Giles and Emanuel, slaves belonging to. James E. Polk, .of Nashville, was the lost case of importance upon the State docket, and elicited much discussion from the bar, and feeling.from the community at large. The defenfonts were charged with “a conspira cy to mahftnsairection,” an offence under our laws puuishablo with death. The evidence show ed that the overseer, a timid man, and afraid of tho negroes, was in the habit of calling upon his associates to assist him in correcting them; that upon one of such occasions, they resisted him and his friends, and apparently with con certed purpose. 1 Oar State declares the term insurrection to mean “on armed assembly of claves of free holders, or both, 1 utving intended to resist or sabyert lawful authority.” Tho indictment having been drawn under this statute, Judgo Fisher, the counsel for the defendants, contend ed with great force that it charged no legal of fence, because the authority to be resisted or subverted most bo governmental authority— that is, tho power of the State Itself; that the term lawful authority docs not mean snob au thority as that of the master over his slave; and, although the law sanctions and regolates this magisterial authority, it is but an authority de rived from a domestic relation—not tho creature of the law, but existing independently of it.— This view was not, however, sustained byJjidge- Cothhus, and the case was submitted without argument to the jury, who found the defendants “guilty as charged.”: The case being one of life and death will,'doubtlea,-be appealed: and, as the question to be determined is one ' of nov elty and great importanoo, the Bar look foward with much interest to the decision of tho Appe late Court. ~. . . / > Howtuk IxroRTED Atkicaks Wokk.—Two of ! the Congo negroes brought to Savannah,Geor gla, inthe yacht Wanderer, hare been smuggled : into Mississippi. They are*on a plantation,, bordering on the Miaaiaiippi Central Railroad between, Canton and Doraut. Wo saw them our self. They aro in thn possession of a rery gen tail-looking man named Monligue. He says they arc obedient, and when: encouraged to labor they work rigorously. We do hot think they are raloable, from the faet that we beliere no whilo man would like to orersee a set of such hideous, senseless-looking creatures; besides, it should in our opinion, be. a great deal of trouble to keep them at work. They can ask for tobacco and whiskey, and per haps chew the former and drink the latter, hot they oan do nothing else. They know nothing about the use of olothing, and would as soon place apair of pants ontheir shoulders as their legs. One of them has formed a great fancy for umbrellas, and when a couple, of young ladles approached him, dressed in the present exten slro fashion, he down with his hoe, and pursued one of them with.aU possible speed, and a 4 he, came near her be rigceonsly grabbed’at''the gkirt of her dress, but befohjJie sueoeeded in getting hold of it, one of the attaches of the Mississippi Central Railroad Bacccededmltapck iwg him down. I iTbske U great danger That civil w£r is again about to breakout in Kansas, aail ihatmuoh blood will be shed. Got. Medary, of K&qs&s, and Gov. Stewart, of Missouri, are aoting as madmen in .the attempt to crash Montgomery and his partftaaain Southern Kansas by military force. There can be bo doubt but Montgomery and his men hare been guilty of outrages, bat it is »s equally certain that their lawless acta were committed in enterprises of retaliation upon the Border Ruffians'. Kow.it. is proposed to knot down the Frco .Stole men who during the times of Border warfare were Retire, while the Missourians, who, to flay the least, were eqq illy guilty, aro to .be soiled upon officially. Not ling is heard Id official circles of any effort to punish Capt Hamilton and his gang of mur derers. They were pre-slavery men. Their victims were Free Soilem. But Montgom«ry and bis adherents are to be punished. Tt is well known that Gov, Denver preserved peace in Kansas, simply by shelving fair play and soothing the niumosilios ofithe past. The conrso of proceeding of Medary, jet the instigation of the Governor of Missouri, is in marked contrast with this obviously proper' policy. Hence we hear shocking rareors of civil war. And there will be wars and rumors of wars natil there is fair) play, in construing the past and healing the present, when there will be peace. The m&ni resi|diBcriminaUon against Free Stato men in the [movements of Medary, and[ his ferocious call for piaaketo and soldiers, is intolerable, and will be resisted to the bitter nnd bloody end.—Cm.
