ease was.tiken op on Thursday morning, It B.
Roberts, Esq appearing for the Commonwealth
and Col. B. W. Mack for the defendant.. The
indictment contains. two Counts, the lint for le
suit and tattitry•-, and the mond for assault and
battery with intend to''. kill. -The Court Room
was crowded with spectators during the trial.
As we have already published full details of
the whole occurrence, we deem it unnecessary
to report the evidence in full.

The first witness for th e Commonwealth was

for uttering and piblishing this, alleged forged
do - anent, one for forging a contract on the 16th
day of June, 1863; between HeCorkle and the
defendant for the sale Af • piece of land In
Washington • county purporting...to-berm, been
medrid 1846; and one, for uttering and pub
lishing this alleged forged contend. „
In 1846, Mr. . Mellon prooeided to remark,
MoCaride lived in Washington county where he
owned farm consisting of over: two hundred
acres, on which judgments bad been entered up
far $8000: A large number of these judgments
ware. owned by Thomas: - He prevailed upon
McOorkle to purchase from him • house and lot
which were located inaligo,for durum of $2OOO,
giving therefor *judgment bond firoviding that
it should not be entered. on, as ideCorkle would
- sett his two and pay off all his indebtedness.
The bond was entered up. In July, hire. Mo-
Oorkle went to Weshington to sell the fum and
--ihere rewind, an offer of $5,600. • When the
books 'were examined, it. was found that there
werejedgmente for $6OOO against the place, and
the offer was themefore withdrawn. Thomas, the
defendant, hid entered
_up the judgment bond
for $2OOO. .
Mr. Thomas proposed to Mr. Cable, in :the
saw month, to purchase the farm, pay off all
the judgments, including that for the house in
Sligo. Mr. hfoCorlde accepted the proposal,
and accordingly an agreement wasentered Into,
datedthe Ilth of July, 1845. This article was
left in the hands of Mr. Hanger, Mr. Thomas'
agent, who bad drawn it up. aloCorkle had no
, eon' of it furnished him, but he afterwards
took At copy himself; which was null and of no
'l*use in a civil suit as it had no signatures. The
orightil article was dared July 11th and was the
only bargain ever entered Into between the par.
