Chaflestowo, on Salarday last, his counsel filed
a motion for arrest of judgment. On .Monday
morning the Judge decided cathefleveral points
raised by the counsel, and ordered the prisoners
to .be brought. into court Iforeenlence. The
several questions were propound edto each of the
of the prisoner*, *a towbether they had noything
to say why sentence of death should not be p» 8 *
sed “upon them. Stephens, in a firm and dis
tinct voice, replied that “ho had, if it pleased
the [court.” Hewlett also responded in the af
firmative, although in an agitated manner.
Stephens continuing, said that although most
of the teslimony in his ease was true, yet, in re
gard to what bad been'etated by one or two or
thewllnesow, that be desired the* damned town

Where he was known thiaioputation would need
no! denial. He had also io say that he bad no
failllofiod either with bis treatment at tbo
bauds of tho authorities since a .prisoner, Cor
with the proceedings on bis trial, all had been
done for him that he hare could reasonably ex
pected—bis counsel had done his utmost, but he
appealed to the Court that ns he had extended
mercy to others, bo thought he might expeot
some degree of xneroy. Bat whatever his fato
might bo, he would meet It sb became a man,
unshrinkingly.
[Uptfn his concluding, Haxlett addressed tho
Court, Ho saidhebadftfew wordslceay. Tbo
testimony given against him was false, oue wit
ness in particular was mistaken.. He spoke of
the testimony in regard to his identify, and said
that he had always been in the habit elnoe he
hid a beard of shaving it off every three weeks.
He etated that eineo a prisoner he nad been treat
ed most kindly; that hisoouosel, Messrs. Green
and Boris, had done more for him than northern
counsel, could have done, and that since he had
seen Virginia and her people, be had formed an
entirely different opinion of the whole subject of
slavery to what he had entertained previously.
Haxlett, In the delivery of Ms remarks, was con
siderably agitated, which probably arose from the
fact that ho wasnnused to publio speaking.
Judge Kenny then proceeded to pass sentence
.on tho prisoners, whioh ho did in the most /eel
iogand impressive terms.' He sentenetd eaoh
of them to be hung publicly on/Friday, the ICth
day of M&roh next, between Hho hours of 10
o’olook A. M., and 2 o’clock P. MS
' Immediately after passing sentence, the Court
remanded the prisoners to jail, and the coowd
drawn together to witness the proceedings quiet
ly dispersed. '

I tory of Brown from the battle of Oeawatomie to
I the fight in tho engine house of the Virginia Ar-
I serial. Every thing tends to the oonvicilon that
ijßrown kept his own counsel, madono confidents
| except among his immediate followers, covered
I his tracks carefully as he went along, traveled
I 'under all the names in the directory, did enough
Jibusinees with ficticious signatures to be.entitled
|i to fifty Indictments for forgery, and kept him-
I self instinctively free from connection with the
| Republican party. The upshot of Senator Mo-
I son’s movement will provo that while Brown
I was engaged in fighting the Border Ruffians in
1 Kansas, he had frequent interviews with mcm
| bera of that party, ond>from some of them per
j haps received martial aid; bat that when ho de
| termioed to iovade Virginia, he cut off tho whole
I list of hia Kansas acquaintances, and went for
| ward absolutely on his own responsibility. The
I Investigation will be a failure iu 00 far/ 8 the
1 investigators hoped to damage their political op-

Ton design of the Senate is to keep Kansas i
out of the Union until after the Presidential .
election. Tho census is a mere quibble, and
quite uawortby of serious attention. Nobody
doubts that there is more population in the ter
ritory than the law requires, hence no good ob- |
jeclion exists on that score. The opposition is
purely political. It is now intended to postpone
the admission by an amendment to the act, con
ditionally granting it, enlarging the boundaries
so as to take iu the Fiko’e Peak settlement on
the west, and to extend the northern lino to tho
Platte. If the people accept these alterations,
then to coasumate tho admission by proclamation
of the President. This scheme, it is supposed,
would make the new State democratic by the
squatter vote. The contrivance may be very
ingenious, but it cannot succeed. If tho Demo
crats of tho Senate are determined to deny Kan
sas her right of admission, after all that has oc
cured, and to forep this issue into tho Presiden
tial canvass, they must take the consequence of
their temerity and folly.
As sooo as tbeCommUleo of Ways and Means
have disposed of tho Appropriation bills, and
tho necessary legislation for carrying on the
government, they will tako op the tariff, and
bring in a bill which will be satisfactory to
Pennsylvania aod.tbe country. No extreme
measure is asked by the friends of protection,
but a jast, moderate and discriminating bill
which will eland the test of the closest ccrutioy,
and at the same time give reasonable enconrage
mentlo the -goffering industrial interests. Stable
legislation is needed which will attract capital
’ and enterprise to the development of our nation
al rekouroes, and protect them against the raic
; one fluctuation* and experiments from which
1 they have suffered since the tariff of 184 G wae
1 enacted. Bach a bill can, and will, bo carried
. through the House. A bill for political purpo
ses only, in whatever form it may appeap, will
command littlo respeot or attention, for the snb
> ject involves too many great interests to bo

ruburp, Feb. 15.—The Annual Convention of the
Editors of Pensylvania met this afternoon, at
3 o'clock, in iho Hall of the Houbo of Represen
tatives. There were thirty papers represented.
Morton Mo’Mlcbael, Eeq., was chosen President;
J. Gels, John H. Laird, P. B. Frcasand Henry 8.
Evans, Vice Presidents; and J. H. Pulesten and
L. H. Davis, Secretaries. LouisA.6cdey was ap
pointed Treasurer. A Committee was appointed
to await on the Governor and invito him to tako
a seat-in the Convention, bn* he dcoUned, his
time being too much occupied with official busi
ness. Dr. Corwin, of the Pennsylvania Slate
Hospital, sent an invitation to the Convention to
visit Mo institution; the invitation was accepted.
Mr. Gets, from a Committeo appointed at the
last meeting, reported a series of suggestions
which werereadwndlaldover. AnowC.ommß
leewas appointed to superintend thoprinUng of
this and tho proceedings of iho last Convention.
Mach difficulty was experienced froizf the neglect
of iho Committee appointed at the last Conven
tion to . have the proceedings published. No
business of importance was transacted.

—Ora MawKilmd.— The graining mill attached
to the powder works of Messrs. Band & Smith,
near Newburgh, Orange connty, N. Y», exploded
a few days since, entirely destroying the build
ing, and instantly killing one. of. the employees,
named Christian &lmmcrmahn. He was near
tho building at tho time, with a wheelbarrow of
powder. Tho .unfortunate man was thrown a
great distance. Another, man, who was In the
rard of the powder works at the time; was felled
o tho ground by tho explosion. Tho.walls were
completely destroyed, and timbers and maohino-’
ry carried to a great distance. Tho yard goto
was found lodged on a tree by the Side of the
road. ; The explosion was distinctly-beard in
Newburg, and tho windows of Jho house near
themlll were much sbaltered’-by the concussion.
The cause of tho explosion is An in
quest was held upon tho body of 'Mr. Simmer
man, and a verdict of rendered.
