I`lll SITPUIXB COLIST.—The amendment to the Constitution by which our Supreme Court was. made electiire, provided that the fire jedges cleated in 1857 should hold their offices respect ively for 8,6, 9, 12 and 15 years, the terms to be decided by lot ; that each judge thereafter elected should hold his office for 15 years ; that the judge whose term would first expire should be chief justice : and . that if the terms of two judges expired at the same time, they should decide by lot which of the two should be chief justice. The evident intention was to make the terms expire .at intervals of three years, regularly, and that each 'judge should, in that way, be Chief Justice for l ithe last three years of his tern,. The Judges first elected' were Coulter, Lowrie, Gibson, Lewis and Black.] Coulter drew the 15 year term, Lowrie 12, Gibson 9, Lewis 6 and Black 3, so that their terms would expire as fol lows: Black's in 1854; Lewis' in 1857; Gib. son's in 1860 ; Lowrie's m 1863; and Coulter's in 1866. But Judge , Coulter died in 1852, and Judge Woodward was chosen In his place; and Judge Gibson died in 1853, and Judge Knox was electi.d that year to succeed him. Judge Black was re-elected in 1854, but resigned in 1854, and ;Judge 'Thompson succeeds him; Judge Lewis' term also expires this year, and he will be succeeded by Judge Strong. The terms of the Judges, therefore, as the Court will stand after the first ,lionday inDceember, will expire as follows : Judge Lowrie's in 1863; Judge Woodward's in 1867; Jud go Knox's in 1868; and those of Judge Strong and Thompson in 1872. Judge Black was Chief Justice from 1651 to 1854 and Judge Lewis from 1854* to 1857, in regular order; but Judge Lowrie, if he lives, will be Chief Justice for sir years, from 1857 to 1853; Judge Wood wartll for four years, from 1863 to 1867; Judge Knox for one year, from 1867 to 1868; and then Thompson and Strong will hare to toss up for that honor in the ensuing four years, from 1868 to 1872. In the meantime, however, one or all of t*e judges may die or resign before the ex piration of their terms; and in that not unlikely case; the terms will get so mixed that it will re quire the special attention of some State officer to keep the run of them. Instead of an orderly succession, we have a confusion which destroys the purpose originallyin view, and which indi cates either a want of foresight or an inability, on the part of the framer of the amendment, to empress a plain idea in plain words. ru..l.l6l7sTrausx.—The, National Intelligmeer, speaking of the COUTS6 of the gosernment Intrar.ls Gen. Walker, says: • "'The great rigor with which our Government interpreted the obligations of neutrality in the matter of the Enlistment Contremersy between the United States and Great Britain has naturally erected in the eyes of foreign nations a severe standard by which we must consent to be tried on all occasions which involve en infraction, real or supposed, of our municipal laws and of our rsovereign territorial rights." That both of these sanctions have been violated by Gen. Walker in the present' ttance cannot ho doubt ed, if the positions Lau ed by our Government against certain functionaries of Great Britain are still t 6 be taken as the measure of our duty and obligations under this head." Our government, in the British enlistment case, had no fear of offending the South, for the • sympathies of the South were with Russia, and wa r rather to conciliate the south that such a ester]) course was pursued. But in Walker's cane,l the sympathies of the South are the other way. The Slnveholders favor fillibusterism, because it may result en the acquisition of more slave territory; hence the government connived at Walker's escape, suffering the Neutrality laws to be openly violated. One tithe of the activity shown in the British Enlistment case would haVe sufficed toprovent Walker's escape. Public opinion is as ripe to justify : any rebuke of his misdeeds, as it he and his crew were so many Sepoys engaged in open assassination and bru tality. Are they not, indeed, the Sepoys of civilization? Do they not murder the noblest of instincts? Do they not pollute and degrade the most virtuous women? Do they not imbrute and mislead men created in the image of their God? And yet, while all this is so, it will re quire mach deliberation and caution—much boldness and decision—to abate this new evil upon the body politic." The Press does not over-estimate the impor tance of the Utah rebellion, and wo agree with it in the opinion that, "much deliberation and caution" will be required in its management. In the suggestion that the Mormons are the "Sepoys of -civilization" we. trust our cotem porary entertains no thought of submitting them to the dreadful warfare now being carried on in India. The handful of men who are now battling with the climate and the Indians, as well as the Mormons, should be reinforced by the addition of thousands at the earliest possi ble period. As a preliminary stop let the troops now in Kansas be withdrawn from that territory and despatched to the plains. A good military force will bring Brigham Young and his follow ers to their senses, and reinstate our subverted national authority, in a comparatively brief period of time. In this case "delays are dan gerous"—all the difficulties that wo ore now encountering might have been prevented by prompt and decided action on the part of the administration at their first appearance. But the Mormons were forgotten in the anxiety to overcome the freemen of Kansas—and hence Youngs' insolence and the condition of the little army that is sent to oppose him. Now that the Mormons have grown trouble some on our hands, lei us not despise them as an enemy to much as to underrate their strength and resources. Let the administration go to work and prepare to fight them in a manner that will teach these domestic traitors that the government is in earnest, and that it is deter mined to make up for lost time by a resort even at this late day, to decided measures. This course adopted, we have an abiding confidence that the Mormons will be subjugated according to the usages of civilized warfare. The failure on the part of the Buchanan ad administration to raise a large force . , immediately on the reception of the intelligence of the out break in Utah last summer, when the United States officers were subjected to insult and outrage, has emboldened Young and his asso ciates so much as to induce them 16 assume an open and hostile attitude towards the govern. ment. As a specimen of cool presumption, the following extract from his last "proclamation" is without a parraiiel, in the political history of our country: • "The issue which has thus been forced upon US compels us to resort to the great first law of self-preservation, and stand in our own defence —a right guaranteed unto us by the...genius of the institutions of our country, and upon which the government is based. Our duty to ourselves, to our families, requires us not to tamely sub mit to be driven and slain without an attempt to preserve ourselves. Our duty to our country, our holy religion, our God, to freedom and liberty, requires that we should net quietly stand still and see those fetters forging around us, which are calculated to enslave and bring us, in subjec tion to an.unLawful military despotism, such as can only emanate in a country of constitutional law, from usurpation, tyranny and oppression. "Therefore, I Brigham Young, Governer and Superintendent of Indian Attains for the Terri tory of Utah, in the name of the people of the United States, in the Territory of Utah, forbid, First. All armed forces of every description from coming tutu this Territory under any pre tense whatever. Second. That all the forces in said Territory hold themselves in readiness to march at a moment'. notice to repel any and all such invasion. Third.
