Judge McClure here said that the general
question was not before him at all, but simply
the question whether tho court would make Mr.
Venter take the stand ** a witness, lie said
the cases must bo decided al once, lie referred
to the 10th section of tho act of incorporation
under which (hey were silting in the case. That

powers. It saya that on petition of either part;
the court shall appoint a day for hearing, and
Shall immediately decide, and (hat decision shall
bo final. We shall decide at once. Here are
four corporations al loggerheads. We will hear
them all patiently and then give oar decision,
for we desire to (brow this Toad of responsibility
from na. No fonr nor other number of corpora
tions shall make us fritter away all this summer
when we bare been sluing here almost without
intermission since the first of October. The

Judge McClure said, the Court would assume
every word of that to be true if the respondents
desired. Just admit that it will cost that or
any other sign, it would make so difference at all
with the decision as to tho damages or compen
sation to be paid. The Court was not governed
by the ability of a man or corporation to pay, but
by justice to all parties; by right in the cate. Aa
fares the Court is concerned they ask not whether
the company be rieh or whether H be insolvent;
there were, or ooght to be, principles of decis
ion far above ail suob consideration.
Mr. Howard then plead at some length for a
Utile delay, until they could have other witnesses
examined.
The Judge said they had bad time enough, and
could have bad them all examined if they had
put forth proper efforts. The only question before
the court now was whether or not they had the
power tocoeree Verner into giving bis testimony.
The court had no snob power, and if U had, his
testimony as to what a prospective stock in a rail
way would be worth would be of no use in this
or any case. Judge M’Clure concluded by say*
iog that the public, the traveling public, arc into*
rested in having this means of travel completed;
that be would, after so mueh had been eaid, at
the request of Messrs. Howard and Mellon, put
off theirtearing. until two o'clock on Monday,
(to-day,) and if then they were not ready, the
judges would constitute themselves a committee
of viewers, go upoo the whole road, look at it,
makeup their minds, and then render their de
cisions.
The Lawreneeville & Sbarpsburg Plank-road
matter was also, at the solicitation of Messrs.
Hamilton and Hays, postponed till this mornioe
at 10 o'olook. 6
The Pittsburgh & Oreensburg Turnpike Com
pany matter, which turned upon a question of
taw, was than taken up and argued for the. Turn
pike by Messrs. Bruce and Neglsy, and for (ba
railway by <X H. Bippey, Esq. The points raised
were of .no poblioi interest. Decisions iotbe
cases wi|l probably be rendered to-dsy.

The construction of the passenger raHwoyi affords
facilities for visiting almost every part of tbo city, at
a trifling cost, and the cars are much more comforta
ble than tho “old-fashioned’' omnibus.
The completion or these roads is rapldlyiurreasiog
the growth of the city, by running through districts
which were until their construction almost uninhab
ited, tbns affording an easy means of access to the
business part of the city for many who reside in the
“country," or at least out of the bustle of business.
The cars leave the several stations every three and a
half minutes, iome of them passing up one street and
down the adjoining one; a few of the lines, however,
have doable traoks on tho same street. The faro on
aoy single ronte is flve cents; hot by a system of ex
change tickets, s person can for eight, ten, twelve,
or fifteen" cents, pass over two or three roads, and
tbns arrive at almost any desired point, although
perhaps several miles distant. I suppose the average
cost, on long by this exchange system, is
about one cent a miloJ It is hoped our own citizens
will soon have a trial of this mode of traveling. One
important item should be observed—to secure a raff
which will not obstruct the ordinary carriage and
wagon travel of the .streets they may occupy. ' This
run bo done, and unless it is dune, may be a serious
objection to their nse. ■

sure we met a mao waiting leisurely about among
tbo trees. From bis fine dress and gentlemanly ep.
pearanco we supposed him to be the Superintendent,
and inquired, *Do these grounds belongtothe Insane
Hospital 7” In reply, we received a look and an an
swer which convinced ns that,.iostoadof tbo Super
intendent, we had addressed a maniac. We scarce!;
know how we broke off the palnfnl conversation
which followed, but passing on, carefull; avoiding
to ask an; more questions of man; whom we saw
1 enjoying their morniog ramble, we soon rang the
door bell and were introduced to the Superintendent
who politol; conducted us through sever*! of the
wards. Somo of the inmates followed ns with an
uonataral gaze, while others covered their faces with
their hands or turned their backs as we passed.
Every suitable means is afforded for health and
amusement. Some enjoy almost every privilege
they desire; others ore confined to large and com
fortable rooms—except when, carefully watched,
they take the exercise necessary to preserve their
health; others, whom it is unsafe to allow any snch
privileges, aro closely confined In pleasant rooms.
Tho halls and rooms are famished. with billiard ta
bles, books, papors, ebus boards, Ac., while the
grounds are highly ornamented with walks, trees,
fountains, shrubbery, flowers, a door pork, carriages,
railroads, Ac., for the aansemeot of the inmates.
Every effort is mado to lead their thoughts in a dl
roction different from that which they hare former);
followed, and whleh may hare bead the cause of
their insanity. Oar feelings were far from those of
pleas or o, butjt was gratifying to tee how many corn
er 1 * are here provided for those who may never
have enjoyed, or may bat* lost the gift of reason.
The whole place presented an appearance of com-'
fort. In one of the halls is a painting of "Christ
boating the eicb," by VTest, and which has been pre
sented to tho Institution. A view of this rsioUo*
alone would well repay the stranger for a visit to tho
hospital. Several of the flretaUempts of the lame
artist are to be seen there also. w . „

Balavday, toe motion for * new trial in the case
of James W. Kennedy vi. Fooler & Fleeeon for
libel, was overruled. The deoUlon of (bo Court
overruling the motion was in writing, and was
read by lion. Judge Hampton. |t will bo re
membered that this case arose out of an article
which appeared in the Dispatch, charging (he
plaintiff with shaving notes with money «n*
trusted to him bykhe church and giviog a elow
note to pay; a boy who was
in his employ, etc. The cue was tried a few
weeks since and the jury gave a verdict for de
fendants. Thomas Williams, Esq , attorney for
Kennedy, made the motion.for a now trial which
was overruled as above staled. The Judge eays

trial, the facta were left entirely with the Jury,
who found that the oharges made by the defend

New Brighton, was arrested on Friday-night, by
Marshall Campbell, of the Western District of
Pennsylvania, charged with making counterfeit
coin, lie waa brought to this oity on (he even

States Commissioner, J. H. Bailey, Esq., for a
bearing. The District Attorney, It. B. Boherls,
Esq., happening to be from .the oity, Mr. Glass
waived a bearing, and entered battio slsoofor
his appearance at the next term of the U. 8. Dis
trict Court. It is alleged that ho paid counter
feit coin to a mao who was set to trade with him
in the desire or with the expectation of get
ting the bogus money. Counterfeit coin is said
to have been forund on ,his premises in consid
erable quantities.
OmtUABT.— Mr. John Nelson died in Ver
milliob ip., Ashland 00., Ohio, last-week, aged
-40. He was a native of tbe-Slato cf Vermont,
but resided for several years in this oity, whence
be removed to the place where he died. There
he cultivated a farm which he bad purchased,
and, (hough of delicate constitution, cojoyed
reasonably good health till within a week of bis
demise, when be was attacked with paralysis,
wbiob soon resulted fatally, ne is spoken of aa
a man of good intellectual powers, prompt and
energetic ia his business, and respected by all
