I believe it would, have been-voted down by. a.majority of four to one. I-am Informed by men well posted there Democrats—that:it Aroold.le voted down by ten to one; some nay twenty to-one. Bat Is it a good ransom why you should de-, dare it in force, vithatt being submitted to the people, merely because it would have been vo ted down by five to, onelf, you had submitted dolg , thetPrevel . Does It not show undeniably that an overwhelming majority of the people of Kansan 'aro unalterably opposed to that constitution? Will you force it on them against their will simply, because they would have voted it down if you had consulted them? If you will, are you going to force it upon them under the plea of leaving them perfeetly free ect form and regulate their domestic insti tutions it their own way?' is that the mode in. which I ant called upon to carry ma tho principle of self-gormnnent and popular eovereignty in the Ter ritorks--to force a conetitatio'n on the people °goblet their will, i n opposition to- their _plotect, with a knowledge of the fael, and then - to animists a reason for my tyranny, that they Moil/ he to oh:finite and to perverse as to vote dowlejhe constitution if I had given then* an oplunittnity4o - hiceaindled about it, Sir, I deny .your 'right or Ciao to inquire of these people wluttheir objection's to that Con stitatitt aro, They have a right to judge for themselves whether they like of dislike it. Whether good or bad, whether obnetimmer not, is none of, my business and toneet, yours. It is their business and not -ours. -I -care not what they have in their Constitution, sothat it snits them and does not violate the Constintion of the United States and - .the. ftrulamental principles of liberty' upon which adi Itislitution - rests. I am not goingto argue the question whether the banking system established:in- that Constitu tion is wise or unwise... It sayathere shall be no monopolist, bat there shill be one bisk of discoamt it • the State, with two branches. All I have to say -on that poinlis, if they want a banking system let them lave it ; It they. do not -want it let than prohibit it. So you may go on with all the• tinferent clauses of the constitution.. They may be all right; they may be all wrong. That is 'a (Ines an on which my oplaton Is worth nothing. The opinion -of this wise anti patriotic Chief hlag istratb of the United States is not worth any thing as against that of the pecrple of : ;Kansas, for they hare a rightto. judge for th li einielres; and-neither Presidents; nor Senators, nor 'House of Representatives, nor any other power outside of Kansas, has a right to judge for them.— Hence it is no justification, in my mind, for the violation of a' great Trinalple of -melt-govern ment, loamy that the constitution youareforeint on them is not partientarly-bbnorious,. or is ex cellent in its Trovisions. . Perhaps, air, the same thing might be Said of the celebrated Topeka constitution. I do not recollect peculiar prorisions. I know one thing; we Democrats, we Nebraska men,:vould not even look into it to seChithat its 'provisions were. Ido not know; I. do nol care. You have no right to forcenn unex ceptionable constitution on a people. It does not mitigate the evil, it does not diminish the insult, it does not ameliorate the wrong that you are forcing *good thing on them. lam not willing to be forced to do that which I would do if I were leftfree to judge and act for mysoll. Hence I assert that thereto no justification to be made, for this flagrant violation of popular rights In-Kansas, on the plea that the constitu tion which they hare made in not particularly obnoxious. lint, sir, the President of the United Slates is really and sincerely of the opinion that the shfverY, clause luta been fairly and Impartially submitted' to the free acceptance or rejection of the people of Kansas, and that, inasmuch is Oust Was the exciting and paramount question, if they get the right to vote se they please on that subjeit they ought to be masted; and pos sible it might bo better if we would accept it, and put an end to the qUestion. Let me oak, sir, is the slavery clause fairly submitted, so Unit the people can vole for or spire' st ill Sup pose I were a citizen of ii 3121189, and should go alp to the polls and say, "I desire Vo vote to make Kansas a Slave State; here la Myhallot." They reply to me, ttiihn , Liouglas, just vote for that Constitution first, if you please." "Oh, .nod" I anawer, "L cannot vote for that Consti tution conscientiously. Then they answer. "You shall not vote on making it a Slave State." I then say, "I want to make it a Free State." They , reply, "Vote for the Constitution first, and' then you can vote to make it a Free State; otherwise you smonot." Thus they disqualify every Free State man who will not first vote for the Constitution; they disqualify every Slave State man who will not first vote for the Constitution. No matter whether or not the voters state that they cannot conscientiously vote for those provisions, they reply, "You cannot vote for or against slavery here. Take the Constitution as we' have made it, take the elective franchlee as we have estab lished it, take the tousling austere as we have dictated it, take the railroad lines as we - have located them, take the judiciary syatem as wo have formed it, take it all as wo have fixed it to salt ourselves, and ask no gliestlons, but vote for Rios youthall not vote either for a Slave or Free State," In other words, the legal effect of the schedule is this; all those who are in favor of this Constitution may vote for or against Slavery, as they please; but 01l those who ore against this Constitution are disfranchised, and shall not vote at all. That is the mode in which the slavery proposition it admitted. Every ' man opposed to the Constitution is disfriuschised on the slavery clause. /low many up:they ? Thin is a very important qualification— s qualification that controls a man's vote and his action and his conscieace, if he is an honest man —a qnalification Confessedly in violation of our [ platform. We are told by the President that our faith and one honor are pledged that the slavery clause should be submitted without qualification of any kind whatever; and now am Ito be called upon to forfeit no, faith and my konor in order to 1-miare•ct small minority of the people of Kansas to defraud the majority of that people out of their I elective franeldee2 Sir, my honor is pledged: and before it that/ be tarnished, I will take whatever eon st9uencespersonal lamprey may ram,: Got serer oak me to do an act which the President, in his mewaye, has said is a forfeiture of faith * a violation of honor, and that merely for the expediency of wring the party. I will go as far as any of you to care the party. I hare as much heart in the great cause that binds us together as a party as any man lining. 1 will tacrifiee anything short of principle andhounr for the prate of the party: but if the party will .ht eland kg its principles, let faith, its pledgee, I mill diancithere, and abide whatever ronseguimers may re sult from the position. Let me ask you, why force this constitution down the throats of the people. of Kansas, in opposition to their wishes and in violation of our pledges. What great object is to be attain ed° Cui bone 1 What are you to gain by it Will you sustain the party by violating its prin ciples? Do you propose to keep the party united by,forcing a division? Stand by the doctrine that leaves the people perfectly free to form and regulate their institutions for them selves in their own way, and your party will bo bolted and irresistible in power. Abandon that great principle, and the party is not worth sav ing and cannot be saved, after it shall be vio lated. I trust we are not to be rushed upon this question. Why shall it bo done ° Who is to be benelltted ? Is the South to be the gainer ? Is the North to be the gainer? Neither the North nor the South has the right to gain a sec tional advrintage by trickery or fraud. • But lam beseeched to wait until I hear from the election on the Slat .of December. lam told that perhaps that will put it all right, and will save the whole difficulty. How can Perhaps there may be a large vote. 'There may be a large vote returned. But I deny that it, is possible to have a fair vote on the slavery clause; and I sartluit it is not possible to have any vote on the Constitution. 1 rhy wait for the mochery of an election, when it is provided uneaterably that the people manor coo—when the majority are dis franchised? Bat I am told on all sides, "Ole, just wait; the pro-elevery;clause will be voted down."— That does not obviate any of my objections; it does not diminish any of, them. Yon have-no more right to force free State Constilat lon na Kansas than tit:slave State Constitution- If Kansas. wants a slave State Constitution she has aright to it; if she wants a free State Constitu tion she has a right to it. It is none of my business which way the slavery clause is decided. I care not whether it is voted down or voted up. I Do you suppose, after the pledges of my honor that I would go for that principle, and leave the people to vote as they choose, that I would now degrade myself by voting one way if the slavery clause be voted down, and another way it it be voted up? not how that vote may stand. I take lt for granted that it will be Toted out. I think I have seen enough in the last three days to make it certain that it will be returned out, no matter how the vote may - eland. - Sir, I am opposed to that concern -because it looks to me like a system of trickery and jug glery to defeat the fair expression of the will of the people. There is no necessity for crowding thie nteasitre, so unfair, so unjust as it is in all Ito aspects, upon-us. Why can we not now do what we , proposed to do in the last Congress? We then voted through the Senate an enabling act, -ailed "the Toombs bill," believed to be just and fair In all its provisions, pronounced to be almost perfect by the Sena tor from New Hampshire, [Mr. Hale,] only he did not like the man, then President of the United States, who would have to make the appointments:— Why can: we not take that bill; and, out of com pliment to tho .President, add to it a clause taken from the Minnesota act, which he thinks should be a general rule, requiring the con, stitu• tion to be submitted to the people, and pass Ural - That unites the party. Yesterday I tusked Colonel Henderson, of Kansas, who was an active member of the Conventlek what it meant. "Why," said he, "It means tblm That there are two entire Constitutions, and the people vote separately for the Constitution with out slavery-411e Constitution the Convention has formed—or the Constitution with slavery." I understood him to say that there were two Constitutions prociettly similar. Mr. DOUCILAS.
