zen of unblemished character—holding, per

spectabla in every relation in life--is put in jail
without trial, by an arbitrary decree of a
Judge, having, as vs have shown, no earthly
jurisdiction,. for no .moral wrong, but 'lie for a
oontempe'—"an illusory return"—and when be
appeals, not in person, for the forms of law
preverit hie looking either his accuser or his
Judges in the face, but by counsel, for a ohm*
to test the power that confines him, he is denied
this poor privilege, and has his sorrows &gam
, rated by finding himself recorded and published
as the tit associates of 1810 m—dippers of coin—
purloins= of "letters, smugglers; and others of
Judge Bane's natural enemies," or the state
criminals who Judge Black fancies areispecially
leagued against the Supreme Court, and who,

enjoyments at. Philadelphia. Surelysuch a rea
son for refusing a habeas corpus never before

the Chief Justice on another occasion, "Were It

we would say • that It is perfectly ridiculous."
And to all this, let it be remembered, there was
no dissent accept Judge liztoz'& Mr. Justice
Lowrie spoke of having left hie opinion at home,
and the Chief Jose= said the_ other Judges
might have something to suggest hereafter, but
this was all.

"Judge Kane. say the Court, decides Jurisdic4
tion by assuming it.. Thus assuming it he de
cides contempt, and behind the decision of con
tempt no power on earth can go or look. There
is no rescue, no restoration—worse than all, no
limitation. Mr. Williamson may, those, Judge •
Bleak's rather Hibernian illustration. carry the
' key of his. prison in his own pocket, but outside
the look and across the grate is the stern and
unyielding bar-the-conclusive bolt of Judge
Kane's commitment for contempt. No one but
.he can drswit aside. Let It be borne in mind
by all who think on this question—at home and
at a distance,laymen and lawyers—that the intri
cacy of reasoning—n sort of circular, argumen
tation—tying jurisdiction to contempt, sod con
tempt to jurisdiction—the snake as the
ancient symbol, swallowing his own tail—all this
is on one side. On the other is the simple pro
position which pages of illustration cannot male
more olear, and which rhetoric, good or bad,.
would only obscure, that no man can for one
day or hour be held by the judgment 0f.,. Coate ,
