papers a letter in which he intimates that the
Academy was rathe’r unfairly closed against the
gathering. He writes his opinion ofLccotnpton

Isay it is not, and I shall prove it. The first
witness is the Convention itself; they were urged
16 refer Ibe matter to the people; the President
in his high office pledged himself over and over,
and over again to tho approbation of that coarse,
and by.thc authority an t .vkh the knowledge of
the President, the Govmior, and officers of the
Presldimt’fJ appointment, quieted the discon
l«hii of the people of Kansas by advocating the
necessity of such submission before the Consti
tution could claim any validity. And yet Ibe
Convention refused to submit its doings to the
people; thus confessing its consciousness that
its work would be rejected.
The second witness is Ibenewspaper press of
Kansas; that press is against the Constitution
by a majority of seven or eight to one.
Next; Kansas; by act of has a right
to a delegate in Congress, charged with the duty
to speak for its people. They have flow a dele
gate who is undoubtedly Iho choice of the peo
ple, and is ibe first KansaiVjTelcgftte ever chosen
by the people. He is myinird witness.
: Next; ask tho line of Governors appointed by
Presidents themselves; Geary, Walker, formerly
Senator from Mississippi, andrecenlly proposed
for a place in the present President’s Cabinet,
and highly commended by the President himself;
Stanton, so lately member of Congress from
Tennessee, all agree. • And I would not fear to
ask Denver, the present incumbent; he will cer
tify that even a fraction of the party against the
Lecompton Constitution is mote, numerous than
the whole of its friends.
Fifth. The people of Kansas now happily,
thanks to Walker and Stanton*, have a Leg
islature indisputably representing that people;
and so soon as they could lift up her voice, they
protested against the Lecompton Constitution.
Sixth. Those State officers who received the
largest number of votes aL tbe election on the
4ih of January last, have likewise sent their
protest to (Jongrcss.
Seventh. The voice of the people of Kansas
itself should be heard On the 4th of January
ibey repaired to the polls nnder uo ordinary
circumstances of solemnity. Tho Dissident has
sanctioned the proceedings by his special pro
tection; the Legislature and Denver took care
lhat the vote should be an honest one, and by
(hat vote it appaars that an overwhelming ma
jority of the people of Kansas reject the <-onati
tulion of Lecompton.» •
So then we havot seveu sets of witnesses

of the Lecompton Convention; the Kansas Press;
the Kansas Delegate in Congress; the series of
Kansas Governors—four in one year; the Kansas

the reach of uneasy apprehensions, and imparlß
to its position a dignity that belongs only to

Their approximation in “many respects, in
their political constitutional organization is well
calculated to encourage political and’social sym
pathies promotive of mutual benefits and future
commercial progress, while an institution common
to both countries, fixed and deeply rooted in their
soil, (with many hostile prejudices to encounter from
irilho'ut,) does now establish au affinity between
them, and will insure, for mutual defence, a unity
of action and feeliny that will prove invincible in
'the future.

Tbe Emperor, in an appropriate reply, recip
rocated the assurances of friendships but did
not answer n word to Mr. Meade's hints on the
subject or Slavery. Neither 1 -did the journals
of Bio Janeiro, in commenting on Mr. Meade’s
reception, allude to his pro-slavery point, and
aL the latest dales,-therefore, Mr. Meade’s pro
slavery diplomacy seems to have been a failure.

again retired in oar immediate vicinity. It
made its appearance in a protracted meeting
among the Methodists at Indian Grovo. The

ers and unconverted men, who tried to resist it
by folding their arms and wrapping them tightly
about their bodies, but in spile of themselves

would be jerked back, till they lost all. control of

prevalent. Davidson's Presbyterian Ilistory con
tains a very curious account of these cases. The
cracking of the women’s hair “liko a whip,” as

were informed that in future no Senators inim

and Stuart are read Out of the parly."

by Judge Woodward, of the Supreme of
Pennsylvania, .in the long contested suit or
O’Brien vs. the. Philadelphia, Wilmington ana
Baltimore Railroad Company. The Philadelphia
Ledger says: '
... “Xtic suit was brought Tor damages'., for per
sonal injuries sustained by the plaintiff while -
crossing In a two-horse wagon the- traefcofthe
railroad. The case, was prosecuted and defend
edbyeeveral of our ablest counsel, and the trial
occupied three or four, days, resulting in a.ver
dict for the defendants,, every point being
orately discussed. Judge Woodward, charged
the jury substantially.as follows: '- “Ist. That
a person about to cross a railroad' track', is In
duty bound to stop' andlook in both directions,'
and listen .before crossing. ■ 2d. Thai If tho
plaintiff contributed in the slightest degree to
the accident in question, he could-not'recovor,
although the railroad company were negligent,”
"This, in our opinion,'is not only good law, but
•commonsense. The idea that has solong pre
vailed that railroad companies )aro to be made
responsible for all tho consequences from collis
ions the lines ot their respective roads,
whether they’werc negligent in attending to
their duties ornot, heeded the check which Judge
Woodward, in his ruling has given it. . Here
tofore, the tendency of thc.-decisions of courts
and verdicts of juries have all been in'the wrong
direction. Instead of tending to'make private
travel careful in crossing the tracks of railroads,
the disposition to consider the railroad company
Always in the wrong, and the individual always
the victim, awarding him promptly-.full,' and
sometimes exemplary.damages, has tended to
make them • recklcss .of tho damages thot : may
ensue to the Railroad company’s- property, and
the lives ot. their passengers and employees. If
courts and juries had, set ont inthe first eslSb
lishmentrof » allroada with tho principle of liold
in'g'private travel liable Tor damages to railroad
companies and their passengers, the nuruber- : of
. accidents would-no ■ doubt have 1 been greatly
lessened. The tendency has been not only to
make individuals, criminally careless, but has
even opened the door to the malicious and knav
ish, to put comparatively, valueless property, in
tho shape of horse-flesh and cattle, iB the way
of danger, that a good round price might be
obtained, and perhaps some private pique and
malicious purpose gratified. Tho Wilmington
-Railroad Company has acted wisely in resisting
this wrong, and Jpdge Woodward his done him
self signal credit m righting it.
Tns Chateaux in Fbahce.— According to a
general survey lately made of all the old castles
and country seats now existing in France, there
remained 20,312, of which 311 are of the 12th
and 13th centuries; 804 of the Mlh'and loth, and
3,114 of (he ICtb. The others are of a later date. '
