It is beyond question, Sir, that oar. Constitu
tion was framed by (lie lovers of human Rights;
that it wasaniimnted by their'divind %pirit . rthat
the institution off:Slavery was regarded by . them .
with aversions that,though covertly npridedto,
it was not named in the Instrument; .'that, ac
cording to the debates in the ConientiOn, - , they
refuse&to give it any "sanction," and lookod for-
Ward to the certain day when this evil and shame
would be obliterated from .tho land: , But the
original policy of tho Bovernment did ; not long
prevail. Tho generous sentiments which filled
the early patriots, giving - et : Ahem historic gran
deur, graduallylost their, power., ' The blessings
lirtieeluotileing already secured to: themselves,
the freehim of the land grow indifferent to the;
frcodom of others.. They ceased to think of the
slaves. The slava, masters availed themselves
of this indifference, And though few in number,
compared with tho nonalavelioltlers, ovon in the,
she; States, they have, under the influence of,
an imagined self-intercit, by the skilful, tactics
,of party, and espocisily by an unhesitating, . pea
severing union among themsolves—airaying, by
turns, both the great political parties—succeed
cd, through a long succession of years, in obtain-
ing the control' of the Federal Gorernment,
bending it to their purposes, compelling it to- do
their will, and impoaing upon it a policy friendly
to Slavery ; offensive to Freedom only, and di
rectly opposed to the sentiments of its founders.
Our Republic has grown in population sad pow
-er ; but. it hati fallen from its early moral great
ness., It is not now what it was at the begin
, ning,a;ltcpublic umiely'perinitting; while it re
gretted Slavery ; tolerating it only where it
could not he removed; and interdicting it whero
it dill not exist—but a mighty Propagandist,
openly favoring and vindicating pit; visiting, al
so, with displeasure all who,eynoso
The extent to whleli the original policy of 'the
Government has been changed can be placed
question.' Early in • oar history no man
was fiiaquslaficd fikpnblia office by reason of his
opinions on this subjoct; and this condition con:
tinned for a lengperloil.. As late atf 1821 John
W. Taylor of New Tvirh, who inid Pr&..sod with
so much, energy, not merely, the prohibition. of
Slavery ju the - Territory,-but.its restrictions in
the State of Missouri, woo elected to the chair
of Henry Clay- is .Bpealter of the other Rouse.
It is - needless to odd that no determined support.:
or of the Wilmot Proviso at this daycould expect
that eminent trust. arrogant and inwelent-,
ing ostracism is now applied, not only to all who
express • themselves against, Slavery, but 'to
every man who will. not bolts menial. - A novel
test for office has been ietioduced,,which would
have excluded all the Fatheni of tho Republic—
even Wtsnisc rev ,, JESPYMSON, and Fussxmx.
Yes; Sire startling it may be, dint lndisputable.
'Could these illustrious men descend from their
realms'above, and revisit tho'land which they
bad nobly d edicated to Freedom; theytetild not,
with the ir well known. rind recorded oPinions
against SliTery, receive a nomination. for the .
Presidency from either of the old , parties.. :Nor
timid John Jai, our first Chief Justice,- and
gicak,excmplar. of judicial virtue—who hated
Slavery as ho loved Justice—bo tulinittedlo re-
IMMO-those duties with which'his name - on earth
is indissolubly . associated. To ouch extent has'
our 'Government departed from the ancient ways.
- 'These facts prepare us to comprehenithe true
chariot& of the charge with regard to the Ter
ritories.. In 1787,1111 the existing. national do
main was promptly -and unanimously dedicated
to Freedom, without opposition or criticism.—
Tha interdict of Slavery then covered every inch

Freedom was compelled, by tv dividing line, to
partition with Slaiory. This arrangement,
which, in its very teens, won exclusively appli

present session of Congress; but now,*Sir , here

dm beginning, was a sectional , institution, with
no foothold anywhere on the national territory,
is now exalted as a national institution, and all
oar broad domain is threatened by its blighting
. But tho prohibition of Slavery . . tlo Terri

this account, tho Missouri Compromise ; s pre.

derived—whether filar the express grant, in the

rppOrt the piobibition of Alaseiy. The former
is an unquestionable infringement of sovereign
ty, as declared by our Supremo Court, far more
than aid lai_asserted ot the latter.
I am unwilling to admit that the prohibition
of Shively /tithe Territories is anyjuat ammo
an infringement of the local sovereignty. Wate
ry is an Infraction of the immutable law of Nat,
use,and as acuakeinnot bemad a natural
incident to any sovereignty, ;OW y. is conn-
try which has solemnly declared in it,, Declare:
lion of Independence, the inalenlableright of all
men to life liberty and the pursuit of happiness.
,In onager of eiviltvstion and in !ander rights,
Slavery may still be tolerated in fact; but its
prohibition, within - a - municipal jmisdletion, by
the ativernment thereof, BS by one of the States
of the Union, cannot be considered an infraction
ofnaturd right; nor can its prohibition - by Con;
grew in the Territories 'be regarded as an in
fringement of the locat sotereigutY4,-- • The na
sertedright to 'make a slave is against natural
rigid, and can be no just - element of sovereignty.
But another argument Is pressed, whieh seems
meet- fallacious in its chinteter. .It is asserted
that, inasmuch as the Territories. wore 'acquired
by the common treasure, they are common pro
.o of the whole Union; and therefore no eiti
e'en case prevented from moving into them ,with
his Slaves, without an infringement of the equal
rights awl . privileges which belong to hi m as is
citizen of the United , But it is admitted ,
that the peeple of this, very tirtitorY, when or '
itemized - TA a State; may, exeltdo, Stares, and in
this way abridge an asserted right -founded on
the common property.n. the territorY.- Now,
if this can be done by the fow thousand. settlers
,arii, constitute the State Government, the whole
argement founded on the acquisition of the terriL

-, But this argument proceeds on anassumption
which cannot stand. It assumes that davery is
a national institution, and that prOperty in slaves
is recogniied by the Constitution ofethel/nited
Stoke. Nothing can be more false.' By the
:judgment of the Supreme Court of. the United
State»; and aLso by the principles of the common
law, slavery is a local municipal institution which
derives its support' exolnsively from local muni
cipal laws, and beyond the sphere of these-lowa
it ceases to exist,:except so far-mitt may be pre
served by the claims for the rendition of fugi
tive fiumlabor.- , Madison tholight It. wrong to
rabid into the. Conatitution the Idealbst there
can be property' in rain p and I rejoice to believe.
that no such idea can be toned there. The Con
.stitutiosi regards slaves, always as "persona,"
with_the rights of "persitra,'l never as property.
When it is said, therefere; that every citizen: may .
enter the national domain with his: property,- it
does not follOw'or any' riffe• of logic or of law
that he may carry his qlavez. On the contrin-Y,
Inc can only carry that property which is admit
it'd to be such by- the universal bur of nature,
written by Gcd's coin finger on the heart of man.
Again': The \ relation Of mister and slave is
