Crafty, for manslaughter, was resumed on Fri
day. The witnesses for whom attachments had
been issued were present, all except John Haney.
Ilis testimony was said to he important, but be
could nut be procured. The prosecution con
eluded about noon, the ease was submitted under
the charge of the court, and the jury, being ab
sent but a few moments, returned a verdict of
"Not Guilty."
Com. ye. Isaac Scott, ehargeil with assault and
battery with intent to hill, on oath of William
Smith. John H. Hampton, Esq , appeared with
Mr. Colper for the prosecution, and G. It. Rob
erts and T. M. Marshall, pup , for the defence.
Wm. Smith, sworn—Resided in Elizabeth tp
on the :10th of May. 1550; was hauling logs at
Ilayden's mills, with my brother; was going away
from the mills when Isaac Scott came out of the
mill and said he wanted to see me: he Critic out
and we sat down Together; he said I had been
telling blackguard lies abut him, which I denied:
he said I bad, and lie .allowed he'd shoot me;
drew a pistol from his pocket; I caught it, nod
it went off;. then drew a hatchet and we had 3
tussle; I got him down, but he struck me on the
forehead with the hatchet: I let him up after I
got the hatchet and be ran away; he got two
brickbats and swore he would have my heart's
blood. [The pistol, a very dilapidated weapon,
and a hatchet, were here produced.]

when I caught it; saw the butt of the pistol in
his pocket; my brother was near by when this
occurred : Mr. Johnsen was net there, he I
know of.
