Mr. Loomis, yesterday filed answer, Judge
Shale, and A. Earke,'Esq , appearing in his be
half. G. P. natal:ton, Esq., appeared for the
petitioner.
It was contended tbat the Omni had no juris
diction in the case, as' ie money of the estate
was safe, time ball cairns being good for it, and
tbat'that the money was given Loomis to be re
paid at a certain time, wino!' time had not yet
arrived.
The following is a condensed statement of the
newer refereed to above:
' That Alexander Cairns died, and that Stephen
Ca!repacked respondent to take the funds and
give a receipt therefor, ache did in the case of
Moses Marsden, decd, retaining the money until
taken out by parties In pursuance of the order
of Orphans Court.
Ha gave receipt ; and received $7068 76 drawn
front the Bank of Pittsburgh. This wu the
whole arrangement The respondent also alleges
that he has his arrangements made with a view
to meet his engagement, when the same shall
mature, and bee not a doubt of his ability to
meet Ma letilitier when a decree of the Court
abaft indestis the parties to whom the monies are
to be paid. He decries that Stephen Cairns cal
led on him twenty days after August the 10th,
1868, to pay these mottles into Court, and the
first time was in either September or October
laserlien the respondent was recovering from
no attack orCbolera. Then respondent told
him he wseld'tsve the accounts made out, dis
tribution ordered, and that when thi was done,
the monies ebould be fortkooming.
The respondent also says that from the first of
July to September, he tottered ender a violent
attack of brain (over. Tam Jaya after his recov
ery, he was taken with cholera. In early No
vember, carious Illness in -hie family kept him at
home for two weeks. Respondent was again ta
ken with the scarlet -fever, and as soon after
warda ea' possible bad the account of Cairns
made out, and heeded It to him with the vouch
ers as before stated.
O. P. Hamilton appeared for the peti
tioner, Stephen Cairns, sad charged that Loom
!a had violated his profeasioual oath. Under
what authority did .he step. in as mediator
between the adtnialstrator and the legatees.—
Be held that the mane, w ho Loomis' pones
don merely as counsel far the administrator, and
he bad no right to fir a time himself when it
should be paid back. Relied these trust foods,
without interest or security, and raises to give
either, or yield. up the money until the estate .
was settled up;

Tam.—Two little girls were muted yeater
day for.the larceny of Sid from the mother of
one of them, and taken before Alderman Major.
It waeilisioured there that the daughter was
the thief, andthe mother therefore withdrew the
charge. Darin the examination it wu elicited
that these girls upported themeelva by theft
and prostitution. .They were committed to jail
for further hearty& .
