On Monday morning, in the Common Pless ,Court, Judge Sterrett heard a kobiecu corpus case. The writ was issued on the petition of Mrs. Ann E. Merriman, who sought to obtain" possession of her child, a little girl of Ave years, held in custody by John Merriman, pc. titionerls father-in-law. resident at Sewickley. The facts of the case were: Jacob Merriman, father of the child, was Id the army, and for a time during his absence his wife, the peti tioner, resided with the respondent. When the father returned from the army ho went to housekeepmg, but not, being able to obtain employment, sold out his household goods, and went to the west, the petitioner resuming labor as a domestio to earn =twister= for herself and the child =question. Previous to going away, her husband gave the child into the custody of his father, the respondent. with the injunction to keep charge or it dur ing his absence. The mother was averse to this arrangement, and after fruitless endeav ors to get possesoion of her child, finally took legal proceedings to accomplish her desire. She alleged that thus far she had maintained her offspring by honest labob that she had no knowledge where her husband was sojourn ing, and that the grand parents were not proper persona to have care of the child. For the respondent it was urged that the mother abused the child, and that as she had no per moment place of employment its condition would not he bettered by giving it into her 'custody. After hearing all the evidence, and remarks of John Barton, Esq., for petitioner, and J. W. Y. White, Esq., for respondent.
