District Attorney Roberts and F. C. Fhthigin
appeared for the Commonwealth; Col: kl'Can
dless, Hopkins and ToHoek for the prisoners.
John'ox .was arrested As' few days since,
charged with Laving - furnished the stick with
which thefatal blow way given.
After the opening address to the jury, Dr.
Weida was called to the witness stuid and testi
fied to the extent of the injuries of which M'Calt
died.. The tatal wounds wore upon the head,
the skulllbeing fractured..
George Shade testified to the effect that it was
on a Sabbath evening on which the affray oc
curred, about 4or fa o'clock. ili'Call came run
ning down from the tavern about 200 feet from
his house, past-him to Hopkins'. house whera he
boarded; Shade afterwards saw Hopkins going
towards the tavern. The witness then described
' some tussling which he saw; saw Mark Colon
pull off Me coat, when ho told them to come on,
he could whip them both, if they would show him
fair play. M'Call went towards him, and Down
ins was taking him away; Mark struck AVOW
Ast. the face; Mark. got out of the crowd; Mr.
Downing wisTrying - to get Mark away, and he
put on his 'cost and was going away; lloßkins,
who was being held, broke loose, when Mark
ran away from everybody in order to get his
coat off; lie went into another lot, where he-un
buttoned his shirt; M'Call walked up to him and
appeared ..to lay hie hands on the fence; at the
same Unto saw John For going down with a
stick trailing in his hand, about four feet long

stick to where, Mirk. was; shortly afterwards
Mark struck M'Call a double-handed blow over

Andrew Hopkins testified that he asked Cul
len if he was going to whip M'Call; he said he
would whip both him and witness; told him that
was enough- - he said he would not go home until
he whipped . M'Call; the witness was held by
several .persons; .saw-Cullen knock, deceased

saved him;Aot down 'to near where M'Call was

NEW Yong, April 10th
The Star of the Wert and the George Law,
from Aspinwall, arrived this forenoon with the
mails and 600 passengers.
The Courier gives a few items of intelligence
concerning Strain's party. The lieutenant with
two of his men reached Chapigana in quest of
provisions acid boats for the relict of - the remain
der, constituting nineteen, who had been left four
'Weeks p'Ftriloudy on the banks of the Churn
nague river. The party were 46 days in getting
from they - Atlantic to Point Yachts near the Pa
eiSe. On the 16th day out their provisions bi
came exhausted, and during the remainder of tlle
time they subsisted principally on nuts, suffering
intensely. All the men left behind were disa
bled.
Lieut. Strain reports that the Indians along :

It is reported that Domingo Elias was gaining
ground in Peru: Tacud and Arica had declared ,

possession of the Chineas.
The yellow fever was raging at Callao and
Lima.

The steamer Firefly was swamped at the mouth
of the Columbia on the 25th February. 'Five
men were drowned.
In Washington Territory, Columbia Lancas
ter has bed chosen a delegate to Congress.
Dates from Utah to the 2d of February, state
that the 'Mormons have adopted Resolutions in
favor of the immediate construction of a Pacific
Railroad through Salt Lake • Valley. Col. Bab
bitt has been sent to Washington with' the reso

'San Francisco, March 16th.—There is no im
provement In the markets. Galley's Flour is
quoted at $10,60; llama 11 ; Bacon lli• But
ter 21; Lard 101. Business is generally ex
tremely dull, and money tight.
The steamer Columbus from Lower California
had arrirod at San Franciico. She brought up
as a prisOner, Frederick Emery. Secretary of
State of the Republic of Sonora, who was arrest
ed at San Diego by order of Capt,Dornise of the
sloop of war 'Portsmouth.
President_Wallter was at last accounts forcing
