Case hhder the Foarrivn Slave Law. A
cue of peculiar character and more than ordi
nary interest, both lo professional and lay rea
ders, oame before Judge Merrick on Tuesday
moroiog the facts of which appear lo be as fol
lows:—John Witmer, of Washington county,;
Maryland, bonght certain slaves from the late.
General Lingan, of Maryland. One ofthe wo
men- thus purohaaed gave birth to a obitd who
was named Agnea Robinson. The mother of
Agnes was set freo at some time after the birth
of Agnes. Agnes herself was also manumitted
by her,master, John WUmer, in 1847. Shortly
afterward Agnea came to Washington city to
lire, with the fall knowledge of Daniel Witmer,
the eon of John Witmer, and in obout tho year
1849 herself became a mother. Daniel Witmer
now claims Agnea and her chitdas fugitives, as
serting his property in them under a bill of sale
dated in IMI. The father, John Witmer, died
last Summer, and the son made no claim on Ag
nes until after thedeathofhlsfather. Further,
the bill of sale under which ho claims was never
recorded in Washington coQnty, Maryland, un
til the present month, though the girl bad visi
ted for a considerable lime DaoielWitmer’s place
of abode in (hat county.
The claimant lu support of his claim produced
a oortifled copy of a record of the Orphan's Court
of Washington oounty, Maryland, consisting of
the petition of the claimant, not sworn to, and
the deposition of Benjamin ffiipicr, setting forth
that Agnes had been the slave of John Witmer,
tho father of the claimant, and was sold by him
to the claimant by-bill of sale 09 the Gth of May,
1844, and was afterwards in tjie possession of
the claimant, and that she passed out of bis pos
session about twelve years ago. -The reeord
contained a copy of the bill of sale. The origi
nal was not produced here, and it did not appear
from the copy to have been acknowledged or re
corded. The deposition did not allege that \g
nea or her child had tied from labor. There
was no judgment of the Orphan's Court; and the
proceedings in (hat Court wero confined to Ag
nes, the child not being included.
Mr. Davidge, who appeared for (be respond
ent*, offered io evidence a duly certified copy of
a deed of manumission from John Witmer, the
father, to Agnes, dated July 1817, duly ac
knowledged and recorded, and the free papers
istned to her thereupon; and ho offered witness
es'to show (bat the claimant neveT bad posses
sion of Agnea as his slave; that the bill of sale
had been virtually abandoned by the father and
bia eon; the claimant; that shortly after her
manumission she oame to this city (where her
mother, who had also been aaonmilled by John !
Witmer, Maided.) and has since, with the knowl
edge 0/ the claimant, Hired have an a free woman 1
and been treated and feeognised u such; and
that Agnea was in no sense a fngitlva and oould '
not be remanded in this proceeding
. Judge Merrick ruled that, nnJartfee'lOth see- 1
uouof the FogitiTo Slaife Law, the copy of the
reeord of the Orphans’ Ccuri was conclusive, and
that the only open question was that of identity
He therefore excluded the evidence cflered on
behalf of tho negroes.
It was objected that the copy of (he record'
could not be conclusive, not being in accordance
with the 10th section, Which relates to courts of
record, whioh the Orphan’s Courts of Maryland
arc not; that the Orphaoa’ Court had.mnder (he
law of Maryland, a limited jurisdiction, confined
to testamentary and other specific subjects and
plainly had no power to act in the premises
that the act ofCongress, with a view to (be pro
tection of tbsrightsof the negro, didoot embrace
every court, but had reference to the State tri
bunals haviog common law jurisdiction, and of
higher dignity, and with authority to entertain a
complaint of this nature; and that no act of Con
gress coulJ confer jurisdiction on a State tribu
nal.
Tbe Judge overrated these objections, and
held, as above, that (be copy of (be record was
conclusive.
The copy of the record bold to be conglpsivo
did cot embrace (bo child; she Dot
Uooed in it, and it was urged that as, nader the
ruling"Oi nrooeediog was auxiliary
to tbe proceeding in the’TJrplnrDXC'Onrt of Ma
ryland, and as tbe child was not
that proceeding, ebe could not be delivered to
the claimant; and (hot if, on tbe other baod, this
proceeding were original, then, under lbe sixth
section of tbe act, it was competent to ebon (bat
the child was not a runaway and was free. Gvi
i dence »o that effect was offered, as it had been
1 previously offered in tbe oase of tho mother.
The Judge bold lbe matter under advisement
until Wednesday morning, when he ruled that
tberecord was equally conclusive opoa the ohild,
and refused to allow the introduction of any ev
idence save such os would go to show that ebe
was not tho child bom since (be residence of
Agnes here.
Agnes and hor daughter were theu delivered
into the custody of the claimant.

Great muscular exertion, such os walking
long distances or performing laborious gymnas
tic feats, are manifestly unsuitable to' thoir ne
cessities. Experience and observation abund
aotly confirm this position. I can show a dis
tinguished minister, a man of remarkable intel
lectual aollvity and power, who has trained him
self in tho gymnasium, so that his arm is her
oulean for strength and bis chest absolutely mon
strous io amplitude. But with all this surpris
ing muscular development, it is curious to ob
sorve that ho is a most pitiable victim of chronic
dyspepsia, having a stomaob that will sometimes
go into tantrums under tbe burden of two fried
oysters! If be had understood tbe law of ner
vous equilibrium, be would have choeoo eome
exercise whloh shonld hate been less exhausting
than tbe pranks and musoular agonies of an
athlete. And if bo will demand nervous capital
enough for his musolcstobo a great athlete,and
on tho other hand demand enough for his brain
to be a great preooher, ho will have dyspepsia
to tho end df his days. 'Tho principle may be
laid down as sound (n a general application,that
a great amount of mneoular exerciso is nnenita
ble io etudious men.
Tnn Crops. —According to tbe latest advices
tho wheat crop in southern Illinois averages this
season thirty-five to forty bushels per acre, an
extraordinary yield.
tfiid pigeons are doing considerable damage
to com in Johnson county, lowa. It is said that
Hon 8. J. Kirkwood was obliged to replant 25
acres that the pigeons destroyed in a few hours,
after the stalk was two inches high.
The Onion crop in New England as for several
years past, is to a failure. The maggot
has done its work, and acres have been plowed
up and devoted to other crops. In many in
stances tobacco has been aubstiluted, and for
which the onion lands are peouliorly adapted.
Iq Texas the wheat crop is harvested, and has
proved a foil one. I learn flour, from wheat of
this year’s growth, is abundant and obeap. Beef

Tbe prospeot is good for a heavy yield of
ooorns, pecans and other mast for pigs. Pork

Banner learns from farmers who have been paying
taxes, that the wheat prospects in Knox count?

ML Vernon and Delaware is generally injured.
Emigration from Louihusa to Elayti.—The
New Orleans Delta says:—‘‘Large parties of free
persons of color have lately, at intervals, emigra
ted to Port an Prince, in Hayti, for the purpose
of there settling. They carry oal with them
farming implements, goods, a goodly quantity of
(he “rhino," and all the necessary articles to
constitute a settlement. It 6ecms that the Gov
ernment of Hayti bolds forth great inducements
to persons of color, giving them a tract of land
to settle on, and also payingtheir passage (hith
er—which two things are, perhaps, the main
canao of this precipitate rush for Hayti, though
not altogether the sole cause, as the etriogent
laws made a short time since by the Legislature
of Louisiana in regard to freo persons of color
remaining in the State, may be with justness as
signed as a partial motive for the emigration of
those persons we allude to. The first party of
these emigrants, numbering some 150 sailed
from this place in May last, in the brig West In
dian. Theseconddivision left yesterday, in (he
schooner A. C. Brewer. This party amounted
to about H>s persons.'All tbot had families took
them along, leaving nothing behind. We are in
formed by reliable authority, Messrs. P. & W.,
t hat this last party will be sucooedfed by another
in (he oonrse of another month."

the German sympathy for Austria. He says :
" But as a German, we can sympathise ’only
with Italy and France in this straggle, &e Kos

hold Italy and Hungary in bondage with Bohe
minian,Moravian,German and Styrian regiments,

fully that change is imprudont. But let her be
driven from Hungary and Italy, and she sinks

infatuation to believe that it ia her destiny to
wake thn sullen genius of tho Middle Ages, and
restore the faded glory of the Popish Power.
Archbishop Hughes, asapillar of “the Church,"
does well to repose his trust ia- the Chnrch’s
most sturdy champion, but In him beware lest
the reed upon which he leans proves a broken
one.
Peremptory orders have been issued requir
ing public offioers to subscribe to the Constitu
tion, under the penalty of removal. A thousand
dollars were raised yesterday from compulsory
contributions. This is tboody instancoof such
oppression since Gen. Tyler's interference on
behalf of the Madisonian. The Constitution new
receives $13,000 annually between Mr, Wendell
sod the Department advertising.
Nearly $1,200 were paid for the femoral ex
penses of the late Postmaster General Brown,
upon the order of a Secretary, and without the
color of law. The matter will be investigated.
Oov. Brown was rioh, and Ibis imposition onlhe
Treasury in a matter of much mortification to
his real friends. A poor clerk died recently
and was buried through a subscription among
