:lie Says, that on the night in question, as he

men at the corner of the Penitentiary. After
he had passed them, he heard a whistle, and di
redly after a man came staggerieg towards the
two parties mentioned, with a club of some

and was. followed by the latter nearly across the

continued to aPProach him rabidly, whoa rowel;
drew_ a pistol from his rookie and fired. He
then missed shouted "murder"' two or three
times, end had proseeded but a short distance
when he Met a lamplighter and went with him
into the mardrouse. He state, further that he
did not know that he had shot the man at the
time, and thought that he , was edit pursued, and

nothing farther to defend himself with after his
