Chanters Valley Railroad.; It was one of im
portance, $150,000 of city boucle having been
ironed to that company.
Theargument orrespontiente id long and close.
It commences with a coneideration of the writ,
and it is argued that enbstantlal defects in the
writ may be taken advantage of at any tithe be-
fore the peremptory mandamus; that the rola
ter'a title mutt be clearly set out in the writ it
self, and that the relator should be held to a
strict compliance with the rules of pleading.
'This being eatabliebed, the writ in this cue it
is claimed, will be found liable to the following
exceptions:
It does not aver or set out any law conferring
authority upon the city of Pittsburgh to make
provision for the payment of bonds, or interest
amaipg thereon, by messing and collecting
taxes.
It do,
It does not eel out when the principal of the
bonds referred to Is payable, what rate of Inter
est they bear, or the time or place at which It is
payable.
The writ does not eel out the relater's title to
the bonds, but simply avers that be became the
purchaser, without stating how they wore traps
(erred, or the conelderation paid by him.
The relator alleges that coupoue, for the in
terest, were attached to the bonds, but he &tee
not aver that hale either the purchaser or holder
of soy ow:Tone; while the copy of the bond at
tached to hie affidavit allows that tho interest to
ortly payable upon the presentation of the
coupons.
There is no averment that any demand was
ever made upon the Councils to make provision
for the payment of the interest alleged to be due
by the assessment and collection, f taxes for that
purpose.
'Moreover it Is set forth in the argument that
there Is no reference to any not or law that
makes it the duty of Councile of this city to ari
sen and collect taxes for any purpose; that
there is no allegation of want of funds in the
treasury showing a necessity for special taxa
tion; that the writ does not !efficiently aver a
want of other legal remedy; that the mandate is
to prepare for interest not yet due; that several
parties aro joined in the same writ; that the
writ does not mention the amount of interest
due.
These points having been submitted, - the next
potato touched upon is the return and demurrer.
It is claimed that relator le not allowed to de
mur specially to return to a mandamus; that the
return is sufficient, if It contain a legal reaeon,
for not obeying. It is claimed from these and
many other reasons that relater's otjection to
the return is insufficient.
The jurisdiction of the Court is also coosider
ed. It is claimed that the writ is one of prerog
ative and not of right, and that its only object is
to supply • remedy where there is none end
ought to be one. This Court is esSentlally an
appellate one and tool a oourt of original jurie•
diction. The argument against taking the pea.
pie of this portion of the State, in the person of
their afficers, to answer this writ In Philadelphia
or elsewhere, at a great dietaoce from their dom
icile, is elaborated. If the relator has a legal
right to the money claimed hie remedy ie by an
action and not by mandamus.
The writ is directed to the respondents a, com
posing the Select and Common Councils of the
city of Pittsburgh, to which the respondents an
swer (lint no rook corporation extol, but only
the "Mayor and Aldermen, end eitirene of Pitta-.
burgh," and respondents further aver that the
Lopeporation of which they are Councilmen Is not
named in any of the Acts of dasembly referred
.to In the writ and that no power ie conferred by
those acts to eobscribe for railroad stook or 'sane
bonds or make provision fur interest therein.
It Is admitted that the duties of Councils aro
deliberative, but the Court cannot dictate the
manner In which They shell exercise the discre
tion lodged in them. The relator ie bound to
look to the power to Issue the bonds; ha is bound
In every view to notice the conditions imposed
by the contract.
Moreover,
the return eels forth that the city
has advanced to the limit of taxation, and that
the Councils have already authorized taxes far the
ordinary purposes of the city, and these facts
being admitted, the law Imposing said limit Is an
absolute prohibition upon the exercise of power
commanded by the writ. None of the laws re
ferred to by relator make it the duty of reepon
dentin° perform what be asks them to do They
at most contain but en authority to act. Pre
vious to the application for a writ of mandamus,
an express and distinct demand or request to
perform the act commanded must he shown.
The holder of the two bonds is not content with
the Proper - tribunals of the law, a trial and a
verdict by jury, but demands a special excretes
of power in his behalf "to tithe the freemen of
a great oily."
We have thus Stated some of the points made
by respondents' couneel, Messrs. Penney & Wil
liams,in their arguments to the Court yesterday. •

selling in large quantities for 60 cent' per gallon.

fee simple, thdve will be an additional charge of 2 nr
more cents pe'r gallon. The refined oil is sold at a
much higher figure, and as the refining process Is a
simple one tie oil men eon largely increase their
profits by refilling the oil before sending It to markeL
The oil is valgabla for many purposes, chiefly, how
ever, at present, for filaminating.
ProfessuX Silliman, to hi. Interesting report con
cerning this oil, pronounces it to be one of the beet
materials in existence for illuminating purposes: he
remarks, also, that It is in no sense a drying oil; it
will not gum or „ thicken, and is pronounced by many
to be an excellent lubricator. We have tried it with
satisfactory results on buggy axles, and believe it
will, when combined with animal oils, form an ex
cellenland cheap lubricator, partiClllarly for winter
use. When subjected to a high haat it yields Par
affine In large quantities, and from that material
beautiful white candles are taannfactured. It is un
equalled as a liniment for man or beast. Those er
r dieted with Asthma say it gives them great relief.
Physicians pronounce it 'valuable as a remedy in
Scroftdoue diseases. The great consumption, how
ever, of the oil ssill be for illuminating, and for that
i purpose It Is destined to come rapidly into use all
r over the country,. There is but little danger of tba
, market behomin,4 overstocked with it; it can ho sold
for so much lost than lard and whale oil that it will
in a few years to a great extern delve them out of
the market.
By reducing the price of lard oil, It will no doubt
affect the value of the bog crop all over the country.
There is no fear'entertained by the oil men that the
oil will run out; they believe that the supply is in.
exhaustible; that nature has kindly established a
grand laboratory, under that section of country,
where the manufacttuing process is going on contin
ually. We will mention a singular fact connected
with this subject before we close. In many places
In the valley of qtt Creek the ground Is covered with
puts, hundreds and thousands of them evidently dog
for the purpose of 'sithering oil, and at a period so
remote that from, 250 years old are growing over
them. The query is, by whom were these pits dug
and for what purges° was the oil gathered'

Judge Grier—l cannot say. Don't undertow:id
me so repudiating that case; but the decision
was hastily made, andibere were things uttered
in it which may be wrong, and I think were

these cases came to Washington, the Supreme
Court will hold your oily bound by bar sots, and
that the power to sub'gcribo includes the power
to lasso bonds.
