    Comer or Quesrradlthastows.--Before Judges
Merlins, Boggs, and Adams.
The case of Com. vs. M'Mini, indicted
for the larceny of tiller - aid plated ware .from
the Bt: ClairHoteloras resumed yesterday morn
ing, and the testimony closed about 11 o'clock.—
There was considerable disparity manifesteirin
the evidence;—Mr. Bennett, proprietor of the
hotel, and employer of M'SHms, stated that for
a period of more than eighteen months he had
_missed articles of table ware, and had reasons
antipect the defendant in this casP l while the
latter produces a recommendation from Mr. Seri
nett, written in I March het, in. which
"and given
hint credit for having been "industrious at
tentive to his tiredness." Mr. Fegby swore that
brought to him forty-two spoons and
forks, all of which were marked "Exchange no
te'," except seven; which were
.stamped "City
Hotel; - ' while he testified before All Steel, where
the information was made, that the spoons and
forks were marked Itichange Hotel, New York,"
except the raven, which bad the homes °Carr &
Glass." Fegby also testified that on a certain
Sabbath day he went to M'Minn's eating cellar,
(in company with 31r. Armstrong,) on the cor
ner of Penn and St. Clair streets, at the request
of M'Slitin, to seesome silver spoons and forks
which he wished teshaye his name engraved on—
that' when there 3P3linn raised a plank in the
floor and took out a vessel containing the articles
—while officer Wrigley, who had been sent to
examine the floor, said it was made of ploughed
and groored bear ds. Aaron Stockton, stew
ard at St. Clair Hotel, more he wes in the em
ploy of Bennett at the same time with Inlinn,
and that nothing was stolen dui log his stay there;
that the articles were counted daily, and were
locked up in the safe when not in use; that no
servant could get any article without a check,
and If lost he was charged with it; that the ar
ticles were enumerated in November last, and
nothing loped to be Missing, save one silver spoon
belonging to a boarder. 'Air. Bennett swore that
when the search warrant was issued he accom

end saw tumblers and wineglasses that belong
to him, and did not bring them nvrxy becau.n

the search-warrant AS the property of Bennett;
the pedestal of the bowl had been broken, and
Mr. Bennett swore that it was mended at his ex- r
pense, and afterwards stolen by 31'Minni while
Francis Lynch testified that be lived at the St.
Clair Hotel in 1858, and saw Mrs. Bennett pre
sent
the said bowl to 31'111inn, while he was about
throwing it into the general receptacle for Ins
ken glass, remarking to him that it was too good
to throw away, as it could be easily mended.—
Other glaring discrepancies were exhibited, and
thoroughly sifted by the able - counsel on both I
sides. The evidence was closed about 11 o'clock,
and the argument for the prosecution was then
opened by W. W. 'lrwin, Esq., who was bil
lowed by Messrs. Flanegin and McCandless for
.the defence., The latter gentleman made a pow
'arid address •to the jury—and handled Mr.
Feyley the principal witness for the Common
wealth, without gloves. He remarked that his
client had been pursued /With a hyena ferocity,
for the purpose of Saving from the penitentiary
the .perpetrators of- one of the most diabolical
outrages ever committed—namely, the robbery
of McMinn, by Link, McDonald and Carwille.
There , was no doubt in his mind that the pre.
sent prosecutiortwaa 'a malicious one,and brought
to operate in favor of the watchmen above named.
In regard to the interview between Feghy and I
Mellitus, on the 15th of November last, in I
whith the latter is said to have expressed sor
row at the conviction of the watchmen, and can- '
didly acknowledged that he was mistaken as
to the loss of the money said to have been ate
' len by thenr—the learned gentleman remarked
that it was one of the many modern refinements
to avoid perjury, to get McMinn to say that
be had not lost the money, as the watchmen and !
their friends would refund it, arid of course he r
could .not say that be bad lost that which was
in his possession. There was not the slightest
doubt In his mind that this. was the way in which
tithe: poor, simple, Igoe - rein Irishman was in-1
veigted into this admission.
Mr. Hatch closed on the part of the prosecu- . ,
, tion ; after which Zitdge McClure delivered an
able and impartial charge to the jury. He cony
eluded by remarking that were it not for the
whelesale evidence of Mr. Feghy, the Cowman
wealth had utterly failed to make out a case—
had the jury were the judges as to the validity
of his testimony. .
The jury retired .nt a few minutes after five
o'clock,' with permission to seal their verdict.

without outside help, the managers kW* called
(without any authority) a - "Whig" meeting for
this afternoon, at which they expect to be able
to 144 f -in nomination. It will then appear in
the Jacit and Dilpatch of Monday as the reg
ular Whig ticket.. AO there is no one in the Ward
grew?' enough to bc fooled bo this transparent
ticket, a simple exposure is all that is necessary.
