Intelligence has reached us to the effect that
the,Orand Duchy—not the Grand Duke—of Tus
cany has declared la favor of Italian indepen
dence, or, in other words, has cast in its lot
1 with France and Piedmont. Of all the Italian
States,-the Grand Duchy has been the least mis
governed elope 1815 ;•but even there, the rulers,
In the hour of trial, fiud a long Score of arrears

Ia while back as 1848;'-the present. Grand Duke
might have conciliated to himself the good will
and respect of his peoplo—for his, in truth, bad
never been a grinding tyranny. The farmers

had lived happily and peacefully enough under
t his rule, snd they remembered it to him in the
holm of his need. When he absconded—for
i there Is no other term In which to describe the
manner of his precipitate fight—after the events
of 1848, ho was recalled by the affection of his

duchy with Austrian troops, and to convert it

Now, whether it is that the Tuscans were a
more enduring and patient race than the inhabi
tants of the other Italian States; whether it is
that the manner in which the rulers had exer
cised their away. despotic as It may have been,
was for milder than was the fashion of other
Italian princea ; whether Tuscany lay so near to
the great Austrian garrisons, and was on filled
with Austrian troope, and no weak that any at
tempt al insurrection could not but boil:latently
crushed; or, finally, whether, taught at last by
the events of 1818, the Italian friends of ligian
independence had resolved never to move again.

the reactionary policy of the little Tuscan Court
was tolerated with envier discretion and for
bearance by the people. The desire to free
themselves from the despotism of Austria was
there, bat they engaged in no idle plate, and
gave no excuse to their foreign taskmasters for

had made up their mind.. to bide their time and
the time has arrived at last.
Ail this, indeed, points to a foregone conchs
elan. It is no common Propaganda which has
beat at work in Italy sines the Autumn 0f1856.
Nearly every man among-the edoented-classes
who has net been absolutely connected by ties of
personal interest with the ruling Powers has been
a member of it. No mysterious cake may have
passed from hand to hand, id recently in India,
but the movement was as thoroughly organized,
and carried on in as complete subjection to a
central will, as the one which bat Lwo years ago
convulsed our own Indian Empire. We shall
have more incidents of tho /IMO kind torecord
within the next few days, for the Duke of blo
dens and several other of smaller Potentates
were far more hateful to their people than was
ever this fugitive .Grand Duke of the Toucans.
' That portion, indeed, of the Italiaosoilon which
the Austrian armies are encamped, or which is
commanded by their fortresses., is Austrian—not
&square rood of it beside.

Would that we could see the independenee.of
the Italian people—would that_we could see a
regenerated Italy at the end of this straggle!
But when the Italians, by French help—should
thin be the cent—hove chased the Angeleno
from their peninsula, who will help them to
drive away the French ? When we thinker the
hangings, and shootings, and oppressions of the
French to the southward of the Alps in farmer
due, it is difficult to decide whether they or the
Austrians have been the sterner taskmasters of
Italy. The Austrians at leant never led or drove
the youth of Italy to the shambles by wholesale,
as did the first Napoleon, nor are we aware that
they have ever plundered the mueettem and
churches of Italy in the same way as that warm
hearted friend of the Italian race.

him The Jury was necessarily a counterpart
of the Judge—old, broken down, party haeke,
with the sestet and marks of the party harness
still on them; *elected solely and exclusively
fol no purpose biut to do the thing they did. Of
course they returned the verdict required, and
the Court sentenced the convict, and he is in
jail. The Marshall and District Attorney per.
formed their functions, and to the acceptance of
their keepere.
This morning Langston will be sentenced; the
Court will adjourn without any delay, and Prof.
Peck and his associates will remain in prison.
The hearts and eympathies of a Christian people
will be with them, and this great outrage will
add another Item to the huge which awaits
the destroying and reforming hand of the Peo
ple—Cleve. Leader.

the Court this (Wednesday) morning was one
that will be engraves, ever, on the memory of
those who wero spectators of the most glaring
instance of judical injustice that Ohio ever saw.
The Court room was crowded and many were
unable to get near enough to bear the proceed
ings. The prisoner Bushnell, came in bringing
his child of perhaps eighteen months of age, and
accompanied by his wife and other female relatives
and friends.
The lecture read by Judge Wilson to the pris
oner was in as bad taste as In bad temper. A
stranger, not knowing the case on trial would
have aupposed a counterfeiter was clouding up
to receive his aentence to the Penitentiary. IThen
we look back to the charge given by Judge Wil
son to the Grand Jury—of which Boynton was
chief, and which found these indictments,—when
the Court went clear of the Bench to dilate upon
the theology of Oberlin, when we road the charge
of this same Judge to the Petit Jury in the are
of Langston, in which the Court gave the Jury a
lecture upon its duty as to the enforcement of
this Fugitive Law—an if fearful there might be
some Democrat on that jury who Might waver—
when we reflect upon the cruel Sentence of Bush
nell, by which a young MID, joist hegitining life,
dependent upon bin daily labor to furnish food
for a young wife and infant child, is doomed to
sixty day, incarceration in jail— in addition to
the thirty already ,offered—sentenced to pay a
fine of six hundred dollardand the costs of pros.
—these latter reaching to perhaps fif,con hun
dred or two thousand dollars—we confess that
Judge Wilson has executed this infamous Fu
gitive Blare Law with a vengeance. The thing is
past belief did not the bearing of the ears of five
hundred people proclaim its reality.
We speak plainly, but pereonal considerations
must be entirely laid aside rather than such a
Judicial wrong go unrebuked. Justice has been
stabbed in ita Temple, and State Sovereignty
and the rights of the..citizens of Ohio not only
invaded, but have been stricken down on the
very steps of the Altar of what should bo the
