Sherwin, of the arguments upon - which we 'gave a condensed report, yesterday. • Ilia Honor remarked in substance, that the ease Was one of an extraordinary nature, unex ampled in the administration of justice in the Courts of the United States. There had been greatdestruction of property of the eomplainapts by 11:ff:rep - too strong for suppression by 441314E tuu7 primes& of the Court; there was a breach of Its injunction by the reepondents, proved by the clearest and most satisfactory testimony; they were notified of the.particulars of this breach and informed, judicially, that on the sth of this month a motion would be made for their commit ment; the notices were reasonable; same of them were served on the alst of December, the oth er not later than the 3d of January; it was a ease of great emergency; there had been great spoliation of property; there was rt 4 ,0 11 to be lieve it was continuing and would be continued, , so that &longer notice would here been impreper, ; 'The respondent evidently thought' it scient, for on the 2d of Jarmary, theyappaared before a United States Commissioner, at Erie, and made affidavits of being innocent of violating the , junction; ,these affidavits were received and read at the bearing, and every proper consideration was given to them by the Court.
