and some of them

month o' July last I resided 113 Allegheny with
Mr. Shannon' left there on the fourth of July;
went to New Brighton and Maid two weeks.

there I went to live with Mr. 'learner. In Oak
land; staid there but a very short time. I left
there on Saturday, the day before I was found
at Mr. Donnelly's. That day I went over to
Allegeeny to Mx. Snair's to take my clothes

o'clock. He was going to Allegheny and I was
