The witness, was cross examined at length, but his street testimony was not shaken. The Counsel for the defence ob jected to the admission of dipapers as evidence, and cited fevers! au t horities in support of his exceptions. The t Distriet'At Attorney replied, and ;the Court, after a Mort delibe ation, decided that I\ so much of the confession as, admitted the guilt of the prisoners might go to thejury. That por tion of the confession in which one prisoner charged the other with the offence, the jury should take no notice of. ), Cot McCandless, on behalf pf George, offered another objection to the admissfon of Skyles' confession. lie said that the prisoner had been convicted and sent to the Penitentiary for grand larceny, and that under these circumstances his testimony could not be entertained in a Court of justice. The gentleman offered to produce the record of this Court to mabstantiate his asser tions. but the Court overuled the objection, and the papers were both read to the jury. J.
