Judge McLean. At the time that the speech
was delivered, the friends of Judge McLean
felt that groat injustice had been done by Gen.
Cass' interpretation of Judge MoLcan'e article.

There is no speellio power given to-Congress,
in the Constitution, which authorises the estab
lishment of a Territorial Government, except
that which relates to the District of Columbia.
The Ordinance "for the government of the ter
ritory of the United States northwest of the river
Ohio" was approved 7th August, 1787, which
was before the formation of the Constitution of
the United States.. .That ordinasie provided for
the first and second grades of Territorial Gov
ernment, which extended over that territory that
Include the present States of Ohio, Indiana, Illi
nois and Michigan. Separate. Territorial Got
ertiments were formed under the ordinance, as
the progress of population required. This pro-.,
vides for the government of all the territory
ceded to the Union at the adoption of the Con
stitution; and this fact may have been supposed
to render any provision on the subject in the
Constitution unnecessary. On the 7th August,
1787, the ordinance wee modified by en act of
Congress, so as to adapt it to the Constitution.
On the 25th February, 1790, North Carolina
ceded to the Union territory which now consti
tutes the State of Tennessee, whichwas accepted
by sot of Congress on the 2d of April ensuing,
In the act of cession, among other previsions, it
vas stipplated "that no regulation made. or to
be made by Congress shall tend to emancipate
eleves;" and on the 26th May, 1790, by the act
of Congress, the ordinance of 1787, with certain
exceptions in the act of cession, was adopted "for !
the government of the territory of the United
States south of the river Ohio.'
The first annexation of foreign territory to the
Unified States was Louisiana, within which els- •
very existed under the French and Spanish Gov
ernments. Florida which was subsequently an
nexed, was also a slave territory. Texas wee a •

Under the Articles of Confederation there was =Valetta
a provision.for the return of fugitives from jus
tice, but none in regard to absconding slaves.
There was, therefore, no obligation on a free
State, unless imposed by its own law, to deliver
hp a slave; nor was , there any legal means
through which the master could claim the feet- .
tire. The inconvenience and collision which
frequently arose from this State of things led to
the abeive provision in the Constitution.
The power to institute slavery belongs exclu
sively to the community in which It exists. In
i the language of Chief Justice TAxer, in Groves
vs. Slaughter; 18 Peters, 508, a State "Ims a
I right to decide for itself whether it will or will
not admit slaves to be brought within its limits
from another State ' either for sale or for any
other purpose; and also to prescribe the manner
and mode In which they may be introduced, and
to determine their condition and treatment; and
this action esnnot be controlled by Congress,
either by virtue of its power to regulate com
merce, or by virtue of any other power conferred
by the Constitution of the United States."
And in the case of Prigg vs. the Common.
wealth of Pennsylvania, 16 Peters, 611, the
Supreme Court ally: "The elate of slavery is
deemed to be a mere mtmicipalregolatiou. foun
ded upon and limited to the range of the terri
torial laws;" and "its manifest from this eon
sideration,Lhet, if the Constitution had not con
tained the clause for reception, every non-sieve
holding State in the Union would have been at
liberty to have declared free all runaway slaves
coming within its limits., and to have given them
entire immunity and protection against the claims
of their masters."
The true construction of the Constitution is,
that implied powers can only be exercised in can
into effect s 'pacific paver. And this ap
plication is limited to such measures as shell be
appropriate tolthe object. This is an admitted
and safe rule of construction._ It is believed to
be the'enly one which has been sanctioned by
statesmen end jurists. Powers exercised beyond
this are not derived from the Constitutiou, but
must depend upon an unlimited discretion. And
this is despotism. -
Row, there is no specific power in the Consti
tution which authorises the organization of a
Territorial Government. Snot' a power was
given in relation to the District of Col=bis, and
it was equally necessary in regard to other Ter
ritories. But if this power be implied from the
specific power given to regulate the disposition
of the public! lands. It must, under the above
rule, be limited to means suitable to the end in
view: If Congress,go beyond this in the organ-

archy. Admit that they may organise , a Govern
ment which shall protect the lands purchased
and provide for the administsation of justice
among the settlers, it does by no means follow
that they may establish slavery. Thie is a rela

sovereignty. It is a municipal regulation of
limited origin. It is a demesne relation Da the
stams,3* over which the Federal Government

institution of literary is not within any implica
tion which can be drawn from the power to reg
ulate and dispose of the public lands or other
property of the United States. As hefore re
teethed, slaves are not treated in the Constitu
tion as property. They are made property by
the law.
The Supreme Court ofthe United States have
decided that, under the power to regulate com
merce among the Stela", Congress could not in
terfere with the slave trade between, the Eitetes.
