The purpose of this act is ihc better to securo some of theso rights which 4»avo been systematically invaded, and at the same time afford the Stale, through its rep*- resenuuives, an opportomjy to declare its ver dict upon the fugitive slave law of |s.',o. For the information of those who may not have found time to examine the hill for them selves, 1 will state that the tiral section declares ihe ime intent and meaning of the act of 17H*. to be, that any person restrained of bis liberty is entitled, as of right and of course, to the writ of habeas corpus. The second section extends the provisions of the act of .1847, which prohibits the judges and justices of the peace of this Commonwealth from issuing warrants for the apprehension of fugi tives from labqr.'onder the act of Congress, of to the fugitive slave act of 1860. The tbirdseetion directs that' it shall be the doty of the judges, whenever it shall appear that the person whose liberty is in question is claim ed as a fugitive from service or labor in another | State, lo award a trial by jufy according to tho 1 forms of the common law: and the fourth and fifth sections points out the manner of summon ing the jury and tryiog the cause. The act fur ther provides, that no sheriff or other person holding office under authority of ibis Common wealth shall engage in the re capture of fugitive, slaves ; and lastly, that the jails and prisons of State ehall not be used to second aud promote the operation of the fugitive slave act of Congress of ISoO. b Such, sir. is the substance i.f tlir hill before you. I 0 the year ISSU, 1 think it was, under the malign influence of the facile Bigler, who then occupied the gubernatorial chair, a Democratic Legislator® repealed the act to which I hare alluded. The section which prohibits persons holding office under authority of the State, from assist ing hi the re-captnre of fugitives, rests upon tho same basis and i» sustained by the same reasons os the sections to which I have iu«t al luded. We shall be told, however, that if we pass Ibis act, it will be in violation of the Constitution of the United Blatea. That instrument provides that no person held to service or labor in one State, under the laws thereof, escaping into another, shall be discharged from 6nch servico or labor by any law or regulation therein, but shall be delivered up, on the claim of the parly to whom such service or labor is due. Now sir, who is it that is required to deliver up fugitives ? 1h ii the Stale, or Federal Government ? The idea that the Stnto government is required to perform this service, is contradicted by the fugi- It ve slave law itself. The Federal Government by the terms of that act, has appropriated to itself the business of huntiog down the fagitive It is keen and greedy for the work, and ought not to be superseded therein by the State au thorities. Besides, sir, it is not to be sdpposed that the Stales which have no interest in, or love for the slave system—the moral and reli gious convictions of whoso people revolt at its injustice and oppression—will lend themselves to the buisneas of slave catching. No, eir, the great heart of the North is opposed to it, and the laws should he made to correspond with its feelings and convictions. If then, the fugitive elate acts conflicts, both with the terms and the spirit of the Constitution, by which, as a State, shall wo abide ? Which is.the higher law, the Constitution, or an act of Con gress ? The fundamental law, or legislation in defianoe of that law ? Again we arc told that Iho supreme court has pronounced the act of ISSO to bo constitutional and thereby settled the question: Sir, neither an act of Congress, uor a decision of the supremo court, nor both together, can alter or amend the Constitution. If that instrument guarantees to the people the right of trial by jury, neither the Legislature nor tho judiciary can dispense with it. The supreme court has jasl as much power and authority for declaring the offices of iho United B(ales to be hereditary, as it has for in vading tho right of trial by jury in any case contemplated by the Constitution. Will any ■oembor upon this floor, conteod, Afcat the Con stitution, which guarantees the right to a trial by jury in a case assault and battery, or petty larceny—-even in every civile-case where tho amonnt in question exceeds the sum 0/ twenty dollars, denies it where the question is not of a fow dollars onJ oents, not of a few days, imprisonment, not of a paltry lino to be imposed by a court of justice, but in on issuo which is to determine our right to liberty itself—a right which we, sir, are. accustomed to hold dearer than life, and which thcro is not a member of ibis body but would rather laydown his lifo than surrender: Aro wo to be told iu tho face of the very words of the Constitution, that in an issuo of Buch grave and solemn import as this, we have not a right to call upon a jury of our countrymen to try whether the facta alleged are true or false ? Ah! hot gentlemen will gay that although Ihey ami l are entitled to the enjoyment of the right to trial by jury under the Constitution, there is a portion of the population who are not* and they aro the colored people of ibis country! If the Constitution did not address itself to the whole people—if the clause which relates to trial by jury had provided that it should apply to every body, except black men—there might be something in (his objection. But even then it would not excludo the mulatto, the quadroon, or any other shade of complexion except only the purely black, for wo must always construe in favor of liberty. But, sir, I find no such words in the Consti tution—they are not there—and I repeat that neither Congress nor tho supreme court have any power to put them there. Besides, sir, there is another phase of this. H is neither just, nor consistent nor becoming the majesty of a Sute, to guarantee to its people the enjoyment of a sacred right like this in the trial of questions which involve merely the prop erty, tho reputation or the temporary confine ment of the person, and deny it when the Issue is life-long slavery on the one hand, and the precious boon' of liberty on the other. Wbat though the victim bo blaok! What though he be the humblest member of the entire commu nity! Does that excuse the State for suffering her fundamental law to be violated " If it may be done in one instance, may it not bedouo in another'/ Ifit maybe done in the person of a fugitive from service to-day, may It not be in that of some other to-morrow '! When once a breach is made m the guards which are set to protect our liberties, tho stepß are easy to their entire overthrow. How the Ahti-Lecomptositks talk. —The Philadelphia Press says: The indifference of the people to the Conven tion of the adherents of the General Adminis tration, which assembled at Harrisburg on Wednesday last, was the result of a doable feel ing of contempt for its managere, and a foil fore-knowledge of its policy. Nobody expected decent, much less Democratic, action. Xbe great body of the delegates did not come to reiierago principles, but to earn wages. They did not vote the wishes of the people, but thanks to their masters. Rowe and Wright must take the chances of war. We trust, if they shall choose to stand upon this platform, they will announce the fact before Lhe cars bare started Let us have no more juggling. It becomes the good men of the Democratic party, outraged and insulted by the recent Ad ministration Convention at Harrisburg, to take immediate steps to resist aod rebuke that act of insolence anJ oppression.
