sets as put down on the sheet, if realized, were

Mr. Thos. Mellon,.for the defence, here rose
and elated that the testimony for the Common
wealth being now all before the Court, it could

The defence was now in Court, with thirty or
forty witnesses, bank books, etc., etc.; ready to
go on with the ease; but he, Mr. e 1.,. Appealed
to the candor of Mr. Sweitzwelder to say wheth
er he had made out hie ease Under the counts in
the indictment.
Mr. Swartzwelder acknowledged the fact that
he had not; the fault was tot, however, in him:
or in the indictment, which was perfectly drawn,.
but in the net tinder which prosecetion.,Wes
brought; he had conaulted with Mr. Collier
(who was absent from. Court and sielt).and that
gentleman had also expressed hie doubts as to
whether they could make out their case.
Judge M'Clure then madesome remarks. Ile
raid that Dr. Dake's money drawing interest in
the concern of Arthura, Rogers & Co., was not
to be considered under penal law as a deposit
but as an investment: the Doctor had put in-his
money there drawing 8 per cent. and he moat
rue his risk: be might have . pue. it, into th e old
.Bank of Pittsburgh where it WoZtld been been

where and must abide the circumstances.
Mr. Mellon sold he took the same view of thei
ease: that the law d'f 1858 referred to what is
usually called n breach of trust, where specific
slims of money were taken and misappropriated.

Under the instrtietions of the Court, the jury
withoutletaving their seats brought in a verdict

Ws regretted to learn yesterday that our
friend, P. IL Collier, Esq., District Attorney, is
80 unwell as to be_conGued to his bed.. We are
not at all surprised at it, for ho has been for the
lasted: weeks working in season and out of sea
son in hfs.daties to the Commonwealth— Some
cases he has had have been so exciting and ex
hausting es to require an Iron frame and consti
tution To — wiihstaul their wear and tear. We
sincerely hope his illness may he of short dura
tion, and that ha may speedily be restored to
his place.
DlED.—Tbereacrable-Major Beckham, an long
Warden of the Western Penitentiary, died yes
terday. Major B. was a man of quite striking
appearance, with an eye like a hawk, a clear
ringing voice, and a frank, fearless, open bearing.
Re was a Virginian by birth and a worthy chi-
Zen. We believe he died of cancer in the face.
We learn that his family is afflicted, his daugh
ter-in-law having died on Tuesday and Mr&
Beckham lying quite low. This is very, very
sad.

01 Tuesday evening last, Prof. Warnelink and
the accomplished Mrs. Wade and daughter, gave
a concert at the Insane Asylum, under the care
'of Dr. Reed, for the benefit of the unfortunates
in thatinolitution. We are informed by a gen
tleman who was present that the delight . exhibl
led by the auditory was marked and the effect of
the music soothing and salutary. We all owe
our wtirmest thanks to tho benevolent friends
who le* their powers to ease the heavy load
that, "weighs upon the brain of madness."
AMIDE:ST.—The train on the fast line from
Philadelphia, on the Central Road, ran off the
track, about one and a half miles beyond Cone
tnaugh, on Wednesday morning about 2 o'clock.
The ;milt was very badly smashed up, the cars'
and engines being broken to pieces. Fortunately
not /I single soot was injured in the leasL The
paliengers were detained about two hours. We
learned from a passenger that the engine shot
from the track, owing to a defective rail on the
crossing of a culvert.

Friday last, Jacob, aged 19 years, son of
Mr. George Alerts, of Franklin township, Weft-
Moreland county, while feeding a threshing ma
chine near Manor Dale, had his hand caught in
the cylinder, tearing the arm off above the el
bow. Drs. Duff, of Manor Dale, McNeil, of Sa
lem, and blurry - , of Murryaville, amputated the
Arm near the shoulder, hut it is uncertain
whether he will recover.

Booes.—We learn that our' esteemed friend,
Mr. J. S. Davison is to move to Wood street,
corner of Diamond Alley as soon as the Holidays
ere over. All our friends the hook-sellers, are
making great preparations for tho approaching
holidays. We have not as yet seen any books
for the season, but shall doubtless be able to
notifi the public in due limo of the various gems
for gift that may offer. •
