resolution to go into Joint meeting with the
House of Assembly to elect a United States
Senator again came up m the New Jersey
Senate. Senator Soovel addressed the Senate
at length, deciarmg that he could not surren
der Ms position without dishonor and that he
would adhere to it to the end. A vote to go
into Joint meeting wee then Oaten and lost

would have voted against. the resolution.

The case of Thorn & Denman vs. the -Pena
-1 Sylvania Railroad Company, was taken up.
This is an action to recover the value of four
behdred sheep. It appears that In Septem
ber, 1%4. tile plaintiff% shipped by the Penn
sylvania Railroad, nix hundred and forty
sheep, for Philadelphia. When the tram haa
nearly reached Latrobe, the locomotive ex
. pimied, killing three men, and making the
i rain a wreck. Four hundred of the sheep
owned by the plaintiffs were killed in they
wreck. The plaintiffs claim that the explo-
sten b r ing the result of carelessness, and there-
fore action to recover. The defendanta, ,
on the other hand, claim that the explosion l
was an unavoidable accident, and that the i
eonpany is not liable for the loss sustained.
