'ln the matter of the application of William
Magill, late Sheriff of AlleViegy County, to the
Court of Quarter Sualons, in account with the
County Commiaatoncre::
The application is based upon an Aet of As
sembly approved May Sib, 11358. Pamphlet
tow, 1854 page 620; orldelt Lee follows
Sac. I: ...That from and after the postmen(
this bit, it shall be the duty of the Court of
Quarter Sessions, of Allegheny County, to Si
and settle upon the amount that shall be allowed
sad paid by the County Commissioners, to the
Sheriff, for the per diem support of each prison
er, who has or may bo in the raid jail, and said
- allowance shall be paid by the sold Commission-

The daily allowance for, the import of prier
oners now, and for thirty-two years past hoe
been-
1. Far vagrants, tea tents a day, for each
2. For Court prisoners,. fifteen cents a day
for each Court prisoner.
The petitioner sits forth the unprecedented
high prise of flour, and of the necessaries of life
daring a portion of the time he was In office,
and site the Court to fl:, as may be just and
proper, the daily support of eaoh.prisoner who
has been In Jail from the commencement of ids
term of office. The facts set forth in hie petition
are true to the letter.
The rate insisted on by the Sherlff s s comsat is
fifteen seats per day for each vagrant, and
twenty cents a day for each Court prisoner.
This the County Commissioners resist.
The case bas been argued during a portion of
two days, And the decision of the court involves
the consideration of a multitude of items, facts
and reasons, which, owing to the number of
them; cannot be alluded to or specified without
making this decision of impracticable length.
- Upon examination of varlou Acts of Assem
bly, Auditor's reports, and other documents of
a public nature, and from what appears in the
case [WU, I think the Court is warranted in
making the following inferences :
"The Sheriff is entitled to compensation for the
support of prisoners.
This compensation for prisoners has hereto
fore beenasource of great profit to the Sheriffs
of Allegheny county.
- It does 'not appear that by the high pries of
flour the Sderiffit eases have beau prier ; but
only that his profit* Aare been
,less.
The law contemplates compensation not profit.
It devolves upon the complainant to satisfy
the Court that the per diem allowed vas nude.
quote. . Each member of this Court, after fre
quent and careful deliberations, is of opinion,
that It was adequate, end that sufficient cause
has not been shown why the rates of allowance
which have prevailed for thirty years should be
disturbed at this time. The ;act of assembly un
der which this decision le made embracer the
put, present, and the future. This Court will
at any time, hereafter, interpose and save,
and protect the sheriff from actual loss, on the
item of subsistence. But this interposition will
doubtlese never be called upon, as it is preen
, med the County Commissioners will allow what

The meant Board of Commissioners are will
ing to pay ten cents per day for the support of
vagrants, and fifteen cents,! pe r day for Court
prisoners, and oa this we are constrained to be
lieve they are "prudent and right."
The petition is dismissed, and in obedience to
the Act of Assembly of May Bth, 1855, the
Court of Quarter Sessions of Allegheny County
fixes and settles the per diem support of jail
prisoners, as follows :
Ten cents a day allowed for vagrants, and fif
teen cents a day for court prisoners ; until the
time of the expiration of the office of the petl

And the same allowance, la made from that
time until now ; and the same rate to continue
and remain, hereafter, until good cam be
shown to the contrary, whin the allowance shah
