The following is one of the principal points in
the message : .
uAre ire not too prone to forget that the Federal
Union is : created of the States, not they of tho
Federal Union. - We irere the inhabitants of col
onies distinct in the heal government, one from
the other before the Revolution. By thit revo
lution the colonies became an independent state;
they achieved an independence and securid Its
recognition by the agency of a consulting body,
which, from being an assembly of minhters of
distinct sovereignties instructed agree to no
form of government which did not leave the do
mestic concerns of each State to itself, it woe an
pro p 'ately denominated, a Congress: When
having tried the experiment of the confederation
they resolved to change that for. the present
Federal Union, and thus to etnfor on the Pell
etal governieent meta ample authority, they
scrupulously measured such of the functions of
their cherished sovereignty as they chose to
delegate to the general government. With this
aim and to this end the Fathers of the:Republic
(ruled the Constitution, - and by which the inde
pendent and sovereign States united themselves
for certain purposes and for those Only leaving
all powers not therein set forth as Conferred, as
one or another of the three great- departments,
the legislative, the exeautive, and the judicial,
indubitably with the States. ,
-When the people et :the several States had in
their State Conventions given effect and force
to the Constitution, not content with any doubt
which should in future arise as to the scope and
character of this act, they engrafted thereon the
explicit declaration that, the powers not delega
ted to the. United States by the Constitution, nor
prohibited to the States, are reserved to the States
respectively or to the people. Can it be contro
verted that the great mass of the business 'of
gcvemment that is involved in severatrelations
the internal arrangements. of the body politic,
the mental and-moral culture of man, the devel
opment of local resources of wealth, the punish
ment of crimes in general, the preservation of
order, the relief of the needy or otherw - he enter
innate members of society, did in practice re
main with the States, that none of these objects
of local concern are by the constitution expects
ly prohibited to the States and that none of tht m
are by any exprecs language of the Constitution
transferred to the United States.
Can it be claimed that any of these functions
of local sabnicistration and legislation are seated
in the Federal Gorernmeot by any implication

one of the plummeted powers touches the sub• .
ject, nor has Men a remote axiology to it. - The
powers conferred upon the 11. S. have. reference
to federal relations or the menus of accomplishing

the powers granted and the powers restricted
were so granted or so restricted only where it
was requisite for the maintenance of peace and
harmony between the States or for the purpose ,
of protecting tbeircommon interests and defend
ing their common sovereignty against aggression
from abroad or insurrection at home."

amended to reed to every white male above 20
years of age, who has declared his intention to
become a citizen, and who is now a resident of

shall remove to and settle in said Territory, and
continue to reside therein, shall be donated 160
acres of land, on condition of actual settlement.

that the benefits of the act shall not be extended

CINCINNATI, May 4.--John J. Crittenden is suf
ferink, severely in public estimation in conse
quenceNf his volunteering to defend the Wards,
awl a public meeting in Madison, Ind., yesterday
passed the following resolution with only two
dissenting.votes: •
Resolved, That this meeting request the Board
of Directors of the Jefferson County ismicultn
ral Fair to withdraw their imitation to Governor
Crittenden to deliver the address at the next an
nual Fair of Jefferson county, the action of Gov.
Crittenden in the Ward cane, having voltinteered
his services in 'that cue, and prostituted his
great talents in an unworthy cause, viz : the
overriding of public justice, which tag occurred
since the invitation wee given; being deemed a
entScient eiense, if one is necessary, for this
public withdrawal of that invitation.
The Kentucky papers are tilled vith,the pro
ceedings of public meetings' in that State, by
'every one of which Crittenden is denounced, and
requested to resign his seat in the united States
Senate. - -
The Ward family have left : Louisville, and the
whereabouts of the murderer is unknown.
