TUB CONSPIRACY CAsEet.
At the usual hour the Court was opened, on
Saturday, arid the trial of the defendants re
, Mr. Stokes took np the tire's& of his env
'meat by s recapitulation of the points made by
him on the day previoualy. He replied to Use
attacks of the opposite counsel upon the zeal
zuentrested by Mr. Hampton in thin case, and
paid that gentleman a glowing and merited trib
ute for his, ability and assiduity. He deserved
and would receive the thankf of every honest
citizen for.his course in this trial. After some
remarks relative to the Pennsylvania Railroad,
he proceeded to the law in the ease, which he
considered'consideredmmypa i n and simple. He cited a
number of authorities.
' The defence denied the extortion._ It was ex
tortion to demand that to which there was no claim.
The informations were not ma& until December
and the defoodewth were consequently nut.in
formers until that time. What right hail they
then to claim the 48800 front Magotfin on the
22d November. What else was it but extortion.
The spealter alloded In seething terms to the
law Preseriers who combine in Ohio and pollute
the soil of this State to carry their unhallowed
purposes into execution. They were common
,infanners, than .which no name was more de
grading. It stunk in the weevils et' all honest
• men, its bearers were shunned and, hated.—
It was redolent of shame and degradation. The
_common infernier betrayed everything—honor,
the common dictates of humanity, family, friends
—merely for private, corrupt gain. Worse than
English spies and Irish informers, for they nev
er worked in combination. Ile closed with a
-
very beautiful peroration.
we.,have newer heard any speech in Court
more brilliant, eloquent and convincing. A
breathless silence prevailed' during the delivery,
which lasted on Friday evening =and Saturday
morning for over four hours.
• • - Judge M'Clure then read hie charge to the ju
embracing his decision upon the points pre
' vented by the defendants and by the common
wealth. -
We published the points of the defendants in
Saturday's paper, and we therefore at present,
!damply refer to them.
The principles of the Ist and 2cl points were
affirmed by the Court.
Thee thirdpoint was negatieed, which took the
position that the jury , cannot find the the defen
dants guilty, if the ordinary business of the
Bank was_to pay out the small notes.

The Court negatleed the seventh point on the
same ground:as the fourth. -
On the Bth point, Judge ATClure charged that
• extortion is, a etparate and wide offence. Its
legal definition is an unlawfhl taking of money

er, hi not charged here.' The, word bad -a
larger anise—oppression - under corer of right.
He would leave to the jury, under all the testi
.Mony; if they believed there was a conspiracy,
whether there was in any part otit an intention
to Ciao! (extortion, from ez out of, and soreness, to
twist,) money from the 13ack. The word in the
indictment'was used in its general siguification.
On the 9th point, the Court charged that to
sue for a penalty was no offence; nor drawing of
uneven checks, of - itself, either; but the jury
were:to decide whether or not the' checks were
• drawn to Induce the corporation to violate the
es,lave, and whether the procurement was not an
l'Overt act of the conspiracy. .
10th. If the facts warrant the proposition that
the. county had. .an inchoate right in the
'•-le penalties, the defendants hadno tight to destroy
each interest by offering to burn the notes. The
Commissioners swear they never authorized the
_ 'suits to be compromised.
On the Ilth point the Court charged that if
-• • the' aiety bed no interest In the penalties, the
defendants had none. The penalty, the right
and the came, were one and individual.
The 12th point was decided affirmatively. If
the banks ware in the habit of violating the law;
that la of course powerful evidence of it being
W .the customary business. It is very probable,
• and doubtless all would admit that every bank
— and banker In the city had violated the law, but
41 they are , not on triaL •Itis a matter of no im
' Patine's now, except, by showing the usual cus
tom, it might go to the point whether the - defers
dents are innocent or guilty.
The. Banks are the creatures of the laws , were
they on .trial, they should be dealtorlth accord
ing to the law and testimony.
The Court 'could not charge affirmatively on
• the 13th point. The jury are the judges of evi
• - deem, and they will or net say whether there.
aras,eonnection between Davis, at Wellsville, and
, Haien. They will recollect that it was testified
by Galway and Scott they had gone to Wells
ville to compromise, at the request of Hazen,
who urged the measure for fear of incurring a
criminal Indlitment here; 81111 they will recall
what passed between Davie and Hazen there.
As regards the 14th points, His Honor would
say there was much evidence. He could not say
• there was no evidence; he would commit an er
ror. The Court was constrained to charge the
Jury thertrwas evidence, and:they will bear In
mind some of the rules referred to by counsel;
that after an unlawful agreement la established
by proof, the sets of one binds all, in pursuance
thereof, whether here or at Wellsrille, or any
place else; before confederatienu are established,
• however, the act of one affects only himself.
On the 16th point, the Court said that the ,
whole evidence must be considered and applied
to all the Courts. If the feet is as the defame
allege, the Court would charge affirmatively.
As regards tke 16th point, the 'Court charged
that the Puy must be 'stinted before' convicting
on any count, that the evidence warrants it; the
proof under each count must, be full and corn
pieta in itself.
In regard to the 17th point, if there were but
two comae, and Jones was one and Holmes the
other, the iedietment mast MI. Bat there are
• ten, and the jury will remember;what the wit
nem Stewart said of Lawson; that there was to
be an executioa of a general stupendous design
and speculation: they were going to set the mill
grinding and that all.the banks and bankers but
• two should stiffer. The jury will remember that
•
`.Hazen mid that it had been decided in grand
council, so and so. Take the evidence of all up
on any gives point or given count; take all that
went before and ell that follows, and find guilty
or not guilty en these comities theLearidence may
'lead you to decide.

1. That the penalty named In the General
Banking Law, is given by the 48th section, to
r. the informer," and that as neither Hazen or
Davie _were Informers, neither had any right
of action againet Alegoffin, or the Fanners' De
" posit Bank, at the time they offered to release
from all liability on the payment of $ll5OO, and
there being no just or legal claim, if they at,
tempted to extort moneyrit was an act which
- may be considered by the jury, with the other
acts proved in evidence, to show • corrupt apse
' meat by the unlawful means of a pretended
claim to extort money from thesaid Mageffita and
the said Bank, and thus the defendants, if the
jury believe the Ewe, may be convicted on the
Bd, 4th, sth, and 6th counts of the indictment.
The Conn 'charged that if the jurT believed
these facts, they would lead to a conviction un
der those counts. -
2. Teat as the penalty Is to ^ the informer," ^
and there is no informer mill, informstien is
made, by bringing suit for the penalty mimed in
- the act of April 16th, 1850, there was no claim
'known to the law, nor .any vested right to the
said penalty, in anyone known to the law, when
awn and:Davis, before snit was brought, at
- tooted, by threats, to extort $B6OO l from Ma
- softy and the Farmer' DePosit Bank; and, if

The Court said the facts were for the jury; If
they belieied them, the would lead to scon
viction under the 3d, 4th, , sth and 6th counts.

The_ Judge would charge affirmatively, pro

crime agreement, in the opinion of the jary f

5. The criterion of pull, (if the agreement be
proud) ,is the. intention of the parties. If it
was fair and honest,they cannot be convicted.
If, on the other band, the agreement was unfair,
dishonest, meant for the unjust gain of the par
ties, and calculated rather to prejudice the Com
munity; or to bring nay number of citizens un
fairly under the power of the parties, the offence
of conspiracy is complete, and there should be a
conviction.
The Court charged affirmatively.
0. A n t if the jury believe that the defendants
conspired together that any of their number
.should, for the purpose of gain, and not in any
- iirdinary business way; open an account with the
-Fanners' Deposit Bank, and after having procur
ed the email net= to be passed, began-proceed
-legs for theunlawful Pupas° of getting money
alone, and not for any public good, or any fair
or legitimate object, then the defendants are
guilty . of a conspiracy.
The Judge charged affirmatively, with the
qualification that such conduct wan an overt act,
and had been done in pursuance of a conspiracy.
7. If the jury believe that Dayis opened an =-
coma in the Farmers' Deposit Bank by agree
ment with-the other defendants, for the purpose
of so drawing his checks and managing his . in,
tercourse as to induce Johillagoifin, the enabler
of said bank, to pay out foreign bank notes Of
lose denomination than fire dollars, and therebY
subject himself to indictment, under the 49th
section of the general banking law, such agree . -
ment ;is a conspiracy to induce the commission
of an indictable offence by said cashier, and in
volves: a conviction under the sth, let and 2nd
counts of the indictment, it being a conspiracy,
The Judge charged affirmatively.
The Bth point was in reference to the Holmes
count, and the Court decided the evidence under
it might show a link in the conspiracy.
At this point the defence protested against the
pointa of the Commonwealth, on the ground that
but three were read by the counsel before they
Were banded into Court.
The Court said that the other points were
merely the reduction to writing of points ex
pressed by
the oeunsel on the previous day.—
However, the counsel for defence might argue
thput now, if they chose.
They declined, and the Court concluded its
charge, by explaining the law applicable in the
case, and the various legal . definitions of the
terms of the indictment.
The jury retired at twelve o'clock.
TUE STADIOT.
. .
At half-past-four o'clock, - after an absence of
font. hours and a half, the Court was informed
that the jury were prepared to return their ver
dict.
The .foreman handed the Court the verdict,
which was recorled. The defendants, Hazen,
Morris, Davis and Lawsan, were found GUILTY
on all the counts except the 9th, (that relating
to the Messrs. Holmes.) '
Mr. Stokes moved judgment upon the verdict,
which was withdrawn, however, upon Mr. Dar
ragh stating that be intended snaking a motion
in arrest of judgment and for a new triaL
Mr. Stokes then moved as the defendants were
not in Court, their bail be forfeited and bench
warrants issued for their wrests.
After some debate, the bail a-as declared for
feited, and warrants issued.
EMOGISZ;=
Shortly afterwards the four defendants, with
the exceptionof Morris who had concealed him
self, were arrested and lodged in jail.
EXPLOSION ON A FEBILT BOAT.
ONB ZILLND AID A BOXBEII INJOBID.
-- We are seldom called on to record so disastrous
an accident as the one the particulars of which we
giro below. The whole affair, will doubtless, be
submitted to II rigid Oltamination, and the cense
of the accident ascertained.
As the ferry-boat;, General Scott, one of
Jones' Line, was about , leaving the lower land
ing, on the opposite side of the river, on Satur
day morning, about seven o'clock, on her return
trip to this city, both boilers exploded, one being
thrown over Lee's Ferry Boat into the river, a
distance of four hundred or five hundred feet,
and the other about one hundred and filly feet,
into the water, opposite the tollhouse.
The boat is badly injured; the floors destroyed
and the frame work and wheel-house be one side
carried away. The engine is also destroyed At
the time of the accident, there were eight pas
sengers, in addition to the employees. Three
women were uninjured; and a little boy and a
girl were slightly injured, and three men were
more or loss injured.
Jacob Badly, the Engineer, was instantane
ously }Alla By the force of the explosion he
was thrown upon the shore where be was picked
up dead. He was horribly mangled, his skull
bebag .fracturtd, 'and the upper part of his body
badly scalded. He was about 26 years of age,
and leartis a wife and one child in . Steubenville.
He had - been in the employ of Mr. Jones singe
last fall, previously he bad . been engaged in
Holmes' Shovel Factory; Ile was in the habit
of drinking. but not to that extent that he was
unable to attend to hle'duties.
Michael Nonelty, a farmer, of Noblestown, was
blown into the river, but succeeded in swimming
to a mfr. One of his legs was broken and he
was otherwise badly injured. He had with him
a two borne load of hay. The horse nearest to
the boilers was instantly killed, the other and
the wagon and load were blown Into the river;
the horse saved itselfley swimming ashore.
The steersman, Cries Davis, was very badly
injured. One of his thighs and on arm are bro
ken, his skull is fractured, and his head and face
scalded by steam; be is now lying at his board
ing house in Temperanceville, in a precarious
condition.
Johrainney was hlorp into the riser. but
was rescued. - He is.'rery badly ipjured (min
scalds and fractured. He is now lying insensible
at his residence. Temperancerille. His wife
was with him but was uninjured.
A lad named Philips was slightly cut on the
bead, and a little girl named Floyd was also
hurt. •
We gather from the testimony, which the
crowded state of our columns prevent us from
publishing entire, that the boat was five years
old; the boilers - were second-banded; the boiler
heads were replaced last fall; the Scott and Paw
nee were in the habit . of racing with the Walker,
the boilers on the ferry boats were not sufficient
to generate enough steam to 'carry the boat
through without pnehing.
The jury after examining the boat, the boiler,
'and viewing the body, adjourned to meet at the
Mayor's . offsee at 4 o'clock P. AL
Having re-assembled, an, individrud named
Spear testified to the strength of the boilers. .
The other witnesses being absent, the jury
again adjourned until this afternoon.
It Is the general belief that the accident was
caused by the lowness of water in the boiler.

treme depression of the previous week IBd ad
vance on Wheat; 5s fal on Flour; and 4s on
Corn. Wheat Flour closed with a good demand.
Corn quiet - Weather extremely fine.
Baring's report money as rather easier. Con
sols closed at 84. Rix dollars scarce at Ss 3
farthings. Bar silver 6s ljd. Businses in Amer
ican securities wa &almost totally suspended.
..T64 Russians are abandoning their forts on the
east coast of the Black Sea.

It is rumored that the Turks are preparing to
attack Sebastopol.
Napier's fleet at the last accounts, was again
under way, it is supposed,o seise the Island of
Aklaud. Kioge Bay is named as the rendez
vous.
The British Minister at Berlin had telegraphed
to Napier the declaration of war, with Instruc
tions to commence hostilities.

The Russians are making great preparations
for hostilities iMthe Baltic. All the light houses
and buoys are removed, and formidable fleets of
gunboats are collected in shallow water at the
principal points. Preparations are made to
block up the intricate parts of the channel with
rocks. All the houses at CronsMdt incapable of
defence are being pulled down, and now batte
ries are everywhero being erected. Two hun
dred additional gunboats have been ordered.—
The Czar and his son are, personally, superin
tendents.
Discontent prevails in Finland' and some ar
rests have been made.
Accounts from Greece are unfavorable. The
Turkish Minister left Athens. -The Greek in
surrection is reviving, but the Turks hold the
fortress and have 8000 troops in Epirus. En
voys are daily expected at Athens with the final
commands of the English and French govern
ments.
It is reported that several nobles have joined
the insurrection.
The whole French army of 60,000 will be in
.Turkey by the Ist of May.
:The first division of the expeditionary force is
being rapidly forwarded from Malta to Constan
tinople.
It is reported that the British land force will
be increased to 30,000.
Nominal Government Stocks continue to sell
for remittance. There is no demand for other
securities evert at lower prices.
BALT:mons, April 14.—The war news created
a great deal of feeling in this city to-clay. The
Hoar market became much excited, sales at $1
advance. .
BALTDIOIII April 15.--Orleanspapers of Sun
day are received. The news from ElPaso to the
30th ult. states that a fight had occurred
between parties from El Paso and Donna Anna.
The El Paso party was composed of 17 Ameri
cans, an EngSidman and a number of Mexicans
well armed and had a ,eix pounder. The fight
lasted 16 minutes when the Donna Anna party
fled, leaving three dead. The victors captured
a large number of cattle.
The American Consul lhas been arraigned be
fore the Alealde O&M Pease an a charge enter
ing mid that Sante'Amm bad sold part of Mexi
co end would pocket twenty millions thereby.—
The Canard refused to may anything to the charge,
but held himself responsible only.to oar govern
ment. Re 'was suffered to leave court.
Last Wednesday's proceedings of the Charles
ton Coutention.as detailed by the papers, show
nothing definite. The whole day was consumed
in a discussion on the Pacific Railroad question.
A ball took place at night which was a grand
affair, brilliant with Southern beauty.
The reporters of the New York Tribune,
Herald and Express were elected Secretaries of
the Contention, which caused some excitement
and was denounced in the News and Standard.

export demand; prices advanced 50 cents; soles
