Common Council on Tuesday, we stated that a
resolution had .passed that body which! was.

Councils at which the resolution passed; we heard
the amendment offered, nod, though we Were
preserd until Councils adjourned, We heard no
thing about its being withdrawn until yesterday.
We regret that the error Omuta hare occurred
in our report; hot it was wholly unintentiarial.
and may be attributed to the confusion that ex
isted r when theresolcition passed, which, we
presume, prevented our hearing Mr. Sweitrer
withdraw his amendment. In no other way Chu
we account for the mistake.

His honor dwelt at g eat length upon the law
bearing on the case. and look onusualsains to
explain it in all its phases to the jury. lie then
reviewed the evidence, and pointed out the dif
ference between circumstantial and positive tes
timony, showing wherein the former might be
applied to the case. The charge occupied about
half an hour in its delivery, and *As one of the
ablest and clearest discourses of the kind ever
delivered to a jury from the bench of our Crimi
nal Court. •.
I'Se jury retired, and after an alisence- of some
twenty minuted returned into Court with a ver
dict pf "GCILTY, in manner and form indicted,'
against Link, and "guilty of aiding and abet
ting the larceny," against Camille
-The court refused to receive the verdict is Ibis
form, and. the jury, without leaving the box,
renderedi verdict of guilty against all the pris

Mr. Marshall, Cnrville's counsel; Asked that

The trial commenced on 'Tuesday Morning,
and ended a little before noon un'Thureday. It
excited treat intermt, and the court romp wee
crowded from the time it begun until it ended.

battery on M. Irwin. The portion reside in Law

charge of larceny preferred against them by a

they stand charged was perpetrated under quite
t novel circumstances. The defendants it appears
j were arrested for some pottr infringement of
the law and placed in a cell at the Mayor's office
occupied by another tenrnt, whose name we
1 could not learn, and while there, stole some $9llO
in money from their companion.
