COURT 09 QUARTER BROBIONS.—Before Judges
McClure, Maynard, Adams and Parke.
Rutherford's Cose.—.lodge Shake asked that
the Court would postpone the hearing In the ar
guments in the motion for a new Walla the case
of Thomas G. Rutherford until next Saturday.
To this the Court assented, et, that on-Saturday
next the arguments will be beard.
Com. vs. Jacob Kyle, initiated for editing
liquor without a license, on oath of Dr. Ham.
Kyle keeps a licensed house at §barpsburg, but
thla indictment alleges that he sold liquor on a
picnic ground which he had hired. This picnic
ground was open on the 4th of July last and
Kyle had no right to sell there under hie Restive.
McKee, bar-keeper for testified that he
sold mineral water, lemonade, sarsaparilla, etc.,
and port wino to color it. My orders from Mr.
Kyle were not to sell strong drink on that day.
The defence brought on Mr. Stewart, a wit
'nese who testifiedAhat the picnic was got up for
the "Smoother Club," and that the club had
voted not to have liquor. The jury returned a
verdict of not guilty.
Commonwealth vs. Phillip Slicker, Geo. Bal.
doff, and George Miser, charged with assault
and battery on Peter Ilomiser, on the 15th of
September lain. Peter testified that the . three
assaulted him in a blacksmith shop, in Birming
ham. IL appears that the prosecutor, Romiser,
was a workman in the coal beds ad went to
this shop to light his lamp, when the three de
fendants, who were on a "strike" turned inlaid
"struck" the plaintiff with slicks and clubs.
This case was on nearly all the afterdOon,?and.
a verdict of not guilty was rendered.

Tuesday, Roo. 15.—The case of William 11.
Karol/3, indicted for the killing of James Duffy,
on the 18th of August last, in Wylie Street, came
up. Messrs. Collier & Shannon appeared for the
prokoution, and Messrs. Roberts, Hamilton and
Harper for the defence.

also absent, and Mr. Collier assented to the post
ponement, at least for a few days. A subvena

Great Eastern reports the effect of the late gale.
Capt. Harrison and the whole crow were at their
poets, ready to run the ship out if necessary.
-Between 2 and it the wind almost equalled the
force of a hurriitane, at limes jerking at the
masts as if it wodld snap them off at the deck,
making the Great Eastern tremble perceptibly
throughout her immense length and breadth, as
if some giant hand were shaking her. Captain
Harrison's water-proof coat was, on his way
along the deck, blown to ribbons off him, and
he himself at last carried before the gale and
bloWn down, and tumbled along with such vio
lence as to receive some severe contusions. The
Belden skylights were blown up, and wind and
rain poured into the saloon. The upper wood
work was leaking at every sea., and the lower
decks soft and splashing from the drippings.
Three anchors were down, and appeared taut en
the very utmost. At 11, the breakwater -works
were giving way,!portions of the wreak once or
twice fouling the'screw, and it was found neces

der sentence of death at Charlestown, Va , has
written a letter to Mrs. L.. Maria Child, thank
ing bor for her tender of services to go there and
attend his wants, and saying if is unnecessary
as he is in charge of a most imbue gentleman,
who, with his fatally, have rendered him every
possible attention he desired, or that could be of
the least advantage; and that be has ao far re
covered from his stockade as no longer to require
nursing. He suggests, however, that Mrs. Child
might judiciously extend her sympathy and pe
cuniary aid to his family, of whom he says:
"I have et homes wife and three young daugh
ters, the youngest but little over five years old,
the oldest nearly sixteen. I have also two daugh
ters in-law, whose husbands have both fallen
near me. There is also another widow, MTS.
Thompson, . whose husband fell here. Whether
she is a mother or not I cannot say. All these,
my wife included, live at North Elba, Essex
county, New York. 1 have a middle-aged son,
who has boon, in: some degree, a cripple from
his childhood, who would have as much as he
could well do to earn a living. He was a most
dreadful sufferer in Kansas, and lost all he had
laid up. He has not enough to clothe himself
for the winter comfortably. I have no living eon,
or eon-la-law, who did not suffer terriblyin
Kansas."

Wisconsin, the Republicana have carried their
entire State ticket by handsome majorities.
Four years ago we elected our Governor by 124
majority; but lost all the reel of the State offi
cers. Two years ago we elected the Governor
by 118 majority, , and the Treasurer and State
Prison Commiesiener by rather more; but lost
the other fire candidates on our State ticket.
Now, however, we have carried our whole ticket
by an average majority of three thousand or more;
and have solaria 'majorities in both branches of
the Legislature.
Thin signal triumph, in _view of the unusual
efforts made by our opponents, is a most gratify
ing and unmistakeable proof that Wisoonsin in
sound to the core, and that her Republican faith
cannot be shaken: Her vote for a Republican
President in 1860 may be set down as "a fixed

to institute a suit for libel against the editor of
the Nei Yotk Herald. The alleged libel being
the charges made against Weed, and other lead

New York Courier and Enquirer intimates that
Mr. Seward may adopt a similar course on his
return to the United States. The !Jerald, says
the Courier, Is employed by the Administration
to make these assaults upon the republican load
ers; and therefore it must be held responsible
for its slanders, and a verdict against the agent
milk in fart, bo a verdict against the principal.
RAILROAD COLLISION.—About six o'clock on
Saturday evening last, the eastward bound
passenger train on the Chicago andßock Island
Railroad, ran into a freight train of the Pitts
burgh, Fort Wayne and Chicago Road, at
Junction, six miles south of the city. Further
than that no lives were-loot, end that rho loco
redly° of the paasenger train was badly wreck
ed, we were null able to obtain particulars of
