sealed by the parties—husband and wife—before

Lowry, on Saturday, by 0. 11. Rippoy, solicitor
for the Railway Company, and Geo. I'. Hamil

The application is made by the latter, and ae
the points presented do not differ from those
made in the District Court, and reported in (ho
Gareth. of the 101 k inst., on a similar application,
we need not recapitulate.
Mr, Hippy maintained, in addition to the
points then presented, that it was a case of which
the Supreme Court could take no cognizance,
the Common Pleas being dealgnated in the act of
incorporation as the tribunal to which either
party should apply for an injunction, or for the
terms of compensation, fi:e.
It came out in the course of the argument that
the bill fled by the plaintiffs was not perfect,
since theses! of the corporation was not attached
thereto.
Judge Lowrie observed that there was no goes
lion about the jurisdiction of the court over the
case : nor did it appear to him that the defend
ant-sit:re not treepusers. The feat that the plain
tiff bad not filltiliod the rouditious of Moir char
--ter could not affect their franchise. If they had
failed in that there wan a proper method of pro-'
eroding. Nor did the fact that they had not
made applicatioo for an injnontion at an earlier
period justify the defendants The plaintiffs
