sault and battery. The defendant was employed
in Adams, Siacklin & Ca,

committed the assault upon the complainant,
Francis Laughlei,•lith an iron pipe, because the
complainant yea whipping defendant's brother.
The Court sentenced thedefendant to pay 61
cents and the costa ot prosecution.
.Tiumb Mower was arraigned on an ladiotment
for larceny upon oath - of henry Sing. The de
fendant was -eharged with stealing two shirts
and two, palm of drawers. The Commonwealth
failed to make out its case, and the jury ren
(lend a verdict of acquittal 'Without leaving their
box.
James abet Rosin Graham was arraigned on
the charge of thing Cowling's Restsinrant, Fed
eral street; Allegheny, on the night of the 10th
of 'April, resulting in the : deatruotion of twelve
or fifteen buildings; Roberts and flwartwselder for
Commonwealth; end Heys and Hampton for
prisoner.
The following witness% were examined.
John Cowlingeiworn—l resided on the 10th of
April last on the .right hand ct Federal street,
adjoining the canal. .On, that night : I left the
keys of my hones with my brother. I keep lan

the chimney was built from the ground up thro'
