About the last ofj September, Robert Wray,
Jr., and J. 0.8. Golden,dolngboeinessanderthe
firm of Golden & Co., had tbo agency of a pa*
tent shack, invented by. Natali k Kirkpatriok,
for lorew cutting,-which Wilkins agreed to pur
chase from G. 4C0., for $250, payable in twenty
days. In the meantime, Wilkios left with the
proiecutcra two one thousand dollar income
bonds on Ahe Cinolonati & Marietta Railroad as
collateral security for the $250. At the end of
the; twenty days, the money not having been
paid, and in the meantime, as is alleged, the
prosecutors having discovered that the bondt
above mentioned were worthless, brought - the
above salt. John H. Kirkpatrick, Esq., appear
ing for the Commonwealth, and Messrs. Thos. F.
Marshall, and John F. McKenzie for the de
fendant. - ,
Judge McClure Inquired into the facts of the
case, and these facts appeared, vis: That the
original patent was in Nattall & Kirkpatrick,
and that the agenoy was what the prosecutors
claim to have sold to Wilkins.

Golden said to me that on the evening of OoL

agenoy;he proposed two bonds as collateral as-

they never' sold for less than forty-eight cents on
the dollar, and were now worth fifty eentsonthe
dollar; we took the bonds; after the bargain was
completed a receipt was given, the model of the
maohine was given to the original patentees to

tire interest in the screw culler; we objeoted to
the bona and he said they were worth 50 cants
on the dhllar, and showed that two of the con<
pons were taken off and had been paid,
Cross-examined—We did not give Wißuns any
moneybntwhatweoonaiderasgetfdas money;
we'gava him that receipt, (one'ihowed to witness
by Mr. Marshall); we had nothing but the agen
cy to well; the only thing we delivered to Wil
kins was. the receipt; we delivered a'model
machine to NuUU & Kirkpatrick, at Wilkins?
request; I did not claim in the month-of October
to be thh agents of Natali; & Kirkpatrick; we.
said we thought the two bonds were not worth
anything of any aceoont, Wilkias did not propose
to give me 1 , hla note; -we still have the articles of
agreement ,!*tween us and-Nutall k Kirkpatrick,
and in the month of November we refused to de
liver them up to that firm, because Mr. Wilkins
had not paid the $250; it waa after the bargain
was made, that we gave the receipt, and on our
v own suggestion.
J. 0. B. Golden, sworn—On the second morn
ing of the Stale Fair I was introduced by Mr.
Natali to Mr. Wilkins; Mr. W. said he was about
to porthneo ea interest in4he-screw cutter, but
our interest stood in the way; I understood when
we oloaed the bargain -that I had' sold my right
to exercise the agency in that/maohine. Mr.
Bolden detailed the Circumstances of bargain
id aale is the matter at some length, his etaie
eatw-sgreeing substantially with the feds
gathered firoaL£lb&e above testimony. Mr. G.

oaased to sot as agents, and had 1 since exercised
no control in the matter.

Cross-examined—We did not refuse, in the
month of‘November, to give up our agency to
N. & K.; we gave that receipt for the bonds to
Mr. WJUiaa; we sent the model to the inventors,
at request of Mr. Wilkin#.

Defence offered in evidence an article of agree
ment between Natali & Kirkpatrick and Golden
& Co.; also a receipt for two Railroad bonds of
Golden & Co., glveu by ibem to Mr. A. Wilkin#;
also letters from Golden & Co., to Natali & Kirk
patrick of date subsequent to the sale to Wilkins,
touching the screw-cutter; also the NeW'Tork
Jhbiaut report of stock sales showing the price
of C. 4 M. R. R. bond#: [the Utter objected to,'
and objection sustained.]
Mr. Natali, sworn—Oa Saturday, the day the
fair closed, Golden 4 Co., refused to give agree
ment up; ire gave them the model to sell by; we
asked for the article of agreement and Mr. Wray
refused to give it up; Wilkias bought of ds an
undivided third part of the original patent; do not
consider Golden 4 Co., my agents since October.
At this point the Court stated that there was
no' use in going farther; that the ease was closed
with the rating of case by prosecution.
Judge M’Clure then stated the matter in a
few words to the jury, and remarked in conclu
sion, that the Court'would not send a man tothe
penitentiary for not paying bU note. The jury
rendered a verdict of Not Guilty, without leaving
their seals, and ao the prosecution dosed.
Larceny Co##—Martin- Shank Indioted for
larceny of an overcoat, three palrtof pants, two
vests, two pairs of gloves,'three pairs of boots
and five silk handkerchiefs, at Sewfckley. The
prisoner was in the employ of the husband of
prosecutrix. Found guilty of petit larceny, and
condemned to imprisonment in county jail for
two months.

Isquist.—Coroner Boatwiok held an inquest
Tuesday morning, on tbs body of n man namet i
John Martin,, who died about 4 o’clock from in
juries received on the'Alleghany Valley Railroad
Monday afternoon. The engine run off the track
and Martin was killed by being crashed between
the locomotives when endeavorlog to got the
said engine on the traok again. He was a York
shlreman, aged about 80. > The verdict was In

lish a mail route from Lake Superior to the Pacific.
Mr. Davis, of Miss., introduced a resolution which
was adopted, calling on the President for the corres
pondence in relation to tbe outrages committed on
American oitizens oa the Isthmus of Panama.
Without action ou the bill, tbe Senate adjourned.
House.—After tbe usual preliminary business;
Hr. Hill, of Ga., asked but failed to obtain consent
for him to offer a joint resolution declaring that no
new State ought to bo admitted Into the Union nntil
it is ascertained by a census that it has a sufficient
population fora mymber of tbe House, according to
the Federal ratio.
The bill Introduced yesterday, by Mr. Slidell, of
La., whloh was inaudible from toe gallery, was an
act making an appropriation to facilitate toe acqui
sition of the Island of Cuba, by negotiation. The
bill says that, Whereas, The Island of Cuba, in
geography, possesses a commanding Influence over
the large ana annually increasing trade, both foreign
and coastwise, of toe Mississippi valley; Whereas,
The Island, in Its present Colonial condition, most
continue a source of injury and annoyance, endanger
ing the friendly relation between 1 Spain and the
United States, by the aggressions of fits local authori
ty upon American oommeroe and cituens, for whloh
tardy redress can only be had by cinouitous demands
on Spain; and Whereas, In the opinaon of Congress,
and u aceordanoe with the views of toe President,
u the last means of settling existing, and removing
ftitarc difficulties, it Is expedient that negotiations
for the purchase of the island should be renewed;
and, therefore, that $86,000,000 be placed in the
President’s hands for expenditures, either from the
cash in the Treasury, or be borrowed on live per cent;
bonds of a thousand dollars eaob, redeemable in from
twelve to twenty years.

ported at the last session from tbk Committee on
Foreign Affairs, disapproving of the act of the Com
modore Paulding, in toe seizure of General Walker
and his followers, but reoommonding that no action
be taken. Several amendments thereto were pend
ing, viz: oho presenting the thanks of Congress to
Cpm. Paulding and hU officers—a stoond,thit Com.
Paulding’s act betogjwitoout authority of law, meets
with toe condemnation of toe Houje—end a third,
aseerting the right of citizens to htln their neighbors,
who are struggling for freedom—4 right of which
they cannot be constitutionally depaivod.
Mr. Smith, of Ve., moved to lay ijho resolution on
the table, whloh wm negatived—yeas 82, nays 105.
The House then by a vote of 90 jom against 102
nays refused to refer toe subject to the Committee of
the Whole od toe State cf the Union.
Mr. Mills op, of Va., made an unsnocessful motion
to lay toe bill on the table.
Au amendment declaratory of toe right of expa
triation, aadjthat toe capture of Gen. Walker wm
within the letter and spirit of the Instructions of tbs
Secretary of toe Navy, bat without the authority of
law, wm rejected, m wm also an amendment con
demning the course pursued by Com. Paulding. The
vote on toe letter wm 56 yeas, 128 nays.
A substitute for the report of the Committee on
Foreign Affairs, tendering thanks to Com. Paulding
and his officers wm adopted, yeas 99, nays 85.
The question was then stated to be on agreeing to
the report as thus amended, when on a motion of Mr.
.Cox, of Ohio] the whole subject wm laid on tbe table
by four majority.
The Honseltoen resumed the consideration of the
motion of Mr. Bbennao, of Ohio, to refer the naval
appropnatioq bill to the Committee on Naval Affairs
instead of a Committee of the Whole on the State of
the Union sis proposed by Phelps, of Missouri,
who now opnosed that motion, saying that it
had been fonou wise to entrust ooly one committee
with financial questions and no good was to be ae
edbplished by toe coarse now recommended. Ho re
pelled the remark often repeated, that the Committee
of Ways and Means sought to absorb the whole
power of the Boom.
Mr. Montgomery, of Pence., desired to ascertain
whether arrangements had been made tbe
revenue of toe government Is to be increased. A
large national debt had been created, while Congress
is asked to vote thousands and millions 'of dollars.
He wduld inquire whether the recommendations of
the Resident—,
Mr. Ga., interrupting, said he objected
to this harangue! ’

Mr. Montgomery continued: If toe CommUteo of
Ways and Means have made no arrangements forau'

tional debt, and would therefore vote to refer toe bill
to the Committee on Kkval Affairs.
Mr. Boeoek wanted the bill so referred, in order to
give it a thorough overhauling and to see whether
anything that ought not to bo there could not be
rooted out. A feeling is growing among the people
that something Is wrong in the manner of expending
money, and hence there should be a close examina
tion of all bills containing appropriations of money.
Without eomlng to any conclusion on the subject
under discussion, the House adjourned.
