(?h&3c is a document of more than usual excel
lence, in Us way. Direct ami perspicuous in its
style, and occupied solely with topics appropri
ate to tho occasion, it is hardly too mnoh to say
that it is a model message.
Tho account it gives of the condition and pro
gress of our Commonwealth, while liable to no
imputation of exaggeration orself-gloriGcation,
is generally flattering, and under all tho circum
stances, everything that could bo reasonably ex
pected. Our educational and benevolent insti
tutions, according toi the Governor's exhibit,
bave remarkably Improved, daring tho last five
years, are such as can be paralleled by those of
few if any other States of tho Confederacy.—
With tho liberal and wlbc recommendations of
tho Governor fully earned out, they willspeod
ily become not only unsurpassed in the adapta
tion and perfection of their organization, hut
also in their benefioieat results, bringing an am
ple return to our people, for the generous out
lay thus made.
The evils of “intemperance" manifold and
ineomputablo—are appropriately noticed, asdo
serving legislative treatment. The recommen
dation in regard to founding an Inebriate Asy
lum, is one ihnt should be received with univer
sal favor.

The number of capital crimes committed in
(his BlAte, during the year, is at viow startling
thodgh not greater comparatively, wo believe,
than in other .States. The immunity which- crim
inals havo bo largely experienced, in one of tho
least credible features of our social condition,
andimerUs itill stronger comment, perhaps, than
it hhs received in the Executive message. We
attribute this not alone to the repugnance of
juries to eoforco tho death- penalty, but in part
also.Jo prosecuting officers, and to tho too lax
of justice generally, which char
acterizes the present generation. We doubt
whether legislation will speedily romody this
evil, through the suggestion of the Governor, as
to leaving the Courts the alternative of punish
ing with death or imprisonment for lifo, in capir
la) ruf?, might tend 10 insttro greater certainty
of- cooviction.

The Public Works appear still to be a burden
instead of a source of revenue; yet their sole,

dispensable to the interests of the State, is hard
ly possible. On any lees equitable and safe con
ditions, such’sale would bo nimost universally
condemned, and deservedly, so.
The other recommendations, cf tho Executive
which are few, are such as will be generally ap-
proved. Ho docs not talk for buncombe, but
treats of only euoh matters as are naturally for
ced upon bis uttantion, and always offers « good
reason for whatever legislation is pr jposed. He
introduces no abstractions, and says nothing
that can properly give offence in any qaarter,
however, much bis views, clearly and oubesita
tsogly proclaimed as they are, may bo dissented

A Novel Case is Court.—ln the Supremo
Jourt, at New York, on Tuesday, a young wife,
(rs. Mary Elizabeth Sinclair, says the Tribune,
pnlied for a writ of habeas corpus, commanding
John S. Sinclair, her father-in-law, (o produce
tho body of her “missing*’ husband before tho
Court. Her petition states that her father-in
law detains her hubUnJ, and refueos to allow
Mm to visit or live with her; that John 9. Sin
clair has declared his intention to keep his eon
away from her at all hazards, and will, if neces
sary send him out of the country to prevent them
living together.
The elder Siaolsir made a return to the writ,
that bis son was a minor, domioiled up to tho
. date of the writ, in his house, and wholly do--
pendent upon him ; that ho was not restrained
of his liberty by force or confinement, bat only
commanded under pain of parental displeasure,
hot to leave tho premises, for a previous disobe
dience and disrespect of the command cf hts
father. In conblnslon, ho states that on (he day
the writ was {granted his son had already left
the control and custody of his father with tho
consent of the latter, who consequently could
not nowprodueo him, as required by the writ.

The stook of tho Panama Railroad has be
come so profitable that English -capita'ists aro
buying it op at a large premium. The road is
only 53 miles long, and has oost $8,000,000; yet
It is earning over 12 per cent, per annum. At
present, thero is no prospect of its earning less,
as England has about oouoladed to establish a
line of Australian steamers via Panama, which
will in speed exceed even the Red Sea route.
Tho construction of the Panama Railway, is one
of those triumphs of tho genius and energy of
our oountrymeo, which has given our nation a
proud niohe in the world’s temple of industry ;
for the reason that when it wasfirst undertaken,
on account of the life-destroying climate of tho
Isthmus and Us almost bottomless swamps, the
completion of a good road was considered im
possible ; yet it is in suoh successful operation
that the passage that formerly required two
days, is now made In two hours, and tho stook
is the most profitable of any railway in the
world.

State Aid to Railroads.—Missouri ia suffer
ing in Its finances from tbo failure of the rail
road corporations,, to which the Slate leot its
aid, to pay the interest on the State bonds. Two
of these railroads will probably be sold to save

Wealth or the Pore.—lt is said that the
Pope receives out ol his state some $8,000,000 a
year. Of this $6,000,000 goes to his private af
fairs, and $2,192,000 to pay interest—s2,7oo,-

to maintain the prisons ; $24,000 to schools.—
Other expenses in proportion. The yearly de
ficiency is $1,800,000. The clergy own one
million dollars’ worth of real estate, and hold
all of tbe fat offioes. The State debt is twenty
seven millions.
Gen. Houston not a Candidate.—Several
friends of Gen. Bam. Houston bave noticed him
as a candidate for the Presidency in 1860, bat
tho General is now on a visit in Now York and
pubicly proclaimed that bo is not a candidate
for that or any other office. On the subject of
the Presidency the General disclaims all ambi
tion for such an honor, and says ho woald ac
cept of no snob a position, oven though it were
unanimously aocorded to Mm.
