The ease of Corn.,ve. J. B. Scott and John
Willa,. police offmers, the first for assault with
intent to kill, and the latter for assault and
battery, upon oath of David Laughlin, was re.
tamed.. The evidence showed that Laughlin and
a man minted Kelley hired a buggy from Mr.
Charles, Allegheny, on a Sunday morning, for
the purpose of going to a funeral; that before
they returned, Mr. Charle s found that they were
on a plealmns exclusion, ant! accordingly stied
them for obtaining goods under false pretences;
Scott, without a warrant (It was in the posses.

til they returned to arrest them; Laughlin re.
fused to ge with him without a wet rant, and ho
.and Scott walked towards North Common; when
they arrived there Laughlin ran off towards the
river; Scott fired a pistol twice, two witnesses
swear they were aimed. at Laughlin, arid one
that it was aimed in the air. Laughlin took
refuge in the house of a Mr. Kennedy, where
ho was found by the defendants, and Wills beat
him on the bead a number of times with a handy
billy, took him undressed and bloody, through
the streets to the 'Mayor's office, where be Ira,
looked up. •
The defence in alarming the jury showed
tionolusively that the warrant ler miedemeinors
was absolutely void on Sanday, and that the
offerers were bound to know that, and conse
quently noted without Color of law whatever.
The Court eo charged the jury. The jurphad
found no verdict at the time of adjournment.
John Magee was arraigned for assoult and
battery upon the oath of Terrence (Wine, taleff•
cd to have been committed on Webster street on
the evening of the 10th of September. The com
plainant bad been to the Democratic Convention,
and after returning in tho evening was talking
of Breekenrildge being a noble eyelike}, Eni.-&a.,
before defendant's door, to a largo crowd. The
defendant ordered him sway and pushed him off
