Tan Fuesucr.--The Monongahela Navigation
Company was in great fear that the vast body
of water from Gm last week's rains would carry
away some of their dams. They were, fortu
nately, mistaken. The water has now subsided,
and no damage has resulted. The river was so
high that the boats penetrated to Morgantown,
in Virginia, some 20 miles above New Geneva,
lest which is considered the head of navigation.
Fatirr.—We have collected from a vast num
ber of our exchanges facts and opinion's as to the
condition of the fruit and the prospects for a
crop, since the snow storm and frost of Saturday
week. We have to make report from the data,
that no serious damage was caused and that the
crop promises now to be above middling, to say
the least.
Tun Wheeling Intelligence, .of Friday says that
the agent of the Pennsylvania Central Railroad
delivered at our door several boxes of stationary
and job room stock, which we bad ordered from
New York, at the low rate of eirty cents a him.

of the Bt. Nicholas, as belonging to this vicinity,

Char/sr.—Mr. J. M. Siebenick submitted a
preliminary petition for a charter for the First
German Evangelical Lutheran Congregation.
The church is situated at Dravosburg, Mifflin
township. It is to be chartered under the name
of St. John's Church.
Flannigan's ease.—J. M. Kirkpatrick, Esq,
counsel for Michael Flannigan, withdrew his mo
tion for a new trial and made an appeal to the
mercy of the court. He spoke in behalf of the fam
ily of the man whose sons and daughters are in
respectable positions and in posts of confidence.
Mr. Kirkpatrick read a letter in behalf If Flan
nigan from Hon. Arnold Plamer, from eftm the
valise was stolen. lie said in his letter Hint the
value of the clothes stolen was not above $4O.
The papers in the valise were of great value,
but to Mr. Plumer alone. lie said he had no
desire to press the man.
Mr. Kirkpatrick said that it was in a fit of
drunkenness the prisoner committed the oriole,
and that when he is sober there is no more
trusty citizen. lie asked the court to make the
sentence as light as possible, and to send the
prisoner to the jnil and not to the penitentiary.
George Black, Esq , formerly of Leech tn: Co.,
said that while Flannigan was in their employ
they considered him very trustworthy. They
hod entrusted him with bones of coin to convey
from one place to another, and he had always
acted right.
Mr. H. alert submitted letters and affidavits,
going to show that Flannigan was drunk on the
night of the theft, and when sober is an honest
and discreet man.
Mr. Fetterman spoke quite eloquently in a
set speech in behalf of the prisoner. Judge
Maynard made some remarks as to the Court's
views of its duty in the premises. Judge M'Clure
said that as a man, his sensibilities were moved
as deeply as those of the counsel, but as a Judge,
as a Court, they could take no cognizance of the
eloquent arguments used. lie thought the ap
peals to the feelings of the Court, out of place.
They would administer justice, ay, Jr9TIVC, With
out fear, favor br affection. Ile had consulted
Judges Maynard, Park and Adams, and they all
agreed with himself as to the sentence be was
about to pronounce--Penitentiary for one year.
Asvolut and Battery. —Mortis Carlisle, con
victed of two eases of assault and battery, one
upon Henry Weaver and one upon an omnibus
driver named Won., with a brick, wan sen
tenced to six mouths in jail for the first and to
three months for the second offence.

for sentence, tint a motion for a new trial was

not present. Terry was remanded without sen
tence.
New Tam —Jackson M'Cartney was granted
a new trial, on Saturday, on reason Bth: The
potent reason for a new trial wan this: that when
the jury came into court asking that the testimo
ny of officer Lewis be read to them again, the
judge read the said testimony incorrectly. Judge
51'Clure had abbreviated the testimony in his
notes, writing "pris" for prisoner, and "pros"

for prisoner, thus bringing Arptitcheon, the man
robbed, and M'Cartney, the man charged with
the robbery, in company with each other, a short

Ingurit No. 2.—The body of a boy woe found
on the shore of Wainwright's Island, near Law
renceville, on Saturday. It was thought that this
is the body of the boy drowned on Monday, we
think, In tho Kiskeminitas, the fact of whose
drowning we have before noticed. A verdict of
accidental drowning was rendered.
Inquest No. 3.—A woman was found dead in
her house, In Allegheny, on West street, in
the Third Ward. Verdict of death from intem
perance wan rendered. Her name wan l'lant.
Tits General Synod of the Lutheran Church
will be held in the Rev. C. P.- lirauth's church,
Seventh street, on the dash of May, (not June,
as previously stated.) Arrangements have been
made with the Pittsburgh, Ft. Wayne Sz. Chicago
Railroad to bare the delegates and others car

New SrEsmaa.—The Monongahela Repul lican
says that the Monongahela Steamboat Company
are now building, in West Brownsville, a new
steamer, to take the place of the Lucerne. She
is intended for a /cut boat, sad will he placed in
the "lightning line"—so as to make the trip from
Brownsville to Pittsburgh, and back, in daylight.
She will be furnished in anew etyle, withoutany
state rooms.

Common M. E. Church, an Saturday, at 8 a. a.,
Bishop Morris presiding. The session was opened
with the usual religious services, conducted by Rer.
T. M. Hudson, one of the oldest effective nduLters

The Recommendation of Local Preachers for De,

Rev .1 Wright, of the Cincinnati Conference, and
agent for Wilberforce University, was introduced to

made some remarks touching its interests.
The Recommendation of Local Deacons for Elder's
ortle}s, was called for, and J Boyd and P.P LAuffer,
being duly recommended, were elected.
Rev D P Mitchell having stated to the Conference
that Rev J Somers, deed, Lad bequeathed certain
moneys to the Chartered Fund of the Pittsburgh Con.
fereelce, Rev J Monroe was, on motion, appointed to
collect said moneys and pay them over to the Treas
urer of the Chartered Fond.
The Report of the Committee on the Bible Cause
was presented, read, and. after some discussion, was
adopted. Among the resolutions, we select the fol
lowing:

freedom of his eon, and after a statement from the
colored man, a collection of nearly eighty dollars was
raised to aid him.
Bev. J. W. Durbin of the North Ohio Conference
was Introduced to the Conference.
The Conference Stewards presented a report,which
was read and adopted. According to the report of this
Committeo,there was rased sl,soo,more this year than
the last, for (he support of the .4°mo:tooted Preach
ers, widows, and children, and only $773,27 lacking
to pay the entire claim of those worthy claimants.
Tho Committee made the following assessment f u r

A Warrens. woman living on Webster street,
was brought to the Mayor's office on Saturday
night in a wheelbarrow. She was in a state of
beastly intoxication. There was a row in her
house where she was living, where a drunken
man was making a noise and threatening to set
the tenement on fire. Six children, the young
est only eight months old, were also brought to
the Mayor's office. After a while, an aunt of
the poor things was found, who took them, and
their mother was locked up in the watch-house.

SUDDEN Dcsnr.—Leonard Kunkle, of Han
nabstown, Westmoreland county, Tißi ted Greene
burg, on Wednesday last, to purchase some
goods. While in Painter's store, in company
with his wife, he fell to the floor mid expired
almost instantly. Ile had been in his usual
health up to the moment of his death.
Tux Court of Quarter Sessions has nearly fin
ished its list of trials. The only cases left are
those of Barker, indicted for nuisance, in block
ing up theispeet during his speeches, and the
homicide case which occurred at Port l'erry.
The latter case will probably go over to next
term, however, as two important. witnesses are
absent down river.
Fins.—A house belonging to a woman named
Johneon, was burned ,Saturday night on Coal
Hill, nearly opposite mouth of Market street.
It was a wooden house, and entirely destroyed.
It wan unoccupied, and must have been set on
fire by some evil minded person.
Vertinc-r Itsmnanan.--Col. Simpson obtained
a 'verdict for $704 00 against Joseph C. Foster,
on Saturday, in the District Court. The sum
was for rent due Mr. Simpson for the Pittsburgh
Theatre, of which Mr. Foster woe for eaveral
years lessee.
Sifirrmicsu.—Hugh Dumars, for the offences
with which he was charged in Mercer, and found
guilty, was sentenced to the penitentiary for fire
years. Hugh Is an old offender.
Tun alarm of fire on Saturday was occasioned
by the burning out of a foul chimney on Wylie
street, near Chatham.

State Treasurer, Col. Eli Slifer, arrived at the
Capitol today, and will enter upon his official
duties on Monday. From the multitude of

commanding the fortes at Utah.
The complications and difficulties between the fed
eral and judicial officers is fully explained, and. his
course in responding to the requisitions made upon
him by the judiciary, which area co-ordinate branch
of the guvooment, is folly sustained and justified.
It appears that Gov. Cumming was acting under
special instructions from the State Department, and
directly opp..site to the instructions of Col. Johnston
and the judicial officers. The Cabinet has the
sub
ject ander consideration to-day. Gen. Johnstou's
despatches change toe aspen of affairs there, and it
is not known what course the administration will
pursue between the federal and judicial nni

Dr. Forney, the Superintendent of Indian Affairs
for rt.h, writes to the Indian Bureaupeinder date of
March ISth, that he is in possession of such reliable

the Mormons in the Mountain Meadow massacres,
and that but a few days after it there were distribu
ted to each of the leading church dignitaries thrity
dollars worth of property. The seventeen children
who escaped were in his care, and arrangements had
been made to restore them to their friends in Ar
kansas.

A battle was fought on the 21 of April, near Zuni,
-between the Navajo Indiana and Apaches, in which
tea of the latter and eight of the former were killed.
The Navajos also lost 4000 sheep. The Zuni Indians
assisted the Apaches.
The river is about stationary at this point and all
the upper streams are reported falling. Weather
clear and warm.
