orably discharged, Soldiers* and Sailors , of
Allegheny Comity, betook occasion to express
his approval-;Of" the course pursued by
the majority in' Congress against the mad
scheme of Andrew Johnson: He was in full
accord with those who called tee Convention
that byte assertible in this city on the twenty
fifth. He felt that the voice of those who had
defended the country in her hone of peril
should be heard now fn ita bebnif. The Con
vention to which they were about to elect del
egates would prove tO be one of the most im
portant Conventions that has overact on this
continent; and if their deliberations were
' charaCterized by goal, sound sense—as he
knew they would be—he had no fears for the
safety of the country.
When the Chairman had concluded, General
James S. Kegley and Captain Harper wore
chosen toned as Vice Presidents in the tempo
rary organization, end Captain N. M. Smith,
Capt. IL te. Monteath, Sergeant Jolts IL Kerr,
Lieutenant W. S. Mc(uue and the reporters or
the Press were appointed to act as Seem
tenet.
On motion of Colonel T.M. Day - ne, a commit
manetwenty was appointed to nome r
t officers, with Capt. F lem in gas
chairman of the committee.
The Chair appointed the following gentle

The Committee withdrew to an adjoining
apartment to perform the labor assigned
them, and In their absence Colonel John A.
Ducks, at the suggestion of Captain W. B.
Cook, came forward and delivered a telling
and patriotic address, which wise greeted by
several hearty rounds of applause. In re
spew. to repeated calls, Gen. Jus. S. Neglov
ascended to the stage Land also made a brief
end characteristic speech, which was inter
rupted by the arrival of the Committee on

A vote being taken the report was acceptant,
and the officers nominated ware declared
elected without a dissenting voice.
Gen. Pearson was then escorted to the chair
and Introduced to the Convention by Gen.
Collier Ina few pertinent remarks.
After than kmg those present for the honor

prise that Inc should be chosen to preside over
the action of an assemblage consisting of so
ninny brave and gallant men who had hew, a
proud record in the history of their country
by their noble and daring deeds on a hundred
battle-Wilds. He said he was not present as a
politician but as a soldier. The Convention
was not a Democratic, Repnialonn or National
Union Convention be said, brit a Convention
of the honorably discharged soldiers and sail-

for its preservation. The speaker said

ed the enemy, and now they must direct the
shot of their ballots the same way, If they

At the conclusion of the gentleman's re
marks, the officers elected took seats upon the
Stage.
Colonel T. M. Bayne moved that a commit
tee of live be tippet:di:a to prepare resolutions.
The motion was adopted., and the chair ap
pointed the following: Col. T. M, Bayne, Sergt.
J. IL Gray, Sergi. Wm. Shore, Lieut. Palmer,
Capt. Wm. Paxton.
The committee retired at the request of the
chair, to preface their report.
Gen. J. S. Negley Mortal that the "Buys In
blue, in each election district, he requested to

en delegates to attend the National
Union Convtion, to be held in this city on
the twenty-1111h of the present month. Col.
T. H. Bayne opposed the resolution on the
ground that hi thought it unjust to. exclude
any assn who heal fought in defense Of the old
nag, from participation in the'pruceedings of
the Convention.
Sergeant J. H. Herr, thought as It wins im
possible to accommodate she six or seven
thousand union soldiers of Allegheny County,
within the walls of any structure in the cone
' ty. that there ahould he three elected from
each district to represent their comrades in
the projected Convention on the 25th.
Gen. Negloy accepted the amorultnent con
veyed in the suggestion, and the resolution
was adopted in the following words.

Maier Kegley endeavored to defend the
amexotheat by saying that A.ndrow Johnson
in denying tag loyalty of Congress, was guilty
of treason.
Captainitarper denied that that constituted !
treason, and after a light debate the amend- •
meat mislaid on the table by a unanimous
vote.

,Negley then moved that the
delegates presimt proceed to the election of
three delegates for each election district in
the comity to attend the National Convention
on the 25th.
t. COL T. M. Bayne in a forcible and argnmen
. wire speech opposed the resolution, Ile was
for admitting any man who wore a blue uni
form during tho war. Ho wanted the soldiers
and sailors to turn out en muse on that occa
sion.
General J. 8. Negley remarked that If such a
policy was adepted It would exclude the del
egates from other parts of the county. The
Convention was not called for the purpose of
cheering for the flag and making bombastic
es, bet to deliberate on the great clues
ms that are now agitating the country, and
to endeavor to devise some measures for its
speedy restondloa.
The matter was finally settled by the pas
sage of the following resolution, offered by
Capt. Samuel Harper:
Resqlved, That the organization of the Hoy - .
In Blue In the various election districts in the
county bo Instructed to select three delegates
to the Convention, and that the names. of thede
elected be reported to the Resident Commit
tee.
On motion, the Chair was Top:stet to

point a committee of fifteen to co-operate
with the Resident Committee in making re
parations for the National Convention.

Criminal Conri
Court opened yesterday morning at ulno
o'clock. with Judges Mellon and Brown on
the bench.
The evidence and arguments in the case of
John Cash and Michael hail, for committing
a rape on the person of Amelia liennewag:riew
Mrs. Cash, having been concluded Thursday
evening, the Jury were charged by Judge
Mellon yesterday morning, after which they
retired, and hr a short time brought in a ver
dict of not guilty on the first coma of the in
dictment which charged them with having
committed a rape, but guilty on the second
count, which charges them with assault and
battery with intent to oommit a rape.
A motion was made by defendnnts counsel
for an arrest of judgment, and new trial
The argument will be hoard on Monday.
Henry yolk, an individual who was tried
at the March term for fornication, was placed
on trial for the larceny of a bat and vela val
ued at night dollars, the property of David
Boyd, of Indiana township. A verdict of guil
ty was returned and the prisoner sentenced
to undergo an imprisonment of one year in
the Western Penitentiary.
Daniel McCain was noxt placed on trial for
assault and battery on oath of William Swear
engen. A verdict of not guilty was returned,
and the prosecutor was directed to pay the
costs.

The next case was that Of John Conway, a
boy fifteen years of ago, charged with steal
ing a lot of iron from Mrs. illvetta Wharton,
of East Birmingham. A plea of gLdlty having
been put in, the Court took into consideration
the tender years of the defendant, and com
mitted him to the IiOUBC of Refuge.
The next case called was that of a father
against a son, the father being seventy years
of age, and the son fifty. The name of the son
is James Wright, and that of his father, Alex
ander Wright. The father sues the son for
larceny as bailee. Ile states that he gave the
son ono hundred dollars in money, and that
when he asked James for it, James told him
to sign a receipt, and he should have the mon
ey the next day. The receipt was signed, but
when the old gentlepum called for the money
per agreement, the young gentleman
denied that he owed him any - thing, and pro
duced the receipt-as evidence. The jury re
turned a verdict of guilty. A motion In ar
rest of Judgment was made, and the argument
will be hoard next Monday.
John Dover° alias John Potts was next plac
ed on trial for having married a Miss
while he had another wife living In the east
ern portion of the State. The Jury returned a
verdict of guilty, and the prisoner was re
mended for sentence.
The next was one of the most singular eases
that has ever been brought before the court.
it was the ease of David Dailey alias David
Bailey, altos Leasure, alias Warmer, charged
with having stolen fourteen head of sheep
from Mr. Battalions°. The prisoner was
brought into court looking more like a will
beast titan a human being. Le had no shirt
on his bath, and his other clothing was In so
dilapidated a condition that he w almost
naked to his waist- ills longue stu ck
k out of
the left corner of his month, and his body
swayed back and forth like a drunken man.
Lie paid no attention to Judge, lawyers, wit
nesses or Jury. but stared around with a I idi
otic stare. ft he is not Insane It is tile best

in evidence that iel wan sane and shrewd
enough when he atteannttyl to sell the sheep,
and that he showed no signs of Maundy um I i

gent letter written by him while in jail was
shown to the Judges. The jury found a vet
die of guilty, and he wan sentenced to pay - a
line of six anti a-quarter cents, anti undergo
solitary confinement in the penitentiary or
two years. During the sentence he assumed
the same look that he wore during the
trial, and dill not appear to know that he win.

Frank colomans, a colored boy, was next

against him- The Grand Jury had Ignored
the bill, and ho was discharged by proclama

John Scott, colored, was brought up for as
sault and battery. Bo was taken in the act of
