This is a moat deluaire statement. The South
_ftn democratic papers olaim, and tho argument
on the democratic basis is on thoir side, that,
according to the Pred Bcott decision, Slarery
axisti constitutionally in all the lerritories; and
that, this fact being conceded, as it is by tho
northern democracy, it is the duly of Congress
to prepare a Blare Code for the territories, in
order that slareholders may enjoy protec
tion to their ftueged) constitutional rights, as
against any ieWs the territorial legislatures may’
frame of a contrary kind. Thus, for instance,

ligations and duties which, that judgment im-

It will bo seen that the Union not only con
lends that Blartry exists in those Territories, but

gress Is bound to pass laws for the protection of

.Alinding to Judge Douglas’ position on this
point, as shown in his .Freeport speech, it says:
