GAZETTF.-CITY lari-STMENT PITTS:I3IIRGH: seTinitin idoittigt, 70E, 14,'DICA. Trm Bonn or Liagassas.--The Board, upon itt organisation, yeeterisy, took tOho order s of the day—the remonstrances' spinet certain p. .plicents, founded upon convictions / for selling li quor on Bundey—which the Board had decided wee erdScient proof of immorality. The Chairman, air. Beekine, Bare notice that in some wards and boroughs there was en excess of applications. The Board would hear counsel hereafter to show the wecersity, for Rush h aze s There was an excess in the Vast Mint .. The remonstrances were then: taken up 'Col. fost4lr; orliC Cason lesigtin, ibsting sumieble apneartume4ith two - formblible doikets._ .. . IL fisMplon wish to raise a question of law, and that is, whether one particular act absdi disiredit an applicant; -or two, or three 13iee. seta t .tor.rathether the testimony mud emb the panel reputation, The Canon Le n attacked Mr. Seeley by proving that to 185 , when the Sunday law was not observed, he asconeloted for a violation of it. Suppose this were .in the Quarter Semmes, more than two yessa.bave elapsed, and the charge could not tried. it would be proper to show that at doe notioe the. applicant continued to vb. tat the law, arl , that would show malice. In the cue in 1863, the proclamation of the Mayor wee hated on Friday, and the arrests were made on the following Sunday. The spies were about and those men, were brought in and tried. Seeley Was ,sweated once afterwards, but was acquitted.. ' , CoL-Postes.—The record does not show that. Mr. Hampton—Thal record does show it. Tho Bolted should frown down this fanaticism that Witten to run everything to the extreme. In making the proper discrimination, the Board will not allow itself to be carried away by pri vate opinions. Vol. Pouter knows as a lawyer 'he ought not to offer this in evidence. Cot FoSter.-4115 scarcely necessary to argue this point, ea the Board decided two or three days ago that convictions for violating the Sun day law wee proof of immorality. I pretend to no knowledge of law more than any citizen may acquire whose business as an editor or reporter leads him frequently to the Court room. Mr. Hampton—Why, Colonel, you practised law in California? Col. Foster—That's true, and I made a pretty good thing out of it. dint the authorities are not the same there, and would hardly be received here. [Laughter]. The Board have made their declaims two days ago and though I can not see how — the act of selling liquor before twelve o'clock on Saturday night is not immoral, and selling after that time on Sunday morning s; or how selling to a person 20 years and 11 moulhe old is immoral, and selling to the same person two months later is not, I will not argue the questions. , I now offer the record of Alderman Steele, to support my remonstrance against C. C. Su Mr.d. sy Hampton.—l object to proceeding until the Ward decide the point raised. Mr. Hawkins.—l see. noreason to change the decision of the Board. If you (to Col. Foster) can show that the applicants are in the habit of selling on Sundays, or to minors, we will regard the applicant as immoral. The remonstrance againetliteeleryill be proceeded with, and we will receive the milord In evidenoe. Alderman Steele called and affamed.—These two dockets are records of cases tried and =- tried before me." The general character ut See lers beam in the community as a drinking house is bid. Cross.examined—Havo heard the house talked - •of repeatedly for three• or four years. Have _ heard of a shooting affair in his house. Have heard of his house chiefly through police °Meets, but also through others, who called to make in formation against Seeley for selling too much liquor to their friends. By the Board—Have beard of a back alley leading to Seeley's house, in connection with selling liquor on Sunday. Never heard of women going in that way. CoL Foster thee read in evidence the record of Seeley's conviction fbr selling liquor on Sunday the 17th of July, 1858. Alderman Steele was called by Mr. Hampton. —Jonas W. Horner was the complainant. He was one of the Mayor's pollee. It was reported that Horner want around to liquor sellers and induced them to sell liquor to him on Sondem In order to earn half the penalty. Joe. Justice was the witness in the cue. Seeley was after wards brought before me. A watch was put around his house, and those who were going in and out were subpoenaed; it was a trap of the Captain to catch the officers. The remonstrance against Abrabamareenwood ..was taken up. Mr. Fosterread the record of Alderman Steele showing that the applicant was convicted of sell ing liquor on Sunday, the 4th of February, 1855. Mr. John Mellen said that applicant had gone to the country, and that his assistant sold liquor to a sick man, and David Dodds, the latter of whom divided his fees with a lawyer to bring sail. Alderman Steele way called by Mr. Mellon, and stated that the above wee the defence made at the time of the trial. Have baud from po lice officers that applicant kept a hard house. By the Board—Can't state any particrulars against applicant--;appose the general charge originated from the chasten of the people go ing there. John Flynn testified that he and applicant went out to the canary on the 4th of February, 1866. Never saw any liquor eel& theta on Sun days. Have UM dominoes played for a ;lase of liquor, or ale, or cigars within eix months. The remonstrance against the application of Henry Tierheller was taken up. The applicant, a German, appeared for himself. Col. Foster read the record of Alderman Steele against applicant. The date was Sunday, the 6th-day of August, 1863. The applicant afterwards engaged Mr. Stew art, who proceeded to make a lengthy speech on the present and put laws. - The - remonstrance against the application of James Shannon was the next one called up. Mr. Foster prodaced the record of his convict• tion before Alderman Steele, for selling liquor on Sunday. Date 6th September, 1863. Mr. T. B. Hamilton counsel for the applicant used that this charge was founded upon the feat that late on the Sunday-night referred to a sick passenger by the railroad woe tarnished with a glass of liquor, free of charge, when the Infor mant rushed in, seized the bottle, took a drink, and then drew his money. The remonstrance against the application of Alexander -Vapplee, wee the next in order, and the last case. The record of Coppice' convict- Con before - Alderman Steele, of selling liquor on Sunday, the 6th of November, 1858, wu offered. Alarm= Steele testified that the applicant's character was good, and his house, (kept on the bank of the river) was ordetly. Mr. Foster said he bad nothing against Mr. Capplu, except this one cue; he believed him to be as worthy a man es was in the business.
