following bomb shell at their proottedinge
Tie stated to the Court, premising, that it was
unconstitutional for Congrers to conferjruiltdal
'power upon the State Courts; that It had done
eo In the Aot of 1802; relative to naturalization,
and therefore this , . Court had no right to inter-
alize aliens. He eutunltted the following paper:
the matter of the application in the part
of V. Bonner, im aSen, to become naturalize
under the provisions of the Constitutiont andd
- awl of the United Butes.

Court] and except to the Court here naturalizing
the said Bonner for the reasons following, to

That the power to naturalize by virtue
of the Act of Congress of 1802 is a judicial pow.

"ad. That the third section of the act of Con
greys 0(1802, conferring the power to naturalise
upon State Courts, le unconditional and void.
..4th. That the Court of Quarter Bastions of
Allegheny county, being a 'Rate Court, does not
possesa and therefore cannot exercise the power
of naturalizing aliens."
The Conn said it undoretood that It was- ex
pected by this to decide upon the constitutional
ity of an ad of Congross—to which the Counsel
answered affirmatively. Ills Donor then pro
- ceeded to say that &Court of inforiorjarisdiction
would not presume to decide a question of this
magnitude. Stroh a question should not be
sprang upon the ere of an election. The sa.
prome Court would bo in melon in a week, and
there was the proper place to bring the subject.
Tata Court had carefully 'nulled the act and,
though It might bo entrejadical to eV so, be
lieved it to be constitutional. Inasmuch as
the pinata involved were of etormotus magni
tude; inaemuoh as the Supreme Court met with
in A week, and insomuch=time would not, be
fore the State - election, altlllfor a proper reflec
tion; the Court would refuse to sot upon this
propoeition at present. The Counsel would we
at once that it would be improver for n local
Court of a county to decida upon the constitu
tionality of an act of Congress tinder which
every State has _acted. Chief Justice Tilghman
in deciding that point had said that the Untied
States Courts being so few and far apart, that if
they had the exclusive .right to naturalize, it
would prorent one.balf whose rig h t it was, from

Mr. ilartshornit withdrew the paper. A great

This equate Is bounded by Beaver -at., Locust,
Market Ana Walnut streets. Oa Beaver atreet
there
were Hall & Speer's extensive Plough
Works, Phelps et Cares Coach Shope and Town
sand's large brick store. The hat escaped.
The Plough Shops occupied a large portion of
Locust -et, and a frame building owned and
oe
upied by Mee. Hall was on the corner of Locust
and Market streets; Balm escaped. Oa Market
street were three frame buildings and ono brick:
Two of the frames belonged to Mrs. Hall, and
ware occupied by Luso Stewart, blacksmith for
Ban & Speer, and Swain employed in the Coach
Shop. Widow Dabola occupied the third frame,
which was owned by Cyrus Townsend. The
brick on the corner Of Market and Walnut-sty.,
was owned by the same person, and occupied by
John Dabols. Oa Without Urea, the only lous
es were two frames—one the dwelling home of
Mr. Perkins, Poet • Master, and the other the
Poet Olifire. Those also belonged to Mr. Town
, Send.
The fire originated ea we have otated, in the
Baird story la the moss-room of Phelps, Can dr,
Co's coach shop. The building was a largo
brick one. ' the firm floor was occupied by twelve
or fifteen forges for heavy nag& and wagon
work. Tho second story, with coach-maker's
wood work, and machinery for twisting, foreleg,
getting &c., &a. The third story as a trimming
Fortunately no Sobbed work was left at
the chop, but is Stored in the 'warehouse on St.
Clair Mater Bac there was a very large quan
tity of unfinished work on hand, wheel', spokes,
&a., Ac., part of which was saved in a damaged
condition. The loss of the firm la $ 46 ,000. on
which they but a day or two ago secured Man-
ranee for $lO,OOO In a Philadelphia office. The
betiding was owned by Mr. Cyrus rewneend,
who is not insured, '
Hall & Speer occupied ~ number of buildings.
Pint, a two story pattern shop, filled with a
large quantity of rimy valuable pattern,. Second,
a large one story brick foundry, where there was
a great amount of castings and moulds. Then
there was the engine shop, containleg costly,
maehinerygrindatones, turning-lathes, • new,
and valuable machine for planing iron, screw
mittens, dor Then &large building for sawing
suite a blacksmith shop with twelve forges; e ,
shop for storing castings, of which there' was an,
immense number. And 'finally, several other
storing and paint shops. ,_ Lest Jaly !Messrs I
Hall & Speer had $48,000 worth of finished work
stored there; and since that time a force of 100 I
I Din have been bustle engaged at work, *allot
patio!: of a rise in the river, to fill premptly
their orders. So that the finished stook would
not have been far from $OO,OOO. The buildings
machinery, &0., &a., were worth $20,000 at
the least calculation. A greet many ploughs
were need, bat still their loss is estimated at
not - far from $140,000. On this they have
$14,000 lamming! In the /yet:ming office—hall
upon the building and half upon the stook.— ,
The buildings are totally destroyed.
The two frames on Market street owned by
Mts. Hall were insured. They were totally
destroyed. They were worth about $l6OO.
The frame building belonging to Mr. Town
tend, and occupied by widow Bohol', was worth
about $BOO. No insurance.
The brick building on the corner of Market
and Walnut, occupied by John Dubois was
worth $l6OO. It belonged to Mr. Townsend
and was also uninsured.
The house occupied by Mr. Perkins and the
poet office building were also uninsured. They
ware worth about $BOO. Mr. Townsend's entire I
lees is probably about $BOOO.
The furniture In the dwellings and the letters
and books In the poet. opine were all saved.

And all this loss of money and this distress
has been caused by the devilish propensities of
some unknown person. No calm for the Oa
